Eliot New Commissioner Jason Cansler Commissioner LinMarie Garsee Commissioner Marie Broussard Commission Members absent: Commissioner Dohn LaBiche Commissioner Thomas Sigee Councilmembers present: None Councilmembers absent: Mayor Pro-Tem Alan Coleman Councilmember-at-Large Gethrel Wright Councilmember Mike Getz Also present: Chris Boone, Director of Planning and Community Development; Adina Ward, Planner II; Fran Malvo, Recording Secretary; Anna Varela, Oaks Historic District Code Enforcement Officer APPROVAL OF MINUTES Commissioner Blazek made a motion to approve the minutes with corrections of the Regular Meeting held February 9, 2015 confirming that she and Commissioner Thomas Sigee were present and Commissioners that were absent were Commissioner B. Eliot New, Commissioner Jason Cansler and Commissioner LinMarie Garsee. Commissioner Craig approved the motion. Commissioner Turner seconded the motion. Motion to approve carried 8:0. REGULAR MEETING 1) CA-2467: Request for a Certificate of Appropriateness to replace a window with a door on the front of a house and add stairs and aluminum railings. Location: 2572 South Street Applicant: Jamie Jimenez Ms. Ward presented the staff report. The applicant, Jamie Jimenez has replaced a window at the front of his house, located at 2572 South Street, with a door. Stairs and railings were added and the modifications were brought to the City staff’s attention. There is an existing front door, recessed on the east side of the house, near the parking area. No application was made for a Certificate of Appropriateness or permit. Mr. Jimenez hopes to trim out the door, replace any necessary pieces of siding and paint the house a light grey color with off-white trim. Staff recommends denial of this request. However, if the Commission should choose to grant a Certificate of Appropriateness, staff recommends the following conditions: 1. Permits are obtained for all work as required. 2. Replace or paint aluminum handrails. 3. Stairs to new front door must have a landing as per building code requirements. The property is not listed in SPARE. Exhibits are attached. Mr. Jimenez stated that he purchased the home owner financed. He has been the owner of the home for at least five years and the previous owner failed to tell him about the restrictions for homeowners living in the Historical District neighborhood. Mr. Boone stated that Mr. Jimenez did purchase a permit and a Certificate of Appropriateness on December 24, 2014. This allowed him to strip the siding and replace it with hardiplank, paint the siding bird’s eye maple and weathered shingle (SW2841) and the accent paint (SW2833). The permits were for siding only and did not allow for any changes to be made regarding the windows or the doors. The permits specified to use hardiplank and not vinyl siding. Commissioner Cansler asked about a stoop for the door. Mr. Boone stated that the new code requires you to have at least 3 feet of stoop outside of any door. Discussion followed. Chairman Blazek made a motion to approve a Certificate of Appropriateness with the following conditions as requested in CA-2467: 1. The kitchen door be removed and closed in with siding that matches the wood siding that will be revealed once the aluminum siding comes off; 2. The new front door that goes into the living room must have stairs, stoops and railings that is within the City’s Code of ordinances and; 3. Purchase a permit for any future repairs. Commissioner Craig seconded the motion. Motion carried 8:0. 2) CA-2472: A request to demolish a house and construct a new house. Location: 2104 Pecos Applicant: URS for SETRPC (Southeast Texas Regional Planning Commission) Ms. Ward presented the staff report. Whereas, under Section 106 of the National Historic Preservation Act, this demolition would be considered an adverse affect to historic structures, staff is recommending denial of this request. However, if the Commission should choose to grant a Certificate of Appropriateness, staff recommends the following conditions: 1. Pier and beam construction with a finished floor elevation 3’5” above grade. 2. Parking shall be at the rear of the property with a handicap ramp along the west side of the house. 3. Roof overhang minimum shall be 12” 4. Columns shall be constructed to resemble the Craftsman style. 5. 6 over 1 windows. a Certificate of Appropriateness to allow the demolition of an existing house and the construction of a new house. The property is located at 2104 Pecos. The demolition and new construction is being done under the Hurricane Ike Disaster Recovery Program. A Certificate of Appropriateness was awarded to rehabilitate this can only be made to one unit. If exterior repairs are made, the foundation work would likely result in or exacerbate existing interior damage to the second unit and cannot be corrected. The new house will be of the Craftsman style. The approximately 1,510 sq. ft. house will consist of four bedrooms, two baths, kitchen, living/dining room and a laundry room. The construction methods employed would dictate that the house be constructed on a 12” slab on grade foundation, wood framing, horizontal lap cement fiber siding and 30 year architectural roofing shingles. Windows will have white vinyl frames, and will be of a six over one appearance. The roof will have a 6 ½ pitch and a front gable. The gabled front covered porch will have tapered columns. Paint and roof colors will be selected by the homeowner from the pre-approved pallet available in the Planning office. The house is listed in the 1990 SPARE Beaumont Survey. SPARE states that the house was built c. 1930. The house is listed as an example multiple housing built in Beaumont in the 1920’s and 1930’s and is of a Craftsman style. Slides of the subject property were shown. Adrienne Campbell representing URS addressed the Commissioners. Jennifer Mattingly representing SETRPC (Southeast Texas Regional Planning Commission) addressed the Commissioners as well. Mrs. Mattingly stated that when the applicant applied for the program she listed the home as a single family dwelling and she never specified that the home was a duplex. The Texas General Land Office guidelines specify that a duplex is a single family structure but it is not eligible for rehabilitation. Mrs. Mattingly stated that 97% of their houses are reconstructed. When the contractors went to inspect the property it was not notated that the structure was a duplex. Commissioner Cansler questioned what is the initial dollar investment that SETRPC intends to spend towards the structure. Mrs. Mattingly stated that to rehabilitate both sides of the duplex it would cost $98,000.00. To reconstruct the structure it would cost approximately $135,000.00. The homeowner has agreed to have the home demolished. Discussion followed. Commissioner Tuner made a motion to deny the request to demolish the structure and construct a new structure at 2104 Pecos as requested in CA-2472. Commissioner New seconded the motion. Motion to deny carried 8:0. 3) Director’s Report Mr. Boone discussed the Historic Revolving Loan Fund with the Commissioners. 4) Historic District Code Enforcement Report Ms. Varela distributed the report.
