BOARD OF ADJUSTMENT
May 1, 2008
City Council Chambers
A meeting of the Board of Adjustment was held on May 1, 2008 and called to order at 3:00 p.m. with the
following members present:
Chairperson Pat Avery
Board Member Bob Harris
Board Member Mary Jowers
Alternate Member Kelli Maness
Board Members absent: Vice Chairman Dana Timaeus
Board Member Joey Hilliard
Also present: Steve Richardson, Planning Manager; Tyrone Cooper, City Attorney; Jill
Cole, Recording Secretary
APPROVAL OF MINUTES
Board Member Harris made a motion to approve the minutes of the April 7, 2008 Special Meeting.
Board Member Jowers seconded the motion. Motion to approve carried 4:0.

PUBLIC HEARING
1) File 574-BA: Request for variances to the minimum front yard building setback from 20' to 18.2' .
Location: 7310 Highway 105
Applicant: Linh Berryhill
Mr. Richardson presented the staff report. The applicant, Linh Berryhill, is building a 55' x 90'
metal building that will house a martial arts studio. She states that they hired an engineer to
perform site engineering and preliminary layout for the building. Somehow, the layout stakes were
moved and replaced incorrectly prior to initial setup. The building was setup, formed and concrete
poured using these incorrect stakes. A subsequent survey slab survey indicated the aforementioned
encroachments.

The applicant shall have the burden to demonstrate that all three conditions necessary for approval
have been met.
Seven notices were mailed to property owners within 200 feet of the subject property. No
responses in favor or in opposition were returned.
Mr. Richardson distributed photos of the subject property.
Chairman Avery opened the public hearing and asked for the applicant's comments.
Mike Jenkins, the contractor for the applicant, addressed the Board.
Chairman Avery asked for comments in favor or in opposition. No comments were made. The
public hearing was closed.
Discussion between the Board members followed.
Board Member Harris made a motion to approve a request for variances to the minimum front yard
building setback from 20' to 18.2' at 7310 Highway 105 as requested in File 574-BA. Board
Member Maness seconded the motion. The motion to approve carried 4:0.
