2017 and called to order at 3:15 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Makin made a motion to approve the minutes of the Regular meeting held on
May 15, 2017. Commissioner Senigaur seconded the motion. Motion to approve carried 7:0.
REGULAR MEETING
1) Rolat-Lot 35, Block D, into Lots 35A and 35B, Block D, Mayfair Second Addition: A
request for the Replat of Lot 35, Block D, into Lots 35A and 35B, Block D, Mayfair Second
Addition, Beaumont, Jefferson County, Texas
Applicant: Fittz & Shipman, Inc.
Location: 1690 Montrose Street
Mr. Boone presented the staff report.
Fittz and Shipman, Inc. has requested approval of the replat of Lot 35, Block D, Mayfair Second
Addition, into Lots 35A and 35B, Block D, Mayfair Second Addition, Beaumont, Jefferson
County, Texas. The property is located at 1690 Montrose Street. The proposed 0.7549 acre
replat will create two lots. Beaumont water and sanitary sewer are available for all proposed lots.
Slides were shown of the subject property.
Twenty-one (21) notices were mailed to property owners within 200 feet of the subject property.
There were no responses received in favor or in opposition.
Planning staff recommended approval. A waiver is requested to the required minimum lot width
of 50 feet. No questions or comments for Mr. Boone. Mitch Brackin representing Fittz &
Shipman, Inc., 1405 Cornerstone Court, addressed the Commission. Mr. Brackin stated that the
lot originally had two existing homes on it for a few decades. The public hearing opened. No
other questions or comments. Commissioner Little made a motion to approve the request for the
replat of Lot 35, Block D, into Lots 35A and 35B, Block D, Mayfair Second Addition as
requested. Commissioner Mason seconded the motion. Motion to approve carried 8:0.
2) Preliminary Plat -Meadows Springwood, Section 2: A request for a Preliminary Plat approval
of Springwood, Section 2, Beaumont, Jefferson County, Texas.
Applicant: Faust Engineering & Surveying, Inc.
Location: Northwest end of Alexis Street, northwest of RFD Road
Mr. Boone presented the staff report.
Faust Engineering & Surveying, Inc. has requested preliminary plat approval of Springwood,
Section 2. The project is located within the City of Beaumont at the northwest end of Alexis
Street, northwest of RFD Road. The development is an 8.76 acre, thirty-nine (39) lot, single
family, residential subdivision. Both Riplee and Kayla, residential streets, will have a 50' right-
of-way and 27' wide pavement and Alexis, a minor collector, will have a 60' right-of-way and
36' wide pavement. Utilities will be provided by extension of City of Beaumont water and

sewer.
The item was sent to all interested parties. There were no responses received in favor or in
opposition.
Planning staff recommended approval with the following conditions:
Provide a temporary cul-de-sac at the northwest end of Alexis Street.
No questions or comments for Mr. Boone. Richard Faust representing Faust Engineering &
Surveying, Inc., 2525 Calder Street, addressed the Commission. There were no questions or
comments for Mr. Faust. The public hearing closed. Commissioner Little made a motion to
approve a request for Preliminary Plat approval of Springwood, Section 2, as requested with the
following conditions:
1. Provide a temporary cul-de-sac at the northwest end of Alexis Street.
Commissioner Makin seconded the motion. Motion to approve carried 8:0.
JOINT PUBLIC HEARINGS
Councilmember At -Large Gethrel Williams -Wright called the Joint Public Hearings of June 19,
2017 to order and explained the purpose of the Joint Public Hearing process and then turned the
meeting over to Vice -Chairman Craig. Vice -Chairman Craig explained the policies and
procedures for the hearing process.
1) File 2294-Z/P: Consider a request for Rezoning from R-S (Residential Single -Family)
District to RM-H (Residential Multiple -Family Dwelling Highest Density) District and a
Specific Use Permit to allow for an Assisted Senior Living Facility.
Applicant: Riceland Senior Living, LLC
Location: 2335 & 2365 Major Drive
Mr. Boone stated that he was given a modified site plan shortly before the meeting. Kent Johns,
representing Riceland Senior Living, LLC addressed the Commission and stated that they would
like to table File 2294-Z/P so that the Planning and Zoning Department can review the revised
site plans.
Commissioner Little made a motion to table the request for a Rezoning from R-S (Residential
Single -Family) District to RM-H (Residential Multiple -Family Dwelling Highest Density)
District and a Specific Use Permit to allow for an Assisted Senior Living Facility. Commissioner
Senigaur seconded the motion. Motion to table the request carried 7:0.
2) File 2299-Z: A request for a Zone change from LT (Light Industrial) to GC -MD (General
Commercial -Multiple Family Dwelling) or a more restrictive district.
Applicant: Joseph Endari
Location: 1575 Evalon Avenue

Joseph Endari is requesting a rezoning of the property located at 1575 Evalon Avenue. Three lots
fronting on M.L. King Parkway are zoned GC -MD (General Commercial - Multiple Family
Dwelling District). These three lots, although adjacent to the first three, are zoned LI (Light
Industrial). Mr. Endari hopes to have the entire property zoned GC -MD, so that it could be
developed as a unit.
Slides of the subject property were shown.
Ten (10) notices were mailed to property owners within 200 feet of the subject property. No
responses were received in favor and one response was received in opposition.
The Planning staff recommended approval. The applicant, Joseph Endari, 1575 Evalon,
addressed the Commission. A brief discussion followed. Mr. Endari stated that it would be
efficiency apartments for low income individuals and that the apartments would not be
government subsidies. Mr. Jeron, 3550 Wescalder Street, addressed the Commission. He asked
Mr. Endari what his intentions were involving the apartments since the government would not be
involved. Mr. Jeron stated that he felt since the government would not be involved, he would be
entitled to not adhere to the guidelines. Mr. Endari stated each individual would have the
opportunity to have their own apartment and not have to share a kitchen or bath with any other
individuals. Vice -Chairman Craig assured Mr. Jeron that the project would have to be reviewed
by Council and that Mr. Endari would have to adhere to his intentions. No other questions or
comments. The public hearing closed. Commissioner Senigaur made a motion to approve the
request for a Zone change from LI (Light Industrial) to GC -MD (General Commercial -Multiple
Family Dwelling) as requested for File 2299-Z. Commissioner Mason seconded the motion.
Motion to approve carried 8:0.
3) File 2301-P: A request for a Specific Use Permit to allow parking of Commercial and
Industrial trucks in GC -MD (General Commercial -Multiple Family Dwelling) District.
Applicant: Hector O. Molina
Location: 5290 Highland Avenue
Mr. Boone presented the staff report.
Hector Molina has requested a Specific Use Permit to allow parking of commercial vehicles and
industrial trucks at 5290 Highland Avenue. The property is zoned GC -MD (General
Commercial - Multiple Family Dwelling), and is adjacent to residential properties. Mr. Molina
states that the existing house is to be demolished, and the entire parking area will be screened
with an eight (8) foot fence.
This use is not compatible with the neighborhood. This is primarily a residential neighborhood.
While parking of Industrial/Commercial trucks may provide a service to specific individuals in
the neighborhood, it does not provide a service to the community as a whole.
Staff recommended denial of the request. If the request is approved, staff recommended the
following conditions:

1. Perimeter landscaping will be required to meet ordinance requirements along Hillebrandt
Street and Highland Avenue.
2. Construct a sidewalk along Highland Avenue.
3. No engine, body or tire repairs to be done at this site.
Slides were shown of the subject property. Thirty-one (31) notices were mailed to property
owners within 200 feet of the subject property. No responses were received in favor or in
opposition. Mr. Boone stated that the SUP would not be in the best interest of the neighborhood
or most compatible. Councilmember Wright asked what would be the hours of operation. Mr.
Molina, 2820 Helena, Apt. 28, Nederland, Texas addressed the Commission. Mr. Molina stated
he parks his trucks at a gas station on West Port Arthur Road and that he only owned one (1)
dumptruck. Mr. Molina stated his hours are from 7 a.m. to 4 p.m. Howard Jeron at 3550
Wescalder addressed the Commission. Mr. Cooper stated that a condition could be added to the
request. Discussion followed. The public hearing closed. Commissioner Senigaur made a motion
to approve a request for a Specific Use Permit to allow parking of Commercial and Industrial
trucks in a GC -MD (General Commercial -Multiple Family Dwelling) District as requested for
File 2301-P. Commissioner Beatty seconded the motion. Motion to deny carried 5:3.
4) File 2303-P: A request for a Specific Use Permit to allow a Gaming Room in a GC-MD-2
(General Commercial -Multiple Family Dwelling-2) District.
Applicant: Truong V. Le
Location: 2916 E. Lucas
Mr. Boone presented the staff report.
Truong V Le has requested a Specific Use Permit to allow a Gaming Room in his property at
2916 E. Lucas Drive. In 2004, Mr. Le submitted an application to rezone the north part of his
property to GC-MD-2 (General Commercial - Multiple Family Dwelling-2) with a Specific Use
Permit to allow a strip mall with retail stores and restaurants. One of these existing businesses
plans to install between 15 and 20 machines. The hours of operation for the business would be
1 Oam to 1 Opm.
Another concern is the numerous single family dwelling properties in close proximity to the
proposed Gaming Room. Security could be a concern due to these properties.
Slides of the subject property were shown.
Staff recommends approval of the request with the following condition:
1. Limited to no more than 20 machines.
Twenty-five (25) notices were mailed to property owners within 200 feet of the subject property.
Two responses were received in favor and none were received in opposition. Commissioner
Makin asked Mr. Boone to show the slide that showed where the game room was going to be

located. The applicant, Truong Van Le, 2916 E. Lucas Drive, addressed the Commission.
Discussion followed. Mr. Le stated that in the contract to the Lesee, it states that the hours of the
game room are from 10 a.m. to 10 p.m. If the Lessee violates the contract, the game room will be
closed and the lease will be paid in full. Vehicles that remain on the property past 10 p.m. will be
towed at the owner's expense. Discussion continued. No one spoke in favor or against the
request. The Public hearing closed. Commissioner Makin made a request to approve a request for
a Specific User Permit to allow a Gaming Room in a GC-MD-2 (General Commercial -Multiple
Family Dwelling-2) District as request for File 2303-P with the following conditions:
1. Limited to no more than 20 machines.
2. The hours of operation are from 10 a.m. to 10 p.m.,
Commissioner Beatty seconded the motion. Motion to approve carried 7_;—I Mason).
5) File 872-OB: A request for the abandonment of a portion of the West Euclid cul-de-sac.
Applicant: J.C. Modica
Location: The 3600 block of W. Euclid Street
Mr. Boone presented the staff report.
J. C. Modica is requesting an abandonment of a portion of the cul-de-sac for the Euclid Street
right-of-way, located at 3650 W. Euclid Street. This portion of Euclid Street was never
developed and this portion of the platted cul-de-sac is unused. Mr. Monica states that this
abandonment will allow him to square up the property he purchased to the north.

Planning staff recommended approval. Slides of the subject property were shown.
The applicant, J.C. Modica, 7875 Indian Blanket addressed the Commission. A brief discussion
followed. Mr. Modica stated that he would fence in his place of business due to break ins.
Commissioner Seniguar made a motion to approve a request for the abandonment of a portion of
the West Euclid cul-de-sac as requested or File 872-013. Commissioner Mason seconded the

6) File 873-OB: A request for the abandonment of the alley in the Block 7, West Oakland
Addition.
Applicant: Greater Grace Temple
Location: 3540S. 11 th Street
Mr. Boone presented the staff report.
Greater Grace Temple has requested the abandonment of the alley located at 3540 S. 11th Street.
The congregation owns the entire block, and would like to construct a church building and
parking. The alley runs through the middle of their property. The church hopes to abandon the
alley without the retention of an easement.

Bishop R.N. Robinson, 9230 Mapes Street addressed the Commission. Bishop Robinson asked
the board to grant their request. Commissioner Senigaur made a motion to approve a request for
the abandonment of the alley in Block 7, West Oakland Addition. Commissioner Little seconded
the motion. Motion to approve carried 8:0.
7) File 874-OB: A request to abandon a 6' wide utility easement along Sulphur Plant Road
Applicant: Natgasoline, LLC
Location: Along Sulpher Plant Road, east of the Beaumont City Limit line
Mr. Boone presented the staff report.
Natgasoline, LLC, has requested the abandonment of the 6' wide utility easement located along
Sulphur Plant Road, just east of the Beaumont City Limit line. The easement was for a water
line. Due to the privatization of Sulphur Plant Road by Natgasoline and Martin Gas security, this
portion of the easement is no longer needed. Abandonment of the easement would allow much
needed access by Martin Gas for maintenance purposes. A new water meter, outside the
privatized area, has been provided in the remaining portion of the easement.

Devin Jones representing Sigma Engineers, 4099 Calder Avenue addressed the Commission.
Discussion followed. Mr. Jones stated that they were proposing to install a new water meter near
the drainage ditch and abandon the easement. No questions or comments. Commissioner Mason
made a motion to approve a request for an abandonment of a 6' wide utility easement along
Sulphur Plant Road as requested for File 874-OB. Commissioner Cook seconded the motion.
Motion to approve carried 7:0.
