BOARD OF ADJUSTMENT
July 2, 2009
City Council Chambers
A meeting of the Board of Adjustment was held on July 2, 2009 and called to order at 3:00 p.m. with the
following members present:
Chairperson Pat Avery
Vice Chairman Dana Timaeus
Board Member Bob Harris
Board Member Mary Jowers
Alternate Member Christy Amuny
Board Members absent: Board Member Joey Hilliard
Alternate Member Kelli Maness
Alternate Member Christopher Plaunty

APPROVAL OF MINUTES
Board Member Jowers made a motion to approve the minutes of the June 18, 2009 Special Meeting. Board
Member Harris seconded the motion. Motion to approve carried 4:0.
SWEARING IN OF WITNESSES
PUBLIC HEARING
1) File 595-BA: Request for a variance to the minimum setback for a detached owner identification
sign from 15' to 4' .
Location: 7995 Highway 105
Applicant: Thuy Truong
Mr. Richardson presented the staff report. In 2002, Thuy Truong received a specific us permit to
allow a beauty/nail shop on the subject property. She currently has a sign approximately 2' from
the front property line. Ms. Truong states that to move her sign to the required 15' would require
removal of the only oak tree on the property. She also states that she would Iike her sign to line
up with her neighbor's sign.

A site inspection of the subject property shows that the dentist's sign is approximately 15' from
the front property line. There also appears to be adequate room to move the sign to the required
15' and not have to cut down the oak tree.
The applicant shall have the burden of proof to demonstrate that all three conditions necessary for
approval have been met.
Thirty notices were mailed to property owners within 200 feet. Two responses in favor and none
in opposition were returned.
(Board Member Amuny arrived.)
Chairperson Avery opened the public hearing and asked for the applicant's comments.
Daniel Dean addressed the Board on behalf of Ms. Truong, the applicant.
Chairperson Avery asked for comments in favor or in opposition.
Ms. Truong, the applicant, addressed the Board.
The public hearing was closed.
Discussion followed between the Board members.
Board Member Harris made a motion to approve a variance to the minimum setback for a detached
owner identification sign from 15' to 4' at 7995 Highway 105 as requested in File 595-BA. Board
Member .lowers seconded the motion. Motion to approve carried 4:1 (Timaeus).
OTHER BUSINESS
THERE BEING NO FURTHER BUSINESS. THE MEETING WAS ADJOURNED AT 3:26 P.M.
