Commissioner Colbert seconded the motion. Motion to approve carried 6:0. REGULAR MEETING 1) Replat-Lot 1, 2 and part of Lot 3, Block 16, Calder Place: A request for the Replat of Lots 1 and 2 and the south 69.90’ of Lot 3, Block 16, Calder Place Addition, Beaumont, Jefferson County, Texas Applicant: Faust Engineering and Surveying, Inc. rd Location: 905 and 945 N. 23 Street Mr. Boone presented the staff report. Faust Engineering and Surveying, Inc. has requested approval of the replat of Lot 1, Lot 2 and the south 69.90' of Lot 3, Block 16, Calder Place Addition, into Lots 1A, and 2A, Block 16, Calder Place Addition, Beaumont, Jefferson County, Texas. The property is located at 905 and 945 North 23rd Street. The proposed 3.23 acre replat will create two larger lots. Beaumont water and sanitary sewer are available for all proposed lots. Twelve (12) notices were mailed to property owners within 200 feet of the subject property. No notices were received in favor or in opposition. Slides were shown of the subject property. Planning staff recommended approval. No questions or comments for Mr. Boone. The applicant was not present. No discussion followed. Commissioner Mason made a motion to approve the request for the replat of Lot 1, Lot 2 and the south 69.90’ of Lot 3, Block 16, Calder Place Addition as requested. Commissioner Colbert seconded the motion. Motion to approve carried 6:0. 2) Preliminary Plat-Meadows Subdivision, Phase 3 West: A request for a Preliminary Plat approval of the Meadows Subdivision Phase Three-West, Beaumont, Jefferson County, Texas. Applicant: Schaumburg & Polk Location: Southeast corner of Keith Road and Dishman Road Mr. Boone presented the staff report. Schaumburg & Polk, Inc. has requested preliminary plat approval of The Meadows Subdivision Phase Three - West. The project is located at the southeast corner of the intersection of Keith Road and Dishman Road, within the city limits. The development is a 9.376 acre, thirty-four (34) lot, single family, residential subdivision. With the exception of the northern part of Meadow Run, with its sixty (60) foot right-of-way and thirty-seven (37) foot wide pavement, all other streets will have a fifty (50) foot right-of-way and twenty-seven (27) foot wide pavement. The proposed water and sewer will be serviced by City of Beaumont utilities. 2 Planning and Zoning May 15, 2017 The item was sent to all interested parties. Planning staff recommended approval with the following conditions: 1. Provide drainage easements for all ditches temporary or permanent. 2. Provide addresses for all lots. Troy Whitehead representing Schaumburg & Polk, Inc. addressed the Commission. Mr. Whitehead stated that this project is a continuation of residential development. No questions or comments for Mr. Whitehead. The public hearing closed. Commissioner Little made a motion to approve a request for Preliminary Plat approval of The Meadows Subdivision Phase Three-West as requested, with the following conditions: 1. Provide drainage easements for all ditches temporary or permanent. 2. Provide addresses for all lots. Commissioner Mason seconded the motion. Motion to approve carried 6:0. JOINT PUBLIC HEARINGS Mayor Ames called the Joint Public Hearings of May 15, 2017 to order and explained the purpose of the Joint Public Hearing process and then turned the meeting over to Vice-Chairman Craig. Vice-Chairman Craig explained the policies and procedures for the hearing process. 1) File 2296-P: Consider a request for a Specific Use Permit to allow the expansion of a church in an RS (Residential Single Family Dwelling) District. Applicant: John Polk Location: 7750 Highway 105 Mr. Boone presented the staff report. John Polk has requested a revised Specific Use Permit to allow Northwest Church of Christ to expand at their existing location, 7750 Highway 105. In August of 1984, the church received a Specific Use Permit to operate a church at this location. The church has grown and is in need of additional space for classrooms. The operational hours of the church will not change. The surrounding property is zoned RS to the north and west, and is currently vacant. At such time as the neighboring properties should be developed as residential uses, an eight (8) foot wood or masonry privacy fence should be installed along these property lines. In addition, a ten (10) foot wide landscaped buffer would need to be installed along these property lines as required by Ordinance. The additional parking will need landscaped islands as required by Ordinance. Slides of the subject property were shown. 3 Planning and Zoning May 15, 2017 Twelve (12) notices were mailed to property owners within 200 feet of the subject property. Seek approval from TXDOT for the proposed storm drain system. 2. When adjacent property is developed, install the required eight (8) foot fence and ten (10) foot wide landscaped buffer along the north and west property lines. 3. New parking area shall be designed to include all required landscaping. 4. Construct a sidewalk along front of the property. The applicant, Mr. John Polk, 7750 Highway 105 addressed the Commission. Mr. Polk stated that they would be adding approximately 3200 square feet of classroom space and additional storm sewer will be installed along with a fire hydrant. Mr. Boone stated that the City of Beaumont is working on installing sidewalks throughout the city. No further discussion followed. No questions or comments. The public hearing closed. Commissioner Mason made a motion to approve the request for a Specific Use Permit to allow the expansion of a church in an RS (Residential Single Family Dwelling) District as requested for File 2296-P with the following conditions: 1. Motion to approve carried 6:0. 2) File 2297-Z: A request for a rezoning from RM-H (Residential Multiple Family Dwelling- Highest Density) to GC-MD-2 (General Commercial-Multiple Family Dwelling-2) or a more restrictive district. Applicant: Shaver Family Partners, LTD Location: 2576 & 3586 Blackmon Lane Mr. Boone presented the staff report. Shaver Family Partners, LTD, is requesting a zone change for the construction of a single-story office building. A Specific Use Permit would be required, in the future, for any proposed use. Blackmon Lane, the only access to the property, is a 20 foot wide residential street. All utilities accessed by the property are of residential grade. Although the zoning would be compatible with the surrounding area, the street and utilities would need to be upgraded for any commercial use. 4 Planning and Zoning May 15, 2017 Planning staff recommended approval of the request. Seventy-five (75) notices were mailed to property owners within 200 feet of the subject property. Five (5) responses were received in favor and no responses were received in opposition. Slides of the subject property were shown. The applicant, Don Shaver, 269 Richland, representing Shaver Family Partners, LTD addressed the Commission. A brief discussion followed. No questions or comments. The public hearing closed. Commissioner Little made a motion to approve the request for a rezoning from RM-H (Residential Multiple Family Dwelling-Highest Density) to GC-MD-2 (General Commercial- Multiple Family Dwelling-2) or a more restrictive zoning District as requested for File 2297-Z. Commissioner Cook seconded the motion. Motion to approve carried 6:0. 3) File 871-OB: A request for the abandonment of a portion of the Sawyer Street right-of- way. Applicant: Mark A. Fertitta Location: Sawyer Street just south of Laurel Street Mark Fertitta, manager of SET Asset Properties, LLC (owner of 191 11th Street), is requesting an abandonment of this portion of Sawyer Street. The building located at 191 11th Street encroaches into the Sawyer Street right-of-way 4.9 feet. The request is made to satisfy requirements of a potential lessor. The property has operated in the past under a license to encroach, but this arrangement is problematic, given that the potential tenant may perform extensive upgrades to the property. This item was sent to all interested parties. Planning staff recommended approval of the request. Slides were shown of the subject property. Discussion followed between the Mr. Boone and the Commission. The applicant, Mark Fertitta, 175 W. Caldwood addressed the Commission. A brief discussion followed. Mr. Fertitta stated that UTMB would not sign a lease for the property unless the abandonment was granted. No further discussion. No questions or comments. The public hearing closed. Commissioner Mason made a motion to approve a request to abandon a portion of the Sawyer Street right-of-way as requested for File 871-OB. Commissioner Little seconded the motion.
