A Joint Public Hearing of the Planning Commission and City Council was held on July 17, 2017
and called to order at 3:15 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Graves stated that for File 2303-P she along with Commissioner Mason, voted
against the request for a Specific Use Permit to allow a Gaming Room in a GC-MD-2 (General
Commercial-Multiple Family Dwelling-2) The motion should be 6:2 (Mason, Graves) instead of
7:1 (Mason). Commissioner Craig made a motion to approve the corrected minutes of the
Regular meeting held on June 17, 2017. Commissioner Senigaur seconded the motion. Motion to
approve carried 10:0.
REGULAR MEETING
1) Preliminary Plat-Wooten Oaks Addition, Phase 2: A request for the Preliminary Plat approval
of Wooten Oaks Addition, Phase 2, Beaumont, Jefferson County, Texas
Applicant: Faust Engineering & Surveying, Inc.
Location: South of Washington Boulevard at the southern end of Wooten Road within the
Beaumont City Limits
Mr. Boone presented the staff report.
Faust Engineering and Surveying, Inc. has requested preliminary plat approval of Wooten Oaks
Addition, Phase 2. The project is located south of Washington Boulevard at the southern end of
Wooten Road within the Beaumont City Limits. The development is a 4.3 acre, nineteen (19)
lot, single family, residential subdivision. The residential streets, Oak Dale and Willowglen
Drive, have a fifty foot (50’) right-of-way with a pavement width of twenty-six feet (26’). Water
and sewer will be provided by extension of City of Beaumont utilities.
Slides were shown of the subject property.
This item was sent to all interested parties.
Planning staff recommended approval with the following conditions:
1. Build a temporary cul-de-sac at the south end of Willowglen Drive.
2. Provide dimensions for all road center lines and center points for radii.
3. Comply with all water and sewer requirements (see attached memorandum).
No questions or comments for Mr. Boone. Richard Faust representing Faust Engineering &
Surveying, Inc., 2525 Calder Street, addressed the Commission. There were no questions or
comments for Mr. Faust. The public hearing closed. Commissioner Makin made a motion to
approve a request for Preliminary Plat approval of Wooten Oaks Addition, Phase 2, as requested
for the Preliminary Plat-Wooten Oaks Addition, Phase 2, with the following conditions:
1. Build a temporary cul-de-sac at the south end of Willowglen Drive.
2. Provide dimensions for all road center lines and center points for radii.

Commissioner Craig seconded the motion. Motion to approve carried 8:0.
JOINT PUBLIC HEARINGS
Mayor Ames called the Joint Public Hearings of July 17, 2017 to order and explained the
purpose of the Joint Public Hearing process and then turned the meeting over to Chairman Nejad.
1) File 2294-Z/P: Consider a request for Rezoning from R-S (Residential Single-Family)
District to RM-H (Residential Multiple-Family Dwelling Highest Density) District and a
Specific Use Permit to allow for an Assisted Senior Living Facility.
Applicant: Riceland Senior Living, LLC
Location: 2335 & 2365 South Major Drive
Mr. Boone presented the staff report.
Riceland Senior Living, LLC requested a Rezoning and Specific Use Permit for their property at
2335 and 2365 South Major Drive in June of this year, and was tabled. The request was to rezone
from R-S (Residential Single-Family Dwelling) to RM-H (Residential Multiple-Family Dwelling
Highest Density) with a Specific Use Permit to allow an Assisted Senior Living Facility. The
revised site plan allows for a single story structure of less than 15,500 square feet. Plans are to
accommodate no more than 24 individuals and required staff. Due to concerns regarding
drainage, storm water computations are attached.
1. TX DOT approval of driveways.
2. Provide sidewalk along Major Drive.
3. 6’ wide landscaping buffer along parking area as required by ordinance.
4. Garbage dumpster must be located a minimum of 25 feet from neighboring properties
and surrounded with a gated privacy fence.
5. Drainage District #6 and City Engineering must approve drainage plans.
Slides of the subject property were shown. Mr. Senigaur asked if there was a detention pond for
drainage. Mr. Boone stated that decision would be based on the engineers. He also stated that
there was discussion during the workshop, about the appropriateness of the zoning. A brief
discussion followed. Twenty (20) notices were mailed to property owners within 200 feet of the
subject property. One response was received in favor and one was received in opposition.
Mr. Kent Johns, 2640 Calder, addressed the Commission. Mr. Johns stated the facility will have
the following amenities; private pay, single story residence with an 8 foot privacy fence, thirty-
five (35) parking spaces, 20 foot setbacks and it will be landscaped. He also stated that his client
intends to comply with TXDOT and Drainage District #6 regarding the drainage issues. The
public hearing opened. No one spoke for or against the case. The public hearing closed.
Commissioner Senigaur made a motion to approve the request for a Rezoning from R-S

(Residential Single-Family) District to RM-H (Residential Multiple-Family Dwelling Highest
Density) District and a Specific Use Permit to allow for an Assisted Senior Living Facility as
requested for File 2294 Z/P with the following conditions:
1. TX DOT approval of driveways.
2. Provide sidewalk along South Major Drive.
3. 6’ wide landscaping buffer along parking area as required by ordinance.
4. Garbage dumpster must be located a minimum of 25 feet from neighboring properties
and surrounded with a gated privacy fence.
5. Drainage District #6 and City Engineering must approve drainage plans.
Commissioner Craig seconded the motion. Motion to approve carried 9:1 (Mason). The Mayor
asked if the facility was licensed. Mr. Johns replied, yes.
2) File 2300-P: A request for a Specific Use Permit to allow a church in an RCR (Residential
Conservation Revitalization) District.
Applicant: Guadalupe Serna
Location: 1728 Park Street
Mr. Boone presented the staff report.
Guadalupe Serna would like to use the property at 1728 Park Street for a church. The
congregation proposes to have services on Sunday morning from 10a.m. to 12 noon, Sunday
evenings from 7p.m. to 9p.m., Wednesday evenings from 7p.m. to 9p.m. and Friday evenings
from 7p.m. to 9p.m. The church will also be used for various birthday, wedding and anniversary
celebrations.
A ten (10) foot wide landscaped buffer will need to be provided along the neighboring property
lines and perimeter landscaping is required at the street along the parking area. In addition, an
eight (8) foot wood or masonry fence is required to be maintained between commercial and
residential uses.
The parking area should be paved with striping as per the submitted site plan. ADA parking must
be installed per ordinance requirements.
Slides of the subject property were shown.
Sixteen (16) notices were mailed to property owners within 200 feet of the subject property. One
response was received in favor and no responses were received in opposition.
The Planning staff recommended approval with the following conditions:
1. Landscaping and screening will be required to meet ordinance requirements.

2. Garbage dumpster must be located a minimum of 25 feet from neighboring properties
and surrounded with a gated privacy fence.
3. Parking must be paved and striped as per site plan. ADA parking must be provided as
per ordinance requirements.
No questions or comments for Mr. Boone. Mr. Serna’s daughter addressed the Commission.
Commissioner Graves questioned what is the number of parishioners and the denomination of
the church. Mr. Serna’s daughter stated 30 and the denomination is Pentecostal. No further
questions or comments were made. No one spoke in favor or against the case. The public hearing
closed.
Commissioner Craig made a motion to approve a request for a Specific Use Permit to allow a

with the following conditions:

3) File 2304-P: A request for a Specific Use Permit to allow a CPA office in an RCR-H
(Residential Conservation Revitalization-Historic) zoning in the Oaks Historic District.
Applicant: Sam Parigi
Location: 2643 North Street
Mr. Boone presented the staff report.
Sam Parigi, property manager, is requesting a Specific Use Permit to allow a Certified Public
Accountant's office at for the property at 2643 North Street. The proposed tenant does not have
excessive foot traffic, but plans to pave the backyard of the property to provide all required off-
street parking.
As the property is located in RCR-H (Residential Conservation Revitalization - Historic) zoning,
a Specific Use Permit is required for any use change. In addition, as the property is located in
the Oaks Historic District, all exterior changes and improvements to the property must be
approved by the Historic Landmark Commission.
Staff recommends approval of the request with a waiver to the landscaped buffer and screening
as requested, and the following conditions:

3. Parking will be allowed only at the rear of the property. All parking must be paved with
concrete, asphalt or pavers and striped per ordinance requirements.

5. Runoff from new parking must be directed toward North Street and not run off on
neighboring properties.
Slides were shown of the subject property. Twenty-seven (27) notices were mailed to property
owners within 200 feet of the subject property. One response was received in favor and none in
opposition. Chairman Nejad questioned if North Street has any drainage issues. Mr. Boone

stated that it is curb and guttered. A brief discussion followed. Sam Parigi, Jr., 445 N. 14 Street,
addressed the Commission. Mr. Parigi stated that for the past 35 years the building has been used
as an office building. He is in the process of selling the building and there are two individuals
that would like to operate a CPA firm at this location. Mr. Parigi stated that the individuals
agreed to the conditions and will comply. He said that they would put an asphalt parking lot in
the rear. The public hearing opened. No one spoke in favor or against the case. The public
hearing closed. Commissioner Little made a motion to approve a request for a Specific Use
Permit to allow a CPA office in RCR-H (Residential Conservation Revitalization-Historic)
zoning in the Oaks Historic District as requested for File 2304-P with the following conditions:
1. Approval of any exterior changes and improvements by the Historic Landmark
Commission.
2. Parking will be allowed only at the rear of the property. All parking must be paved with
concrete, asphalt or pavers and striped per ordinance requirements.
3. ADA parking must be provided as per ordinance requirements.
Commissioner Senigaur seconded the motion. Motion to approve carried 10.0.
4) File 2306-P: A request for a Specific Use Permit to allow an automotive parts wholesale
distribution center in the CBD (Central Business District).
Applicant: Bayou Ventures, Inc.
Location: 660 Fannin
Mr. Boone presented the staff report.
Bayou Ventures, Inc. is requesting a Specific Use Permit to operate a wholesale automotive parts
distribution center at 660 Fannin Street. Kyle Stratton, owner of Bayou Ventures, has been in
operation since 2008 and is hoping to expand. The new products will require more space, which
he feels the property at 660 Fannin Street can provide. All products are delivered, and there will
be no store front for retail sales. A new garage door opening will be cut in the front of the
structure to provide better access to the space.
Slides of the subject property were shown. Staff recommends approval of the request.
Nine (9) notices were mailed to property owners within 200 feet of the subject property. One
response was received in favor and none were received in opposition. Staff recommended
approval of the request. The applicant, Kyle Stratton, 2134 Stillwater addressed the Commission.

Mr. Stratton stated the he has outgrown his current facility that has been open since 2008. Mr.
Weinbaum, the seller drafted a proposal for Mr. Stratton. Mr. Stratton also stated that he had
plans to cut a commercial door at the front of the building and he will be selling catalytic
converters, pipes and mufflers. Mr. Charlie Weinbaum, 675 Wade Street, addressed the
Commission. Mr. Weinbaum stated that he was happy to have Mr. Stratton as an occupant of the
building. The public hearing opened. No one spoke in favor or against the case. The public
hearing closed. Commissioner Craig made a motion to approve a request for a Specific Use
Permit to allow an automotive parts wholesale distribution center in the CBD (Central Business
District) as requested for File 2306-P. Commissioner Cook seconded the motion. Motion to
approve carried 10:0.
6) File 875-OB: A request for a waiver to the sidewalk requirement along South Major Drive.
Applicant: Maverick Engineering
Location: 1345 S. Major Drive
Mr. Boone presented the staff report.
Maverick engineering is requesting a waiver to the requirements for a sidewalk at 1345 South
Major Drive. The sidewalk would be required as part of the proposed BAPS temple project at
this location.
An email from TXDOT indicates that a sidewalk would not be feasible as it would interfere with
the existing ditch in the right-of-way.
This item was sent to all interested parties.
Planning staff recommended approval. Slides of the subject property were shown.
Mr. Boone stated that TXDOT’s engineer and the City of Beaumont’s engineer recommended a
waiver. A brief discussion followed. Chairman Nejad suggested to Mr. Boone that they discuss
the sidewalk issue during the workshop at one of the upcoming meetings. The applicant, Ashwin
Patel, 3518 Caffin Drive addressed the Commission. Mr. Patel stated he is the owner of the
BAPS Mandir & Cultural Center. Discussion followed. The public hearing opened. No questions
or comments. The public hearing closed. Commissioner Senigaur made a motion to approve a
request for a waiver to the sidewalk requirement along South Major Drive as request for File
875-OB. Commissioner Craig seconded the motion. Motion to approve carried 10:0.
