Pate Councilmember Virginia Jordan Councilmember Robin Mouton Councilmembers absent: Mayor Pro-Tem Gethrel Williams-Wright Also present: Chris Boone, Director of Planning and Community Development Adina Josey, Senior Planner Tyrone Cooper, City Attorney Fran Malvo, Recording Secretary 1 Planning and Zoning February 19, 2018 APPROVAL OF MINUTES Commissioner Steinhagen made a motion to approve the minutes of the Regular meetings and Joint Public Hearings held on December 18, 2017 and January 22, 2018. Commissioner Colbert seconded the motion. Motion to approve carried 9:0. REGULAR MEETING 1) Replat-Lot 28, Block 2, The Garden Villas: Request for approval of a Replat of Lot 28 into Lots 28A and 28B, Block 2, The Garden Villas, Beaumont, Jefferson County, Texas Applicant: Access Surveyors Location: 7330 &7344 Shady Lane Mr. Boone presented the staff report. Access Surveyors has requested approval of the replat of Lot 28, Block 2, Garden Villas Addition, into Lots 28A, and 28B, Block 2, Garden Villas, Jefferson County, Texas. The property is located at 7330 and 7344 Shady Lane in the E.T.J. The proposed 2.971 acre replat will create two lots from one. Water and sewer will be provided by individual wells and septic systems. The property is located in flood zone AE, also known as the flood hazard. Nine (9) notices were mailed to individuals within 200 feet of the subject property. No responses were received in favor or in opposition. No questions for Mr. Boone. No discussion or comments. Commissioner Senigaur made a motion to approve a request for approval of the Replat of Lot 28 into Lots 28A and 28B, Block 2, The Garden Villas. Vice-Chairman Mason seconded the motion. Motion to approve carried 9:0. JOINT PUBLIC HEARING Mayor Ames called the Joint Public Hearing of February 19, 2018 to order and explained the purpose of the Joint Public Hearing process and then turned the meeting over to Chairman Nejad. 1) File 2325-P: A request for a Specific Use Permit to allow a gaming facility in a GC-MD (General Commercial-Multiple Family Dwelling) District. Applicant: Bladimir Lino-Barahona th Location: 3070 S. 4 Street Mr. Boone stated that staff would like to table the request due to additional information to be reviewed regarding their non-performing status and parking. Chairman Nejad stated that File 2325-P would be tabled until further notice. 2) File 2327-P: A request for an amended Specific Use Permit to allow boat and RV storage in a GC-MD (General Commercial-Multiple Family Dwelling) District. Applicant: College Street Storage, LLC Location: 9695 College Street Mr. Boone presented the staff report. College Street Storage, L.L.C. submitted a request for a Mini Storage Facility for the property located at 9695 College Street in September of 2017. The 2 Planning and Zoning February 19, 2018 request was for two (2) buildings, each with twenty-four (24) units designed for recreational vehicle (RV) and boat storage. The applicant would like to add an additional building to the request as demonstrated on the attached site plan. In October, the application was approved with the following condition: 1. Ten (10) foot wide landscaped buffers and an eight (8) foot wood or masonry screening fence be provided along the east, south and west property lines. In addition to the amended site plan to add a third building, the applicant is asking to wave the perimeter landscaping condition. Slides of the subject property were shown. Staff recommended approval of the request with retention of this condition and one additional condition: 2. A perimeter landscaping buffer shall be required along each side of a parking lot that faces towards a public right-of-way, as required by City Ordinance. Thirteen (13) notices were mailed to property owners within 200 feet of the subject property. No notices were received in favor or in opposition. Commissioner Little asked a question regarding the landscaping buffer. Mr. Boone stated that the buffer is not actually required. The applicant was present. Steve Lucas, 3506 Windrose addressed the property. Vice-Chairman Mason inquired about the house on the property. Mr. Lucas stated that the house was sold and would be moved off the property. There would be no fencing along the east and west side but it will be installed on the north side. No other questions or comments. The public hearing closed. Commissioner Little made a motion to approve a request for an amended Specific Use Permit to allow boat and RV storage in a GC-MD (General Commercial-Multiple Family Dwelling District) zoning as requested for File 2327-P. Commissioner Colbert seconded the motion. Motion to approve carried 9:0. 3) File 2328-P: A request for a Specific Use Permit to allow a new cellular tower in a GC-MD (General Commercial Multiple-Family Dwelling) District. Applicant: Verizon Wireless-Andrew Kasparek Location: 8496 Phelan Boulevard Mr. Boone presented the staff report. Andrew Kasparek on behalf of Verizon Wireless is requesting a Specific Use Permit to allow the applicant to construct a cellular communications site including a 100 ft. tall monopole tower, located on a 0.1391 acre lease site, at 8496 Phelan Blvd. The site plan does not show the required 8 foot wood or masonry privacy fence or the 10 foot landscaped buffer (required outside of the fence in this case), or dedicated parking for the lease site as required by ordinance. However, the site does meet the distance requirement from residentially zoned property and will be constructed to city and federal standards. The applicant states that this tower will help provide additional coverage and capacity to the customers in the area, and would be used for emergency services. Verizon is also requesting a waiver to the perimeter landscaping requirements. 3 Planning and Zoning February 19, 2018 Staff recommended approval with the following conditions: 1. Install an 8 foot wood or masonry privacy fence around the lease site. 2. At such time that any brush or trees are removed outside of the lease site, a ten foot wide landscaped buffer shall be installed outside of the 8 foot fence for the entire perimeter of the lease site. 3. Provide off-street parking within lease area to meet City requirements. Twenty-five (25) notices were mailed to property owners within 200 feet of the subject property. No notices were received in favor and four (4) notices were received in opposition. The applicant was present. Andrew Kasparek, 26438 Morgan Creek Lane, Katy, Texas addressed the Commission. Chairman Nejad asked Mr. Kasparek to explain what a monopole is. He stated it is similar to a taller street light without lights. He stated that there is a back-up generator if power is lost. Discussion followed. Robert J. Kocot, Sr., 8465 Oak Brook Drive addressed the Commission. Mr. Kocot spoke in opposition. Mr. Kocot stated that he was speaking on behalf of his neighbors. Mr. Kocot read a statement regarding his state and federal rights. Mr. Kocot addressed concerns regarding radiation emitting from the tower and the towers possibly collapsing. Discussion followed. Mr. Kasparek readdressed the Commission. He stated that the towers do not emit radiation and the towers are made to withstand the highest winds. He stated that the towers are not designed to collapse like a tree. He stated that they intend to comply with all FAA requirements. Discussion followed. No other questions or comments. The public hearing closed. Commissioner Steinhagen made a motion to approve a request for a Specific Use Permit to allow a new cellular tower in a GC-MD (General Commercial-Multiple Family Dwelling) District as requested for File 2328-P. Commissioner Little seconded the motion. Motion to approve carried 9:0. OTHER BUSINESS THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:51 P.M. 4
