The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on April 28, 2020, at the City
Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Dwight Benoit with Magnolia Missionary Baptist Church gave the invocation. Mayor Ames
led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Pate, Councilmembers Neild, Getz,
Feldschau, Mouton and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City
Attorney; Tina Broussard, City Clerk.

GENERAL BUSINESS
1. Consider a resolution to reject all bids for the construction of a new chain link fence at the
Tyrrell Park Botanical Garden Center.
The City requested proposals for a new chain link fence system to enclose the Tyrrell Park
Botanical Garden Center complex to mitigate damage to. the property by feral hogs.
Bids were requested from ten vendors and three responses were submitted. All submitted
bids were significantly more than the anticipated amount of this project.
Until a bid is awarded the bid tab is not made public in order to.preclude an unfair competitive
advantage in future bids.
Approval of the resolution.
Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL DOES
HEREBY REJECT THE BIDS RECEIVED FOR THE CONSTRUCTION OF ANEW CHAIN LINK FENCE AT THE
TYRRELL PARK BOTANICAL GARDEN CENTER. Mayor Pro Tem Pate seconded the motion.

Resolution 20-091
2. Consider a resolution approving a contract for interior repairs at the Tyrrell Park Garden
Center.
Due to flood damage caused by Tropical Storm Imelda, the interior of the building located at
6088 Babe Zaharias Drive must be repaired.
Bids were requested from fourteen (14) vendors and four responses were received. ,The
low qualified bid to complete the project with a cost of $99,680 was received from Jack Built
Contractors, LLC. of Orange.
Minutes --April 28, 2020 -
The contractor will complete the project in seventy-five (75) calendar days.
Funds will come from the City Insurance Policy.
Approval of the resolution.
Councilmember Mouton moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY JACK
BUILT CONTRACTORS, LLC. OF ORANGE, TEXAS, IN THE ESTIMATED AMOUNT OF $999,680.00 FOR
INTERIOR REPAIRS AT THE TYRRELL PARK GARDEN CENTER BE ACCEPTED BY THE CITY OF
BEAUMONT; AND THAT THE CITY MANAGER IS AUTHORIZED TO EXECUTE A CONTRACT WITH JACK
BUILT CONTRACTORS, LLC. OF ORANGE, TEXAS, IN THE ESTIMATED AMOUNT OF $999,680.00.

Resolution 20-092
3. Consider a resolution approving a contract for property insurance coverage for various city
owned buildings and assets.
Higginbotham, of. Port Arthur, is the City's broker of record for securing the City's property
insurance. The proposed annual premium is based on a total insured value of $246,367,823.
The cost of the policy for this year is $1,543,042.26, a $330,573.39 increase from last year's
premium of .$1,212,468.87.. The net rate (per $100 valuation) increased by 30.3%, from
$0.44 to $0.57. The increase in rate is attributed to a hardening commercial property market
and losses incurred by the City over the past few years. The policy renewal will be in effect
from May 1, 2020 to May 1, 2021.
Companies providing insurance are layered with exposure limited to the amount of damage
incurred. All risk coverage, including Flood and Earth Movement, is provided byAmRisc, LP,
Velocity Risk Underwriters (Lloyds), Swiss RE/First Specialty, AXIS Surplus Lines Insurance
Company, Lloyds of London (Insurisk, LP), RSUI Indemnity Insurance Company, and
Arrowhead Insurance Risk Managers. Boiler and Machinery coverage is provided by Liberty
Mutual Fire Insurance Company. Terrorism coverage is provided by Lloyd's of London.
The deductibles per occurrence for the new policy are as follows:

4. Consider approving a resolution adopting the 2020 HUD Consolidated Grant Program's
Annual Action Plan.
Minutes — April 28, 2020
As mandated by the U. S. Department of Housing and Urban Development (HUD), City
Council has conducted public hearings and work sessions in previous years prior to adopting
the City's Annual Action Plan. Planning & Community Development staff, along with the
Community Development Advisory Committee (CDAC), has hosted Public Hearings in order
to receive public comments on the process and activities related to the 2020 Annual Action
Plan. Attached is the proposed Budget for the 2020 Program Year.
The proposed budget reflects estimated allocations of $1,361,649 in Community
Development Block Grant (CDBG) funding, an estimated $100,000 in Program Income and
$477,022 in HOME funding.
Funds will come from the U.S. Department of Housing and Urban Development (HUD)
Community Development Block Grant and HOME Investment Partnership Grant funds.
Conduct the Public Hearing and approve the Resolution.
Mayor Pro Tem Pate moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY ADOPTS
THE HUD CONSOLIDATED GRANT PROGRAM'S 2020 ANNUAL ACTION PLAN, AS WELL AS THE BUDGET
OF THE 2020 ACTION PLAN IN THE AMOUNT OF $1,938,666. Councilmember Neild seconded the
motion.

Resolution 20-094
PRESENTATION
COVID-19 Update
Sherry Ulmer, Public Health Director gave a COVID-19 Update. Ms. Ulmer stated that there
were 220 positive cases, 720 negative cases with 250 pending results. There has been a
total of 1,190 citizens that have been tested, 15 deaths with underlying health conditions.
There was discussion of the outcome of confirmed cases by age range, as well as the
number of confirmed cases and deaths by race/ethnicity along with the number of daily
confirmed cases by date of collection as of April 27, 2020.
WORK SESSION
Review and discuss options for constructing a fence at the Tyrrell Park Botanical
Garden Center
Keith Folsom, Building Services Director reviewed and discussed options for constructing a
fence at the Tyrrell Park Botanical Garden Center. Mr. Folsom stated that there are three
options, the first option is a chain link fence with a concrete apron underneath, for long term
which would be the best option and would cost more money. The second option is a wood
rail fence, the top rail and bottom rail would be wood post with a welded wire cattle panel in it
along with the concrete apron, the estimated cost would be $117,000.00 which also includes
the ornamental fence. Mr. Folsom stated that he wouldn't recommend the second option.

post and wood post for support, the contractor would run a strand of bob wire on the bottom
and two strands along the top with about 54th inch on height, with this option the concrete
apron wouldn't be included, the ornamental fence would be included with an estimated cost
of about $75,500.00. Mr. Folsom warned that the third option isn't pleasing to the eye but
would still have the ornamental fence across the front around the parameter but probably
won't last as long as option one. Council requested more estimates.
Mayor Ames read the announcement regarding Executive Session being held at the
conclusion of the General Business portion of the meeting
COMMENTS
Public Comments (Persons are limited to three minutes)
Pastor Howard Cameron 6820 Westgate Dr. Beaumont TX
Spoke to Council as a citizen and as a part of the Area Pastors Council, stated that he
wanted to address the things that he has watched going on in the community and across the
nation, stated how much he appreciates the Mayor and the Council, he is appalled by the
things that are going on in the national and social media, most have no idea who they are
talking about, if people only knew what this Mayor and this Council has accomplished in the
last fifteen or so years they wouldn't begin to criticize anyone on Council, stated to the Mayor
that they are behind her and they won't turn on her, doesn't appreciate one bit those that are
turning on her, appreciates the Council and the Mayor's constant upholding of the churches
as well as prayer in our city
Paul Martin 2485 Hazel Ave. Beaumont TX
Spoke to Council on behalf of cosmetologists who didn't want to come and speak, there are a
lot of cosmetologists who have been out of work for a month following the order of the Mayor
they have stayed home without money, they are independent contractors, they don't qualify
for SBA loans or any of the relief money, stated to the Mayor that the decision she made to
go have a service provided was a poor decision, when you're in a position of leadership you
should be setting an example and not circumventing your own rules to get something done
for your comfort and convenience
Greg Kutz 14925 Lisa Ln. Beaumont TX
Made comments regarding a band that came to Beaumont in 1970 and performed their very
first concert at the KC Hall, also commented on ZZ Top and Babe Didrikson Zaharias, etc.,
there are a lot of people that came from this area the City can celebrate, commented. on the
destruction of the Beaumont School District and a year ago the Mayor tried to strike public
comments, also made comments regarding the Mayor's issue with visiting a nail salon and
putting the business owner in jeopardy and under investigation

Stated that he's a salon owner here in Beaumont, wanted to provide character witness for the
Mayor, stated that he's known the Mayor for close to thirty five years, asked the question, do
we make poor choices in life, yes we do, quoted "he who is without sin cast the first stone";
stated that if the Mayor would have called him and asked him to do it he would have, in their

profession they are designed to be service providers and they build relationships, asked who
can judge what is essential and what is nonessential to an individual, hates that social media
has defamed somebody who has provided such great service to our community, it's
saddening
Robert Pate 6315 RFD Rd. Beaumont TX
Stated that Council does a great job, sometimes we faulter, stated to the Mayor that he
appreciates her apologizing because that's more than other people have done in the past,
what occurred several months ago there wasn't an apology, Mark Twain once said "a rumor
can travel around the world and back before truth gets its boots on", thinks everyone needs
to wait until the truth comes out before they condemn someone, stated to the Mayor that she
does a great job, believes in her and always will
Kathy Burks Thomas 1310 Audubon PI. Beaumont TX
Stated that she supports the Mayor, thinks that the job she's done is incredible, she's
dedicated, she has worked tirelessly during hurricanes, floods and other crisis, under her
leadership there have been parks built, the Event Centre, Lakeside Center etc., there have
been events, festivals and the arts, she has an earnest desire to grow the community and to
see it come together, always impressed as to how intelligent, calm and reasonable she is,
she's recognized by other Mayors around this country

Stated that he wanted to get some things correct regarding the Mayor, stated that the Mayor
was not in the salon to get her nails done, stated that Wendy Williams,and the Breakfast Club
need to get it right, Beaumont is beautiful because of the Mayor, made comments regarding
a Councilmember
Sandy Pate 6315 RFD Rd. Beaumont TX
Spoke in support of the Mayor, stated that the Mayor has been on Council since 1994, she
came on Council to work with a purpose it then became a passion, the Mayor is very
passionate about Beaumont, she has never seen so much hate from people, stated that the
Mayor made a mistake and she has apologized for it, stated that she wants to see a unity on
the Council, when she hears or reads bad things from Councilmembers that sit with her it
hurts her, she's appalled at the things that are being said and asked that everybody stop, if
people don't have anything good to say then don't say anything at all
Misty Anderson 3715 Calder Ave. Beaumont TX
Stated that she's a salon owner here in Beaumont and has been in the industry as a stylist
for almost fifteen years, stated that she along with eight other stylist that work with her have
been unemployed and haven't provided a service to anyone, does believe that people make
mistakes but they should answer for their mistakes, stated to the Mayor that she sat down in
a closed establishment, had a towel placed in front of her with a bowl of solution and that is a
service which is against the regulations set by the Governor, consequences should be
established regarding whatever the investigation reveals, her personal opinion is that
everyone needs to stand up and own what they have done wrong, she feels sorry for the
salon owner because she might possibly lose her license for good

Stated that she was here two months ago and let them know then that no seat is
untouchable, stated to the Mayor that had she not been at that shop we wouldn't be here, on
Tuesday evening she did no wrong, on Thursday she had an apology, told the Mayor that
she made national news, we don't need that here in Beaumont, we know that you have done
good things and we hold you to a better standard, things needs to change, no seat is
untouchable not even hers

Stated that she has been a staunch supporter�of this Council since moving to Beaumont in
2005, has known Mayor Ames all that time, although she appreciates her apology and
believes in her heart that she meant no malice, believes that it would have been seen in a
better light and -perceived as more sincere had the apology been made immediately after the
snafu came to light and not three days later or at the behest of an attorney, although the
owner of the nail salon disobeyed the ,County Judges order she wouldn't have done so if
Mayor Ames hadn't called her for a private appointment, if the nail salon is fined thinks Mayor
Ames should be as well, or at the very minimum Mayor Ames should pay for the salon
owners fine, very disappointed about how the situation was handled by Council resulting in a
Councilmember being censured, by MayorAmes own words "he should be held responsible"
and so should she, asked that the Council censure Mayor Ames and by doing so put this
matter to bed as a majority of the citizens of Beaumont have requested

Mayors leadership, stated that everyone should ask themselves if this was done in malice,
knows that the Council will deal with this situation as best it can and will do the right thing, the
Mayor shouldn't resign or be removed

THE DRAINAGE DITCH BEHIND FLOYD'S RESTAURANT, AFTER
SPENDING SEVERAL THOUSANDS OF DOLLARS ON THIS, IT'S
GETTING TRASHED AGAIN, FOR THE LAST SEVERAL MONTHS HE
HAS BROUGHT UP TWO ADDRESSES 1620 AND 1280 W.
LUCAS WHERE THEY ARE RUNNING A WRECKER SERVICE AND
THE OTHER IS RUNNING A GROUP HOME, WOULD LIKE TO SEE IF
THIS ISSUE CAN BE RESOLVED, ASKED THE CITY ATTORNEY
FOR INFORMATION REGARDING SEX OFFENDERS LIVING NEXT
TO SCHOOLS AND CHURCHES, HE OWES SOME ANSWERS TO
SOME CITIZENS, COMMENTED ON THE FACT THATTHE CITY HAS
BEEN DOING SOME WATER VALVE TESTING, ASKED THAT IN THE
FUTURE COULD THE CITY DO A PSA OR SOME TYPE OF
NOTIFICATION SO THE CITIZENS CAN BE INFORMED AS TO WHEN
THAT TEST WILL HAPPEN, ASKED IF IT'S POSSIBLE MOVING

NOTIFIED, FREQUENTLY THEY GET ASKED BY CITIZENS WHAT'S
GOING ON IN CERTAIN AREAS AND MOST TIMES THEY DON'T
HAVE AN ANSWER BECAUSE THEY DON'T KNOW, IF COUNCIL
COULD GET A HEADS UP THAT WOULD BE HELPFUL
COUNCILMEMBER GETZ - STATED THAT OVER 50,000 AMERICANS HAVE DIED FROM
CORONAVIRUS, WHY IS THERE SUCH AN UPROAR IN
BEAUMONT TEXAS ABOUT THE MAYOR GOING INTO A NAIL
SALON, BECAUSE IT REPRESENTS SOMETHING LARGER,
SOMETHING THAT HE DOESN'T NEED TO GET INTO RIGHT NOW,
THIS HAS CLEARLY CREATED A CRISIS OF CONFIDENCE IN HER
LEADERSHIP, THE MAYOR CREATED THIS ISSUE NO ONE ELSE
DID, SHE NEEDS TO TAKE RESPONSIBILITY FOR IT
COUNCILMEMBER FELDSCHAU - STATED TO THE CITIZENS AND PRIMARILY TO THE CLERGY AND
RELIGIOUS LEADERS IN OUR COMMUNITY, ENCOURAGE THEM
TO MOVE FORWARD VERY CAREFULLY AS THE COMMUNITY
REOPENS, KNOWS THAT THE GOVERNOR HAS PUT OUT THE
ORDER OF 25% OCCUPANCY, UNDERSTANDS THAT EVERYONE
IS EAGER TO REOPEN AND GET BACK TO WORK AS WE SHOULD,
THINKS THAT WE ALL AGREE THAT WE HAVE TO MOVE
FORWARD IN A SAFE MANNER, BELIEVES THAT DOING THIS IN
PHASES IS A RESPONSIBLE MANNER IN WHICH TO DO IT, KNOWS
IT'S A CHALLENGE, MANY OF THE CHURCHES AND PLACES OF
WORSHIP ARE SUFFERING, AS A PASTOR HE'S TRYING TO PUT
TOGETHER A PLAN NOW ON HOW TO REOPEN HIS CHURCH BUT
KNOWS THAT EVERYONE AGREES THAT THEY HAVE TO USE
WISDOM AND TO BE CAREFUL BECAUSE THE SAFETY OF THEIR
PARISHIONER'S AND CITIZENS ARE VERY IMPORTANT

EASTER SERVICE OUTSIDE AT FORD PARK, THANKED HIS
BROTHER AND SISTER-IN-LAW FOR ATTENDING THE MEETING,
APPRECIATES EVERYONE THAT TOOK THE TIME TO COME TO
THE MEETING AND SPEAK, ASKED THAT, CITIZENS KEEP
COUNCIL ON THE PRAYER LIST, COUNCIL'S TRYING TO DO THE
RIGHT THING FOR THE RIGHT REASON
COUNCILMEMBER SAMUEL - STATED THAT DR. KING SAID "THE TRUE MEASURE OF A MAN
IS NOT HOW HE BEHAVES IN A TIME OF COMFORT AND
CONVENIENCE BUT IT'S WHERE HE STANDS IN CONTROVERSY
AND CONFLICT", STATED THAT HE WHO IS WITHOUT SIN OR
FAULT LET HIM CAST THE FIRST STONE, COUNCIL DOES THE
BEST THAT THEY CAN, ARE THEY PERFECT NO, STATED THAT
HE HAS WATCHED THE MAYOR OVER TWENTY FIVE YEARS,
SHE'S NOT PERFECT, SHE'S MADE MISTAKES BUT ONE THING
HE CAN SAY IS THAT SHE HAS ALWAYS ATTEMPTED TO DO
WHAT SHE FELT WAS THE BEST THING, THE COUNCIL HAS TOO
MANY OTHER THINGS THAT THEY NEED TO BE FOCUSED ON BUT
CONTINUES TO BE DISTRACTED, WE NEED TO DO GOOD FOR
THE COMMUNITY AND NOT LET IT BE TORN DOWN

COUNCILMEMBER MOUTON STATED THAT THERE HAS BEEN DISCUSSIONS ABOUT NAILS,
HOGS ETC., THERE ARE PEOPLE DYING EVERY DAY FROM A
VIRUS THAT NO ONE KNOWS HOW TO COMBAT, THE MAYOR
HAS SAID SHE WENT IN THE SALON TO HAVE HER NAILS
SOAKED OFF, SHE HAS APOLOGIZED AND AGREED THAT IT
WASN'T THE BEST DECISION, AS PASTOR FLIPPO STATED, WAS.

COVID-19 HAS BEEN SAID, THANKED SHERRY ULMER,
HEALTH DIRECTOR, MAX NGUYEN, EMS AND TIM
OCNASCHEK, EOC FOR ALL THEY DO, STATED THAT THE CITY
ISN'T OUT OF THE WOODS YET, ENCOURAGED EVERYONE TO
STAY SAFE AND THANKED EVERYONE WHO CAME TODAY
