MEETING DATE: February 11, 2020
REQUESTED ACTION: Council consider a resolution authorizing the acceptance of a five
feet (5') x three hundred feet (360') wide sidewalk easement.
BACKGROUND
Escar W. Davis, Jr. has agreed to convey a five feet (5') wide sidewalk easement across the
property located at 3675 Washington Blvd. The easement is described as being 5' x 300' out of
Lots 1-4, Block 5 of Carver Terrace Addition. The easement is for the construction of a
continuous sidewalk for the Washington Blvd Phase 2 Street Improvement Project.
FUNDING SOURCE
Not applicable.
RECOMMENDATION
Approval of the resolution.
RESOLUTION NO.
WHEREAS, Escar W. Davis, Jr. has agreed to convey one (1) five foot (5') wide
sidewalk easement, said easement being 5' x 300' out of Lots 1-4, Block 5 of Carver
Terrace Addition, Jefferson County, Texas as described and shown in Exhibit "1,"
attached hereto, to the City of Beaumont for the construction of a continuous sidewalk for
the Washington Boulevard Phase 2 Street Improvement Project; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
is in the best interest of the City of Beaumont and that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT one (1) five foot (5') wide sidewalk easement conveyed by Escar W. Davis,
Jr. being 5'x 300' out of Lots 1-4, Block 5 of Carver Terrace Addition, Jefferson County,
Texas as described and shown in Exhibit "1," attached hereto, be and the same is hereby,
in all things, accepted for the stated purposes.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

SIDEWALK EASEMENT
THAT BEAUMONT FRAME AND FRONT END, hereinafter called "GRANTOR", for and in
consideration of the sum of ONE AND N0/100 DOLLAR ($1.00), and other good and valuable
consideration to us in hand paid by the CITY OF BEAUMONT, a municipal corporation domiciled in
Jefferson County, Texas, hereinafter called "GRANTEE" or the "CITY", the receipt and sufficiency of
which consideration is hereby acknowledged, has GRANTED and CONVEYED, and by these presents
does GRANT and CONVEY unto the said CITY OF BEAUMONT, its successors and assigns a right,
privilege, and easement for sidewalk purposes in, over and across that certain tract of land owned by
GRANTOR in the CITY OF BEAUMONT, Jefferson County, Texas, said easement described in
Exhibit "A" attached hereto and made a part hereof for all purposes.
The easement herein granted shall be used for the purpose of constructing, reconstructing, and
maintaining sidewalks, and the following rights are also hereby conveyed:
It is expressly understood and agreed that the City shall have the right of ingress to and egress
from the above described tract of land of the GRANTOR as well as beneath and below the surface of the
above described easement for the aforesaid purposes of this easement.
The City hereby agrees that upon any exercise of its rights hereunder, that it shall repair any
damage caused by the City and restore Grantor's property to the same condition as before City's work,
including the relocation of any subsurface improvements such as sprinkler lines. The City also agrees
that any work performed under this easement shall not deny pedestrian and vehicular ingress and egress to
and from Grantor's property. Acknowledging the limitations placed upon municipalities by the State
Constitution, the City agrees, only to the extent allowed by the laws and Constitution of the State of
Texas, to indemnify and hold Grantor, and any tenant of Grantor, harmless from claims, actions, costs and
damages arising from any injury suffered by third parties due to the City's negligence or intentional acts
under this easement.

REQUESTED ACTION: Council consider a resolution authorizing the acceptance of one
Exclusive Water Line Easement, two Water Meter Easements and
two Fire Hydrant Easements.
BACKGROUND
Laurel Vista Apartments, LP has agreed to convey five (5) easements. The easements are as
follow: a 10' Exclusive Water Line and a 10' x 10' Fire Hydrant Easement described as being a
0.0994 acre tract of land being a portion of Tracts 6 and 7, Plaza 10 Addition to the City of
Beaumont; a 5' x 5' Water Meter Easement being a 0.0006 acre tract of land and being a portion of
Tract 6, Plaza 10 Addition to the City of Beaumont; a 10' x 10' Water Meter Easement being a
0.0023 acre tract of land and being a portion of Tract 8, Plaza 10 Addition to the City of Beaumont
and a 10' x 10' Fire Hydrant Easement being a 0.0023 acre tract of land and being a portion of
Tract 8, Plaza 10 Addition to the City of Beaumont. The easements are for the construction of
new apartments located at 3400 Veterans Circle.

attached hereto; a 5' x 5' water meter easement, being a 0.0006 acre tract of land and
being a portion of Tract 6, Plaza 10 Addition, Jefferson County, Texas as described and
shown in Exhibit "1," attached hereto; a 10' x 10' water meter easement, being a 0.0023
acre tract of land and being apportion of Tract 8, Plaza 10 Addition, Jefferson County,
Texas as described and shown in Exhibit "1," attached hereto; and, a 10'.x 10' fire hydrant
easement, being a 0.0023 acre tract of land and being a portion of Tract 8, Plaza 10

THAT, LAURA VISTA APARTMENTS, LP, a Texas limited partnership, of the
County of Hamilton, State of Indiana hereinafter called "GRANTOR", whether one or more, for
and in consideration of the sum of ONE AND NO/100 DOLLAR ($1.00), and other good and
valuable consideration to us in hand paid by the CITY OF BEAUMONT, a municipal
corporation domiciled in Jefferson County, Texas, hereinafter called "GRANTEE", the receipt
and sufficiency of which consideration is hereby acknowledged, has GRANTED, SOLD and
CONVEYED, and by these presents does GRANT, SELL and CONVEY unto the CITY OF
BEAUMONT, P. O. Box 3827, Beaumont, Texas 77704, Jefferson County, Texas, its
successors and assigns, a Water Line Easement and the exclusive right to construct, alter, and
maintain said waterlines, water meters, fire hydrants and appurtenances on the hereinafter
described lands which said easement is under, over, in and across those certain tracts or parcels
of land owned by GRANTOR situated in the County of Jefferson, State of Texas, and being
more particularly described in Exhibits "A, B, C, D, E, F, G & II", attached and made a part
hereof for all purposes.
The easement herein granted shall be used for the purpose of placing, constructing,
operating, repairing, rebuilding, replacing, relocating, and/or removing water lines, water meters,
fire hydrants and appurtenances, and the following rights are also hereby conveyed:
It is expressly understood and agreed that the City of Beaumont shall have the right of
ingress to and egress from the tracts of land hereinbefore described and use of the same for the
purposes aforesaid, and giving said City the right and privilege to improve, maintain and operate
the same as permitted by law.

BACKGROUND
The Stoneleigh on Major Apartment Complex is located at 4550 N. Major Drive. The City
maintains a 36 -inch sewer main that travels south along the east side of N. Major Drive.
On January 22, 2020, the City became aware that a portion of the 36 -inch sewer main had
collapsed. This collapse has likely lead to the formation of a large sinkhole located on the
grounds of the Stoneleigh on Major Apartment Complex. The growing nature of the sinkhole,
exposure of a 30 -inch pressurized water transmission line, and proximity to the apartment
complex, North Major Drive, and the LNVA canal poses a threat to public safety.
On January 28, 2020, Water Utilities solicited three (3) bids for furnishing all labor, materials,
equipment, and supplies to replace a segment of 36 -inch pipe and a fiberglass manhole. Water
Utilities has reviewed the three (3) bids and recommended awarding the contract to BDS
Constructors, LLC, dba MK Constructors, in the amount of $270,000.

Capital Program.

WHEREAS, the City of Beaumont solicited bids for furnishing all labor, materials,
equipment and supplies for the Stoneleigh on Major -Sewer Emergency Repairs Project;
and,
WHEREAS, DBS Constructors, LLC d/b/a MK Constructors, of Vidor, Texas,
submitted a complete bid meeting specifications in the amount of $270,000.00; and,
WHEREAS, the City Council is of the opinion that the bid submitted by BDS
Constructors, LLC d/b/a MK Constructors, of Vidor, Texas, is the lowest responsible
bidder providing the best value to the City and should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the City Council hereby approves the award of a contract to BDS
Constructors, LLC d/b/a MK Constructors, of Vidor, Texas, in the amount of $270,00.00,
for the Stoneleigh on Major -Sewer Emergency Repairs Project; and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute a contract with BDS Constructors, LLC d/b/a MK Constructors, of
Vidor, Texas, for the purposes described herein.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.

REQUESTED ACTION: Council consider a resolution approving the purchase of
two used aviation fuel trucks from Batot Ranch Inc. of Beaumont,
for use at the Beaumont Municipal Airport.
BACKGROUND
The City is currently leasing two aviation fuel trucks to provide aviation fuel at the airport from
Batot Ranch Inc. A 2007 Jet A Truck is being leased for $1,758.48 per month and a 2008 AV Gas
Truck is being leased for $784.14 per month. Total annual lease payments amount to $30,511.44.
It has been determined that purchasing the fuel trucks would be more cost effective than the lease
of same trucks.
Due to the specialization of this type of used equipment, the vendor is considered a sole source and
bids were not required; however, due diligence was performed to ensure that the price is
reasonable.
Batot Ranch Inc will sell the City the 2007 Jet A Truck for $85,313.90 and the 2008 AV Gas Truck
for $57,811.20. Total cost for both trucks is $143,125.10.
FUNDING SOURCE
Beaumont Municipal Airport Fund.

THAT the City Council hereby approves the purchase of one (1) 2007 Jet A Truck, in the

use at the Municipal Airport from Batot Ranch, Inc., of Beaumont, Texas, a sole source,
provider.
