HomeMy WebLinkAbout3-2-06 BA Minutes*MINUTES* BOARD OF ADJUSTMENT March 2, 2006 City Council Chambers A meeting of the Board of Adjustment was held on March 2, 2006 and called to order at 3:00 p.m. with the following members present: Chairman Bob Harris Vice Chairman Mary Jowers Board Member Pat Avery Board Member Dana Timaeus Alternate Member Justin Howard Board Members absent: Board Member Joey Hilliard Alternate Member Kelli Maness Alternate Member Sam Pullig Also present: Steve Richardson, PIanning Manager; Adina Abshire, Planner; Jill Cole, Recording Secretary; Tyrone Cooper, City Attorney APPROVAL OF MINUTES Board Member Howard made a motion to approve the minutes of the November 3, 2005 Meeting. Board Member Timaeus seconded the motion. Motion to approve carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 542-BA: A request for variances to the minimum side yard setback from 5' to 4' 5" and to the minimum rear yard setback from 25' to 18' 4". Location: 3850 Hyde Park Row Applicant: Slade Smith Mr. Richardson presented the staff report. The applicant, Slade Smith, wants to construct a 500 sq. ft. master bedroom and bath extension onto the rear of his house at 3850 Hyde Park Row. The 18' x 28' 7 1/2" addition will extend into the side yard 7" and into the rear 6' 6". BOARD OF ADJUSTMENT March 2, 2006 (Vice -Chairman Jowers arrived.) The existing house already encroaches 7" into the side yard setback. The addition will line up with the existing house. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for the variances have been met. Nineteen notices were mailed to property owners within 200' . One response in favor and none in opposition were received. Pictures of the subject property were distributed to the Board. Chairman Harris opened the public hearing and asked for the applicant's comments. Slade Smith, the applicant, addressed the Commission and answered questions from the Board. Chairman Harris asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Discussion between the Board members followed. Vice -Chairman Jowers made a motion to approve variances to the minimum side yard setback from 5' to 4' 5" and to the minimum rear yard setback from 25' to 18' 4" for property at 3850 Hyde Park Row as requested in File 542-BA. Board Member Avery seconded the motion. The vote on the motion to approve File 542-BA follows: Chairman Harris - For Vice -Chairman Jowers - For Board Member Avery - For Board Member Timaeus - For Alternate Member Howard - For The motion to approve File 542-BA carried 5:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:10 P. M. 7
