BOARD OF ADJUSTMENT

A Regular Meeting of the Board of Adjustment was held on November 20, 2014 and called to order at
3:00pm with the following member present:

Board Member Jowers made a motion to approve the minutes of the Regular Meeting held August
7, 2014. Board Member Maness seconded motion. Motion to approve carried 4:0.

REGULAR MEETING
1) File 678-BA: Request for a variance to the minimum sign setback for a GC -MD District from
10, to V.
Location: 3282 College
Applicant: Darran Dollarhide
Ms. Ward presented the staff report. Darran Dollarhide is requesting a variance to the minimum
setback for an owner identification sigh. The proposed sign will be one (1) foot from the property
line. The property is located at 3282 College. The applicant states that the new sign will replace
an existing sign in same location. This is the only unpaved location on the property where a sign
could be placed without interfering with parking.
Recess while waiting for construction manager to arrive. Board will return to request once
manager arrives.
2) File 679-BA: Request for a variance to the minimum side yard setback from 10' to 5'.
Location: 2190 Taylor
Applicant: URS c/o Zach Martin
Ms. Ward presented the staff report. Zach Martin for URS, has applied for a variance to the
minimum side setback from 10' to 5'. The property is located at 2190 Taylor Street.
URS Corporation hires local contractors to build houses, replacing those damaged in
Hurricanes Rita and Ike. In Round 1 of FEMA Disaster Recovery efforts due to
hurricanes Rita and Ike, URS was hired by SETRPC (Southeast Texas Regional Planning
Commission) to manage construction in our area. Later, URS was hired by the GLO
(General Land Office) to manage the CDBG (Community Development Block Grant)
Round 2. Most of the structures being replaced were built in the early 1900's and do not
meet current setback requirements where they sit. Occasionally the lot does not meet
minimum requirements for width or depth. This is the case in this request.
Mr. Martin states that due to the narrowness of the property, a variance is necessary to fit
a new structure at this location.
CNineteen notices were mailed to property owners within 200 feet. No responses for or
against were returned.
Slides of the subject property were shown.
Chairman Timaeus asked for comments in favor or in opposition. No comments were
made. Discussion followed between the Board Members.
Board Member Maness made a motion to approve the request for a variance to the
minimum side yard setback from 10' to 5'. Board Member Jowers seconded the motion. Motion
to approve carried 4:0.
3) File 680-BA: Request for variance to the minimum front yard building setback from 25'
to 7' .
Location: 157 Briggs
Applicant: Johnny T. Fulton
Ms. Ward presented the staff report. Johnny T. Fulton is requesting a variance that will
allow him to construct a carport in his front yard at 157 Briggs Street. Due to the
configuration of steps from the door accessing his garage, two (2) cars cannot be parked
r" in his garage at once. Being a disabled veteran suffering deterioration of his bones, a
carport would allow him and his wife to both park under a protected covering.
Section 28.03.024 (c) (13) of the Zoning Ordinance states:
Where an existing residential structure does not contain a garage or carport and
where there is not adequate area for an accessible parking space behind the front
yard area, a carport having no side walls may be constructed in the front yard
area.
Mr. Fulton cannot use this exception because his house has an existing garage; therefore
he is requesting a variance to the front yard setback. The minimum front yard setback in
a RS (Residential Single Family Dwelling) District is 25 feet. Mr. Fulton is asking to
build 7 feet from his front property line.
Thirty-seven notices were mailed to property owners within 200 feet. No responses for or
against were returned.
Slides of the subject property were shown.
r Chairman Timaeus invited comments from the applicant, Mr. Fulton. Mr. Fulton explained that
the carport is already built. It is 18' x 18'. He says there is not adequate space in the existing
garage for both vehicles.
Discussion by the Board Members followed.
Board Member Maness made a motion to approve the variance to the minimum front yard
building setback from 25' to 7'. Board Member Amuny seconded the motion. Motion to
approve carried 4:0.
4) File 681-BA: To consider a request for a variance to the minimum front yard setback from
25' to 20'.
Location: 2229 Pecan
Applicant: URS c/o Zach Martin
Ms. Ward presented the staff report. Zach Martin for URS, has applied for a variance to the
minimum front yard setback from 25' to 20'. The property is located at 2229 Pecan
Street.

5) File 678-BA: Request for a variance to the minimum sign setback for a GC -MD District from
10, to 1'.
Location: 3282 College
Applicant: Darran Dollarhide
Board returned to File 678-BA as the construction manager was present to answer
questions regarding sign placement. Chairman Timaeus asked for clarification as to
where exactly the sign would be placed. The construction manager stated the sign will be
placed in a peninsula near the backflow preventer. The parking lot was paved according
to the original footprint and left nowhere else to erect the sign.
Nine notices were mailed to property owners within 200 feet. No responses for or against
were returned.

Discussion followed between the Board Members.
Board Member Jowers made a motion to approve the request for a variance to the minimum
( sign setback for a GC -MD District from 10' to 1' provided that the sign is placed 1' from
property line and adjacent from backflow preventer. Board Amuny seconded the motion. Motion
to approve carried 4:0.
