The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on February 11, 2020, at the
City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 5:30 p.m. to consider the
following:

Mayor Ames called the council meeting to order at 5:30 p.m.
Pastor Cameron Howard with Trinity Church gave the invocation. Mayor Ames led the Pledge of
Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Pate, Councilmembers Neild, Getz,
Feldschau, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City
Attorney; Tina Broussard, City Clerk.

A) Consider a resolution authorizing the City Manager to execute a contract with BDS

B) Consider a resolution approving the purchase of two used aviation fuel trucks from Batot
Ranch Inc. of Beaumont, for use at the Beaumont Municipal Airport — Resolution 20-024
Councilmember Feldschau moved to approve the Consent Agenda. Counci[member Samuel
seconded the motion.

GENERAL BUSINESS
Consider a resolution authorizing the City Manager to execute a contract with BDS
Constructors, LLC dba MK Constructors for the Stoneleigh on Major — Sewer Emergency
Repairs
The Stoneleigh on Major Apartment Complex is located at 4550 N. Major Drive. The City
maintains a 36 -inch sewer main that travels south along the east side of N. Major Drive.
On January 22, 2020, the City became aware that a portion of the 36 -inch sewer main had
collapsed. This collapse has likely, lead to the formation of a large sinkhole located on the
grounds of the Stoneleigh.on MajorApartment Complex. The growing nature of the sinkhole,
exposure of a 30 -inch pressurized water transmission line, and proximity to the apartment
complex, North Major Drive, and the LNVA canal ptoses a threat to public safety.
On January 28, 2020, Water Utilities solicited three (3) bids for furnishing all labor, materials,
equipment, and supplies to replace a segment of 36 -inch pipe and a fiberglass manhole.
Water Utilities has reviewed the three (3) bids and recommended awarding the contract to
BDS Constructors, LLC, dba MK Constructors, in the amount of $270,000.00.
Funds will come from the Capital Program.
Approval of the resolution.
Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
APPROVES THE AWARD OF A CONTRACT TO BDS CONSTRUCTORS, LLC D/B/A MK CONSTRUCTORS, OF
VIDOR, TEXAS, IN THE AMOUNT OF $270,000.00 FOR THE STONELEIGH ON MAJOR -SEWER
EMERGENCY REPAIRS PROJECT; AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED
TO EXECUTE A CONTRACT WITH BDS CONSTRUCTORS, LLC D/B/A MK CONSTRUCTORS, OF VIDOR,
TEXAS. Mayor Pro Tem Pate seconded the motion.

Resolution 20-025
2. Consider a resolution approving the purchase of two used aviation fuel trucks from Batot
Ranch Inc. of Beaumont, for use at the Beaumont Municipal Airport.
The City is currently leasing two aviation fuel trucks to provide aviation fuel at the airport from
Batot Ranch Inc. A 2007 Jet A Truck is being leased for $1,758.48 per month and a 2008 AV
Gas Truck is being leased for $784.14 per month. Total annual lease payments amount to
$30,511.44. It has been determined that purchasing the fuel trucks would be more cost
effective than the lease of same trucks.
Due to the specialization of this type of used equipment, the vendor is considered a sole
source and bids were not required; however, due diligence was performed to ensure that the
price is reasonable.
Batot Ranch Inc will sell the City the 2007 Jet A Truck for $85,313.90 and the 2008 AV Gas
Truck for $57,811.20. Total cost for both trucks is $143,125.10.
Funds will come from the Beaumont Municipal Airport Fund.
Approval of the resolution.
Councilmember Neild moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
APPROVES THE PURCHASE OF ONE (1) 2007 JET A TRUCK, IN THE AMOUNT OF $85,313.90, AND ONE
(1) 2008 AV GAS TRUCK, IN THE AMOUNT OF $57,811.20, FOR USE AT THE MUNICIPAL AIRPORT
FROM BATOT RANCH, INC., OF BEAUMONT, TEXAS, A SOLE SOURCE PROVIDER. Councilmember
Feldschau seconded the motion.

Commented on new drainage that was put in on her street, her back yard was used as a
runway due to the other homes having fences, her yard was filled with sand and when it
rained the sand went down and left a hill, all the water now flows towards her house, her
home has flooded twice, there has never been flooding at her home prior to the drainage
department using her yard as a runway, she is trying to get some justice, she hasn't lived in
her home since it flooded, has contacted the drainage department and they were supposed
to send someone out as well as call her and neither has happened

Thanked Council for the evening meetings, expects Council to have an evening meeting
when there's something controversial, something that citizens are upset about, the items for
this meeting aren't controversial, thanked the city for repairing the lines and sink hole on
North Major Dr.
James Eller 2332 Evalan St. Beaumont TX
Thanked Council for the evening meeting a lot of people have asked for it, commented on the
James Mathews issue, doesn't want to see the city waste anymore tax -payer dollars fighting
this case, thinks that Mr. Mathews should be reinstated
Rose Matthews 5730 Gladys Beaumont TX
Spoke on behalf of James Mathews, stated that the case has brought more shame on the
City of Beaumont than anything she's ever seen, in her opinion Mr. Mathews was fired
needlessly and has fought this for twelve years, asked that Council find it in their heart to do
the right thing, Mr. Mathews deserves every penny that is due him, don't ruin the city for
something like this

Spoke to Council regarding riding bicycles in the city and the fact that people don't know how
to act around bicyclist, there can be proper signage to help with this issue to make the city
safer, there's a need for better markings, sidewalks and crossing lanes, asked that the city
pay more attention to active transportation when planning is done

Addressed issues on Ada Ave., this is a street in the North End, there's a lot of speeding on
that street, there are kids out there riding bicycles and scooters, citizens in the neighborhood
walk their dogs and walk to exercise, there's no sidewalks and drivers are driving 40 to 45
mph, there needs to some type of signage asking motorist to slow down, the street is also
being used for a cut through from Comstock to Haywood, has talked to traffic about this as
well as his Councilmember who has tried to get something done, if nothing gets done a kid is
going to get hurt

Asked why isn't there anything being done to honor William "Boy" Brown for Black History
Month, he's a historian and feels that William "Boy" Brown is being left out, stated that he's
been to Council on several occasions and still nothing has been done to honor him

Thanked Council for the evening meeting, happy to see so many citizens in attendance,
asked that Council keep taxes low and doing what they do to make the city grow, hopefully
there will be at least two to three evening meetings per year

COUNCILMEMBER NEILD - ASKED FOR UPDATES ON THE CHARTER, THE FLOOD AND
STREET STUDY, WOULD LIKE A WORKSESSION ON THE FLOOD
MITIGATION STUDY AND ON THE HOMELESS ISSUE, THANKED
EVERYONE THAT ATTENDED THE MEETING AND RECOMMENDED
THAT A LATE MEETING BE DONE QUARTERLY
COUNCILMEMBER GETZ - THANKED THE CITY FOR THE QUICK RESPONSE REGARDING A
COMPLAINT ABOUT LITTER ALONG AMELIA, STATED THAT '
HOPEFULLY THE CITY CAN GET A HANDLE ON THE LITTER
ISSUE, STATED THAT BISD WILL BE ROLLING OUT A POSTER
CONTEST FOR STUDENTS REGARDING LITTER, THANKED THE
CITY STAFF THAT'S RESPONSIBLE FOR BRINGING HIGH QUALITY
ACTS TO THE CITY, THERE WERE TWO SHOWS THAT TOOK
PLACE AT THE JULIE ROGERS AND THE JEFFERSON THEATRE
COUNCILMEMBER FELDSCHAU - STATED THAT AFTER BEING ON COUNCIL FOR NINE MONTHS,
THIS WAS THE QUICKEST MEETING THAT HE'S EVER ATTENDED,
