The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on June 2, 2020, at the City
Hall Council,Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Dwight Benoit with Magnolia Missionary Baptist Church gave the invocation. Mayor Ames
led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Pate, Councilmembers Neild, Getz,
Feldschau, Mouton and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City

A) Approve a resolution to repeal Resolution No 20-097 and adopting a new resolution specific
to the requirements of the U.S. Department of Justice authorizing the City Manager to receive
funds from the Coronavirus Emergency Supplemental Funding Program through the

GENERAL BUSINESS
1. Consider a resolution authorizing the City Manager to award a contract to King Solutions,
Inc., of Houston, to rehabilitate sewer lines and replace manholes.
The Pipe Bursting Work Order Contract — Phase III will be used to rehabilitate sewer lines
by the pipe bursting method and to replace defective manholes.
On February 20, 2020, eight (8) bids were received for furnishing all labor, materials,
equipment, and supplies for the project. The bid totals are indicated in the table below:

Based on a review of the eight (8) bids submitted, four (4) bids were incomplete as per page 13
of the advertised contract documents, including the apparent low bidder, Barclays Premier
Utility Service, LLC. The Water Utilities Engineer recommends awarding the project to King
Solutions Services, LLC, the second low bidder, in the amount of $1,833,508.00. A total of 400
calendar days are allocated for the completion of the project.

Councilmember Nield moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
APPROVES THE AWARD OF A CONTRACT TO KING SOLUTIONS SERVICES, LLC, OF HOUSTON, TEXAS, IN
THE AMOUNT OF $1,833,508.00, FOR THE PIPE BURSTING WORK ORDER CONTRACT -PHASE III
PROJECT AND THAT THE CITY MANAGER BY AND HE IS HEREBY AUTHORIZED TO EXECUTE A
CONTRACT WITH KING SOLUTIONS SERVICES, OF HOUSTON, TEXAS. Councilmember Fel.dschau
seconded the motion.

Resolution 20-113
2. Consider a resolution authorizing the City Manager to award a contract to Brystar
Contracting, Inc., for the Cartwright Avenue & Goliad Street Storm Sewer Drainage Repair
Project.
The Cartwright Avenue & Goliad Street Storm Sewer Drainage Repair Project consists of the
repair of drainage structures including concrete box culverts, junction boxes, surface inlets
and all excavation and backfill as required.
On May 14, 2020, six (6) bids were received for furnishing all labor, materials, and equipment
for the project. The bid totals are indicated in the table below:

Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY

Resolution 20-114
3. Consider amending Section 18.01.003 of the Code of Ordinances related to Bingo taxes.
In 2019, the Texas 86th Legislature enacted House Bill 914 affecting the collection of Bingo
prize fees by local jurisdictions. On September 10, 2019, City Council passed Resolution 19-
195 affirming its intent to continue to receive a share of Bingo prize fees collected by non-
profit organizations conducting Bingo activities within the City limits.
House'Bill 914 allows a licensed authorized organization to collect from a person who wins a
cash bingo prize of more than $5.00 a fee in the amount of 5%. The bingo conductor shall
remit 50% (or 2.5%) of the amount collected to the State Lottery Commission. The remaining
50% (or 2.5%) shall be remitted to local governing bodies that voted to impose the prize fee.
The two local governing bodies are the City of Beaumont and Jefferson County. The City of
Beaumont opted to impose the prize fee via Resolution 19-195. As per the State Lottery
Commission, Jefferson County did not vote to impose collection of bingo prize fees.
Therefore, Section 18.01.003 of the Code of Ordinances adopted in 2007 is no longer in
compliance with statutory regulation. The current ordinance levied .a 2% tax on the gross
receipts of bingo games conducted within the city. The ordinance should be amended to
reflect the current law imposed by House Bill 914 and in accordance the City of Beaumont
shall impose a fee of 2.5% of a cash bingo prize of more than $5.00, and said fee is due and
payable by the license holder/bingo conductor, quarterly on or before the 25th day of the
month succeeding each calendar quarter.
Approval of the ordinance.
Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING
CHAPTER 18, ARTICLE 18.01, SECTION 18.0.003 OF THE CODE OF ORDINANCES OF BEAUMONT,
TEXAS TO MAKE CHANGES RELATING TO BINGO FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL; AND PROVIDING A PENALTY. Councilmember Feldschau seconded the motion.

line items of the Consolidated Grant Program's 2020 Annual Action Plan

4. Consider approving a resolution adopting the 2020 Annual Action Plan
The 2020 Annual Action Plan was adopted by City Council on April 28, 2020. However, HUD
is requesting that Council re -adopt the 2020 Action Plan in order to allow additional time for
public comment during the disruptions caused by the COVID-19 pandemic. There are no
changes to the 2020 Action Plan.
As mandated by the U. S. Department of Housing and Urban Development (HUD), City
Council has conducted public hearings and work sessions in previous years prior to adopting
the City's Annual Action Plan. Planning & Community Development staff, along with the
Community Development Advisory Committee (CDAC), has hosted Public Hearings in order
to receive public comments on the process and activities related to the 2020 Annual Action
Plan. Attached is the proposed Budget for the 2020 Program Year.
The proposed budget reflects estimated allocations of $1,361,649 in Community
Development Block Grant (CDBG) funding, an estimated $100,000 in Program Income and
$477,022 in HOME funding.
U.S. Department of Housing and Urban Development (HUD) Community Development Block
Grant and HOME Investment Partnership Grant funds.
Conduct the Public Hearing and approve the Resolution.
Councilmember Samuel moved to APPROVE A RESOLUTION WHEREAS HUD IS REQUESTING THAT
THE CITY RE -ADOPT THE 2020 ACTION PLAN AS WELL AS THE BUDGET OF THE 2020 ACTION PLAN, IN
ORDER TO ALLOW ADDITIONAL TIME FOR PUBLIC COMMENT DURING THE DISRUPTIONS CAUSE BY THE
COVID-19 PANDEMIC, THERE ARE NO CHANGES TO THE 2020 ACTION PLAN OR THE BUDGET OF THE
2020 ACTION PLAN. THE CITY COUNCIL HERE RE -ADOPTS THE HUD CONSOLIDATED GRANT
PROGRAM'S 2020 ANNUAL ACTION PLAN, AS WELL AS THE BUDGET OF THE 2020 ACTION PLAN IN
THE AMOUNT OF $1,361,649 IN COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG FUNDING, AN
ESTIMATED $100,000 IN PROGRAM INCOME AND $477,022 IN HOME FUNDING. Mayor Pro Tem

Spoke regarding the death of George Floyd, stated that the NAACP and 100 Black Men
joined together on last Wednesday and had a peaceful rally to give the citizens of Jefferson
County an opportunity to express their feelings in a peaceful way, thanked the
Councilmembers that were present, announced that the NAACP and 100 Black Men will
partner with the NAACP in Port Arthur to show them how to gather peacefully and to share
their hearts and feelings, this is a time when all people should come together, the gathering
won't be about bail or criminal reform, invited Mayor and Council to an event on June 19,
2020 at 6:30 p.m., at MLK Park

Spoke to Council once again regarding the traffic all hours of the night to and from the
Beaumont Municipal Airport over the Amelia neighborhood, stated that she hasn't gotten an
answer from anyone on Council regarding this issues, hopes that the City of Beaumont
doesn't have the kind of disturbances that other cities are having regarding the protesting,
commented on the flooding due to hurricane season that's here once again

President of the Student Body as well, spoke regarding the death of George Floyd as well as

WHEN YOU TEACH YOUR CHILDREN TO ABIDE BY THE LAW AND
TO MAKE SURE YOU SHOW YOUR HANDS AND COMPLYING WITH
EVERY INSTRUCTION GIVEN AND THEY COULD STILL POSSIBLE
NOT COME HOME, UNFORTUNATELY BEING A BLACK

COUNCILMEMBER FELDSCHAU - STATED THAT THERE'S A SOBERNESS IN THE ATMOSPHERE
TODAY BECAUSE EVERYONE IS BROKEN HEARTED AND

TRAGIC DEATH OF GEORGE FLOYD ON MAY 25, 2020, THIS

COUNCILMEMBER GETZ - STATED THAT WHAT HAPPENED TO GEORGE FLOYD WAS
INEXPLICABLE, UNCONSCIONABLE AND A TRAGEDY, IT HAS
CAUSED AMERICANS ALL ACROSS THIS COUNTRY TO
REEXAMINE QUESTIONS THAT NEED TO BE ASKED, THESE
QUESTIONS NEED TO BE ASKED IN SUCH A MANNER THAT
DOESN'T INVOLVE ARSON, LOOTING, RIOTING BUT PEACEFUL
PROTESTING, COMPLIMENTED MICHAEL COOPER AND THE
NAACP ON THE PEACEFUL RALLIES THAT HE'S ALREADY
LEAD AND CONDUCTED ON LAST WEEK AND THE ONES THAT HE
PLANS TO CONTINUE TO CONDUCT, THESE QUESTIONS NEED TO
BE ASKED AND REEXAMINED AS WE GO FORWARD IN THE
FUTURE, STATED TO MS. ALLEN WHO SPOKE EARLIER THAT IF
SHE WOULD LIKE TO GO WITH HIM TO THE MUNICIPAL AIRPORT
AND TOUR THE FACILITY TO GET WITH HIM AND HE WILL
ARRANGE THAT FOR HER, HE CAN THEN ANSWER ANY
QUESTIONS SHE MAY HAVE, THINKS THAT SHE WILL BE AMAZED
AND IMPRESSED AS TO WHAT IS GOING ON OUT THERE, ASKED
THE CITY MANAGER IF CITIZENS WILL HAVE THE OPPORTUNITY
TO OBTAIN SAND BAGS FROM THE CITY OR THE COUNTY IN
REGARDS TO THE STORM THAT IS BREWING IN THE GULF, JUST
IN CASE IT COMES OUR WAY

REGARDING DISPOSABLE WASTE, WOULD LIKE TO CHALLENGE
CITY STAFF AS WELL AS THE MANAGER TO BRING TO COUNCIL

UNDERSTANDS WHEN SHE SEES HER FRIENDS UPSET AND THE
CONVERSATIONS THEY HAVE TO HAVE WITH THEIR CHILDREN,
STATED THAT SHE LOVES HER BLACK AND HISPANIC FRIENDS
AS MUCH AS SHE LOVES HER WHITE FRIENDS, HAS A HARD TIME
UNDERSTANDING THE RACISM BECAUSE SHE DOESN'T FEEL IT,
SHE KNOWS HOW SHE FEELS AND KNOWS HOW HER FRIENDS,
THAT SHE'S TALKED TO FEEL, CAN ONLY SAY THAT SHE CAN'T
COMPREHEND WHAT IT MUST BE LIKE, IT MAKES HER FEEL
VERY SAD, SOME SAY AS A LEADER YOU HAVE TO GET IN
FRONT OF THINGS, THAT'S TRUE BUT ALSO AS A LEADER YOU
HAVE TO UNDERSTAND THAT SOMETIMES OTHERS
UNDERSTAND AND KNOW BETTER WHAT TO DO AND WHAT TO
SAY, THOUGHT ABOUT HAVING A PRESS CONFERENCE,
THOUGHT ABOUT PUTTING INFORMATION OUT ABOUT WHAT
SHE'S THINKING BUT DOES THINK THAT HER COHORTS ON
COUNCIL AS WELL AS MICHAEL COOPER AND VERNON
DURDEN WITH NAACP AND 100 BLACK MEN UNDERSTANDS
IT BETTER THAN SHE DOES, HAS ASKED THEM TO HELP OUR
CITY HEAL BUT ALSO ASKED THEM TO BRING OUR CITY
TOGETHER AND TO MAKE SURE THAT WE DON'T HURT EACH
OTHER, WE NEED TO SUPPORT FREEDOM OF SPEECH, VERY
PROUD AND THANK THOSE THAT HAVE LEAD THESE
EVENTS/PROTEST AND HAVE KEPT THEM PEACEFUL, JUST
CAN'T COMPREHEND THESE TYPES OF THINGS STILL
HAPPENING IN THIS DAY AND TIME, PRAYS EVERYDAY THAT
THINGS GET BETTER, IT'S HER WISH THAT IN THE DAYS TO
COME EVERYONE CAN LOVE EACH OTHER AS FRIENDS,
