Vice-Chairman Mason seconded the motion. Motion to approve the minutes carried 9:0. REGULAR MEETING 1) Replat-VCCB: Consider a request of a Replat of Lots 18 & 19 Beaumont Orange and Fig Subdivision into Lots 1-7, VCCB Subdivision, Beaumont, Jefferson County, Texas. Applicant: Mark W. Whiteley & Associates, Inc. Location: 9325-9435 Phelan Boulevard Mr. Boone presented the staff report. Mark W. Whiteley & Associates, Inc. has requested approval of the replat of Lots 18 & 19 Beaumont Orange and Fig Subdivision into Lots 1-7, VCCB Subdivision, Beaumont, Jefferson County, Texas. The property is located at 9325- 9435 Phelan Boulevard. The proposed 4.2962 acre replat will create seven (7) lots. Beaumont water services will be installed by the City at the developer's expense as houses are constructed. Individual sanitary sewer services will require further coordination with Water Utilities. This is due to the City's sanitary sewer main being located under the pavement of Phelan Boulevard. Five notices were mailed to property owners within 200 feet of the subject property. There were no responses received in favor or in opposition. Planning staff recommended approval with the following condition: 1. If gas service is to be provided, show a general utility easement on the plat. Slides of the subject property were shown. Commissioner Steinhagen asked if sidewalks were needed. Mr. Boone replied he believed they were already there. No other questions for Mr. Boone. Mr. Rowe stated that Centerpoint could not provide them an answer regarding the gas line. No questions for Mr. Rowe. The public hearing closed. Commissioner Makin made a motion to approve the request for the Replat of Lots 18 & 19 Beaumont Orange and Fig Subdivision into Lots 1-7, VCCB Subdivision, Beaumont, Jefferson County, Texas as requested. Commissioner Senigaur seconded the motion. Motion to approve carried 9:0. 2) Replat-Lots 7A & 8A, Block 56, Van Wormer Addition- Request for approval of a Replat of Lots 7-10 into Lots 7A & 8A, Block 56, Van Wormer Addition, Beaumont, Jefferson County, Texas Applicant: Mark W. Whiteley & Associates, Inc. Location: 1150 Fannin Street and 561 Victoria Street Mr. Boone presented the staff report. Mark W. Whiteley & Associates, Inc. has requested approval of the replat of Lots 7- 10, into Lots 7A & 8A, Block 56, Van Wormer Addition, 2 Planning and Zoning August 20, 2018 Beaumont, Jefferson County, Texas. The property is located at 1150 Fannin Street and 561 Victoria Street. No new infrastructure will be needed for this replat. The purpose of the plat is to create two (2) lots. Lot 8A is designated for a cell tower and is proposed to be 60'x60'. A waiver is requested for the minimum lot width and depth requirements of 100 feet for a lot in an LI (Light Industrial) District. A Specific Use Permit for the cell tower was approved by the Planning Commission and City Council in May of this year. Six notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor or in opposition. The Planning staff recommended approval subject to a waiver to the minimum lot width and depth requirements for Lot 8A. Tom Rowe, representing Mark W. Whiteley & Associates, Inc. 3250 Eastex Freeway addressed the Commission. No questions or comments for Mr. Rowe. The public hearing closed. Vice-Chairman Mason made a motion to approve the request of a Replat of Lots 7- 10, into Lots 7A and 8A, Block 56, Van Wormer Addition as requested. Commissioner Makin seconded the motion. Motion to approve carried 9:0. JOINT PUBLIC HEARING Councilmember Samuel called the Joint Public Hearing of August 20, 2018 to order and explained the purpose of the Joint Public Hearing process and then turned the meeting over to Chairman Nejad. Chairman Nejad explained the policies and procedures for the hearing process. 1) File 885-OB: Request for renaming Homsar Pointe Boulevard to Northwest Parkway. Applicant: City of Beaumont Planning Division Location: A ~385 foot portion of Homsar Pointe stretching east of Major Drive Mr. Boone presented the staff report. The City has entered the final stages of completing the new Northwest Parkway thoroughfare, which will connect Old Dowlen Road to Major Drive. The connecting point at Major Drive is scheduled to incorporate the existing Homsar Pointe Boulevard. To avoid any confusion, staff is requesting that Homsar Pointe Boulevard be renamed to Northwest Parkway. This item was sent to all interested parties. Slides of the subject property were shown. Vice-Chairman Mason inquired about the addresses for the existing apartment complex. Mr. Boone stated it would not pose a problem for the tenants. No public hearing was required. 3 Planning and Zoning August 20, 2018 Commissioner Senigaur made a motion to approve the request to rename Homsar Pointe Boulevard to Northwest Parkway as requested for File 885-OB. Vice-Chairman Mason seconded the motion. Motion to approve carried 9:0. 2) File 2344-P: Request for a Specific Use Permit to allow a Gaming Room in a C-M (Commercial Manufacturing) District. Applicant: Xuong Tuan Ta Location: 6470 Washington Boulevard Mr. Boone presented the staff report. Xuong Tuan Ta has requested a Specific Use Permit to allow a gaming facility at 6470 Washington Boulevard. The applicant wishes to have 35 gaming machines at this location. The hours of operation for the business would be 9 a.m. to 3 a.m. It should be noted that gaming facilities that have five or fewer machines tend to be considered accessory in nature, when part of a primary use, and as such tend to result in fewer negative impacts on surrounding land uses. However, larger game rooms with dozens of machines take on the scale of a small casino and as a result, require careful consideration as to their location and compatibility with surrounding land uses. Some of these considerations include compatibility with other land uses, noise, and traffic as well as safety considerations. As such, proximity to parks, schools and especially residential uses should be carefully considered in the review of gaming facilities. It should be noted, however, that this property is not in close proximity to any residential properties, parks or schools. Eight (8) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor and four (4) responses were received in opposition. Slides were shown of the subject property. Staff recommended approval of the request with the following conditions: 1. Owner must maintain adequate security. 2. The van accessible handicap spot is not ADA compliant. The spot must be 11-ft wide with a 5-ft access aisle on the passenger side if the vehicle were pulled into the spot. 3. The western edge of the proposed rock must be 2-ft away from the property line, and the 2-ft gap be filled in with grass. 4. Garbage trucks will quickly ruin the northwest corner of the proposed rock parking area due to the tight turnaround area. The trucks will create rutting and potholes, causing the loose rocks and dirt to potentially be carried away by storm runoff and be deposited in the City’s drainage structures or on neighboring lots, violating the Watershed Protection Ordinance. The dumpster should be relocated or the driveway should be paved. Commissioner Little inquired about the surrounding zoning. Discussion followed. John Wilson, representing Keller-Williams Real Estate, 6310 Delaware, addressed the Commission. Mr. Wilson stated that if they approve the request it would create three full time jobs and two part time jobs. Discussion followed. Mr. Wilson stated that he would agree to amend the hours of business in order to follow the ordinance. Commissioner Little 4 Planning and Zoning August 20, 2018 inquired about the vicinity of Kelly High School and the intended place of business. Mr. Boone stated that the high school is northeast of the property. A brief discussion ensued regarding the location of the intended gaming facility. Leslie Lightfoot, owner of Dura-Steel Buildings Inc., 6440 Washington Boulevard addressed the Commission. Mr. Lightfoot spoke against the request. Commissioner Makin asked Mr. Wilson to reapproach the Commission. Commissioner Javed expressed concerns about the school being too close to the intended place of business. Discussion resumed regarding the location of the gaming facility and the distance to Kelly High School. Commissioner Little made a motion to deny the request for a Specific Use Permit to allow a gaming facility in a C-M (Commercial-Manufacturing) district as requested for File 2344-P. Commissioner Javed seconded the motion. Motion to deny carried 9:0. File 2358-P: Consider a request for a Specific Use Permit for a small wholesale food preparation facility in a GC-MD (General Commercial-Multiple Family Dwelling) District. Applicant: Prentiss Semien Location: 1195 Grand Avenue Mr. Boone presented the staff report. Prentiss Semien is requesting a Specific Use Permit to allow a small wholesale food preparation facility at 1195 Grand Street. Mr. Semien plans to prepare, cook and package pork skins, also known as cracklins. The cracklins will be packaged for wholesale distribution. The property was previously used as a meat market. Hours of operation will be 8 a.m. to 9 p.m. with a store front from 10 a.m. to 9 p.m. with the largest shift having 5 employees. Slides of the subject property were shown. Twenty-six (26) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor or in opposition. Staff recommended approval of the request with the following conditions: 1. Construction plans must meet all requirements by Water Utilities for water and sanitary sewer services, including any requirements of the City’s pre-treatment program 2. The van accessible handicapped spot is not ADA compliant. The spot must be 11-ft wide with a 5-ft access aisle on the passenger side if the vehicle were pulled into the spot. It is recommended that the handicapped spot be moved to spot 4 and have the access aisle located in spot 5. This would allow easier access to the ramp leading to the entrance. The handicapped spot currently shown could then become a regular parking spot. 3. Provide off-street parking for a total of eight (8) vehicles. The applicant was present. Prentiss Semien, 4355 Cadillac Lane addressed the Commission. Mr. Semien stated that he will be cooking and preparing cracklins to sell them to grocery stores and local convenient stores. A brief discussion followed. No further questions or comments. The public hearing closed.
