BOARD OF ADJUSTMENT
May 5, 2016

A Regular Meeting of the Board of Adjustment was held on May 5, 2016 and called to order at 3:10
p.m. with the following members present:
Board Member Jeff Beaver
Board Member Mary Jowers
Alt. Board Member Tom Rowe
Alt. Board Member Lee Smith
Board Members absent: Chairman Dana Timaeus
Board Member Kelli Maness
Board Member Joey Hilliard
Alt. Board Member Christy Amuny

Broussard, City Clerk, Sharae Reed, Legal Department
APPROVAL OF MINUTES
Board Member Rowe made a motion to approve the minutes from the April 7, 2016, meeting. Board
Member Smith seconded the motion. Motion to approve carried 4:0.

1) File 702-BA: To consider a request for a Special Exception to the minimum rear yard setback
from 25’ to 7’1”.
Location: 20 Stone Brook Court
Applicant: K. E. Wilcox, Builder
Closed: 3:24 p.m.
Adina Ward presented the staff report.

K. E. Wilcox, Builder is requesting a Special Exception to the minimum front yard setback from 25’ to
7’1”. Mr. Wilcox is building a new home at 20 Stone Brook Court. The majority of the neighboring
structures do not meet city requirements. Section 28.02.005(e)(2)(B)(i) states that board may grant,
“…a rear yard exception where the actual rear yard setback of any four (4) or more lots in the same
block do not meet the rear yard requirements…”
Twenty-eight (28) notices were mailed to property owners within 200 feet of the subject property. No
responses were received in favor and no responses were received in opposition.
Slides of the subject property were shown.
K. E. Wilcox of 198 W. Circuit Dr. addressed the board members. Discussion followed. Board
member Beaver made a motion to deny a Special Exception to the minimum rear yard setback from
25’ to 7’ 1” as requested in File 702-BA. Board member Rowe seconded the motion. Motion to
approve was denied 4:0.
Board member Beaver made a motion to approve a Special Exception to the minimum rear yard
setback from 25’ to 15’ in regards to File 702-BA. Board member Smith seconded the motion.
Motion to approve carried 4:0.

None.
