Services. MEETING DATE: February 4, 2020 REQUESTED ACTION: Council consider a resolution approving the renewal of an annual software maintenance agreement with Cityworks. BACKGROUND Cityworks software is used by the City in multiple departments for managing and maintaining work orders, permits, inventory, and cases related to permitting, code enforcement, . water/street/traffic/parks work requests and zoning. This purchase is exempt from competitive bidding since it is available from only one source having exclusive rights to modify and maintain the software. The software maintenance agreement provides Monday_ — Friday, 8 - 5 support for all applications, and provides annual software upgrades. The Code Enforcement group went.live with the software on August 12, 2019. All other departments are in the process of implementation and testing. They are projected to go live by the end of summer 2020. This agreement is for an annual _period beginning March 2020 in the amount -of $112,000.- FUNDING SOURCE General Fund and Water Fund. RECOMMENDATION Approval of the resolution. RESOLUTION NO. BACKGROUND The City of Beaumont receives an annual allocation of HOME Investment Partnership funds from the U.S. Department of Housing and Urban Development (HUD). Federal regulations require that a minimum of fifteen percent (15%) of the City's total HOME fund allocation be allocated to Community Housing Development Organizations (CHDO's) for eligible CHDO activities. Legacy Community Development Corporation (Legacy CDC), a certified CHDO, is seeking to stabilize neighborhoods by providing homeownership opportunities for low to moderate income families. Legacy proposes to utilize $160,271 (Entitlement funds) and $68,630 (CHDO Reserve funds) for acquisition, rehabilitation and resale of three (3) homes to be sold to eligible low to moderate income families. In addition, Legacy is requesting $22,877 for operating funds. The funds will be used to cover the salaries for administrative staff. Any and all income received by Legacy for any properties must be used toward furthering the organization's affordable housing activities. The proposed RV Resort will consist of 50 pad sites with 50 AMP electrical, and 4" sewer connections. The rental office will be staffed and open for business 24 hours per day. We will provide total management of property, with manager on site and staff at 24 hours for traveler's assistant. Each RV pad will have a state of art pedestal with utility connections, water, 50 AMP electric & internet Wi-Fi at location. There is a 4" sewer connection for each RV at designated location within the 5' grass area. The site will be 8' fenced on all sides (except that area front entry) and provide camera and security systems for monitoring. The office will be facing north by Hwy 69 side to monitor the site and visible activities of traffic in and out. All structures will be constructed with a minimum of 18" inches above the Base Flood elevation or be flood proofed to 18" inches above the Base Flood Elevation. In addition, all electrical hook- ups will be at least 18" inches above the Base Flood elevation. All sewer, hook-ups will be designed so they can be completely sealed in the case of a flood. We would like to start the project in soon as February 2020 with ground break and construction. All the private utilities will comply with the plumbing codes requirements and tie into nearby 36" existing sewer line the rear of property and 6" PVC waterline along, Bragg Circle. The RV Park will provide fire hydrants as per fire code. All roadways will be 6" reinforced concrete pavement with drainage and grading design. 4. The design, location and arrangement of all driveways and RV Parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent development; The proposed RV Park will be designed for all safety requirements of TxDot drainage criteria, one 36' wide entrance and radii to meet the guidelines and provide safety ends at each side of driveway. There will be stop sign at the exit entering to Hwy 69 frontage Service Road. All road ways are design for 20' wide fire truck accessibility with all turning radii of 25' as shown on site plan. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; The proposed RV Park will be regulated by the property management team, as part of their job descriptions, will be monitoring the site for QA/QC of physical appearance and cleanliness. The dumpster provided with enclosure doors and fenced surrounded with shrubs. There will be guideline and brochure for not littering and map of the site for dumpster location. Since there are no dirt roadways, dust will not be issue. If any noise or vibration noted at the site, the tenet will be notified for warning. 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; The proposed RV Park will have the sign and light for directional as per City ordinance requirement. All the lighting system at the site will be LED with proper design luminous to not disturb or affecting neighboring properties. i. BACKGROUND L.W. Beaumont, LLC received a Specific Use Permit to allow a sports bar at 6210 Phelan Boulevard in October 2018. The plans called for the use of the interior space as well as a covered area. An application for a building permit was submitted for the restaurant/bar which included a 4,024 square foot interior area and a 2,912 square foot covered patio area, with no exterior seating shown. The registered design professional, H.M. McLeod, estimated the occupancy at 395 which was within the 428 max occupant allowance according to the 2015 International Building Code. Following interior demolition of the space, permit #18-3843 was approved for the restaurantibar. During a final inspection, unapproved changes/alterations were found that were not shown on the original, permitted plan set. The major change from the original approved plan submission was the expansion and improvements to the grassy area outside of the covered patio area. A fence was extended to allow for additional customer seating and customer activities. This additional customer area required additional means of egress within the fenced in area. This required multiple conversations with the design professional as the owner was concerned about controlled access to his business versus the required emergency egress to meet code. Multiple plan revisions were submitted for consideration. Three occupant loads were specified by the applicant's design professional for the temporary occupancy of the building. The interior building was calculated at 200 people, the outside covered patio was calculated at 209 people, and the uncovered grass area was calculated at 381 people. Also, during the plan revision process further discussions revealed that Little Woodrow's was operating as more of a bar which served food, rather than a bar/restaurant. This reclassification of use would require Little Woodrow's to add additional plumbing fixtures to the facility. An application for a new building permit was submitted by Classic Construction to add ten additional bathroom fixtures and four additional lavatories to meet a new, proposed occupancy count of 700. The permit was placed on hold for consideration by the Planning Commission and City Council. Little Woodrow's is located at the southeast most tip of the Colonnade Shopping Center. As a requirement for the original Specific Use Permit, screening and a masonry wall were installed. 'The new addition will be approximately 1,500 square feet and include new cooler/storage space .and additional restrooms to accommodate the additional occupancy and seating area. This addition will be located along the east side of the building providing an additional buffer from noise for the adjacent residential neighborhood. With regard to parking, it should be noted that concerns have been raised by other tenants about the availability of adequate parking. It should also be noted that the calculation of occupancies is set forth in the Building, Fire and Plumbing Codes, whereas the calculation of required off-street .parking is set forth in the Zoning Ordinance, reviewed by the Engineering Department. A parking analysis was conducted as part of this revised Specific Use Permit. It found that while demand for the parking spaces at the interior of the shopping center is high, the minimum of spaces has been provided at the shopping center, albeit some spaces are located farther afield at the perimeter of the shopping center. At a Joint Public Hearing held on October 21, 2019, the Planning Commission recommended 5:0 to approve the request for a Specific Use Permit to allow the expansion of a bar in a GC -MD (General Commercial -Multiple Family Dwelling) District with the following conditions: 1. Install an eight foot (8') tall opaque perimeter fence. 2. Keep litter in direct area of subject property contained. 3. No live music allowed. The Zoning Ordinance states, "The City Council shall not amend, supplement, change, modify or repeal any regulation, restriction or boundary or approve a Specific Use Permit where a protest against such change (has been filed), signed by the owners of twenty percent (2001o) or more either of the area of the lots included in such proposed change or of the lots or land immediately adjoining the same and extending two hundred (200) feet therefrom, except by the favorable vote of three-fourths (3/4) of all the members of the City Council. " Protest against this request was received from more than 25% of the land immediately adjoining the subject property. Therefore a vote of three-fourths (3/4) of the City Council shall be required to approve the requested Specific Use Permit. In an effort to mitigate the impact of the business on surrounding land uses, the applicant has offered to limit the number of occupants to four hundred (400) and, working with the owner of the center, provide additional parking spaces, dedicated for the adjacent tenant. At the December 10, 2019 City Council Meeting, it was noted that the site plan did not accurately reflect the parking layout. Council voted to request a revised site/parking plan and send the item back to the Planning Commission for review. Engineering has reviewed the revised parking plan and found that the minimum number of required parking for the shopping center is four hundred five (405) and with some minor modifications to the proposed parking layout it appears that this minimum parking requirement can be provided. The Engineering Division will need to review and approve the final parking layout. At a Joint Public Hearing held on January 27, 2020, the Planning Commission recommended 8:0 to approve the request for a Specific Use Permit to allow the expansion of a bar in a GC -MD (General Commercial -Multiple Family Dwelling) District with the following conditions: 1. Install an eight foot (8') tall opaque fence along the east property line of the shopping center. 2. Keep litter in direct area of subject property contained. 3. No live music allowed. 4. Occupancy be limited to 400 persons. 5. Provision of a minimum of four hundred five (405) parking spaces at this shopping center, with final design to be approved by the Engineering Division. 6. Provide a minimum of twenty (20) parking spaces dedicated, through signage, to the adjacent tenant. FUNDING SOURCE Not applicable. I: _��1:�L'1ZI11L11; In order to continue to offer a high-quality public transit service within the city, the transit system's vehicle fleet should be replaced and upgraded over time. Last year, two (2) small, CNG -fueled buses were added to the on -demand paratransit service fleet and the year before that, three (3) new large, CNG -fueled buses were added to the fixed -route fleet. The proposed grant would include a request to purchase four (4) small paratransit buses and three (3) large, fixed -route buses. The estimated cost for the small buses is $120,000 each and they are expected to be in service for a minimum of five (5) years and 150,000 miles. The large buses are estimated to cost $525,000 each and are expected to be in service for a minimum of twelve (12) years and 500,000 miles. As these are minimums, we expect much longer service life for both types of vehicles; however, as with any vehicle, as they age, the ongoing maintenance costs continue to increase. It should be noted that historically, the required local match for vehicle grants has been 20%; however, the current rules require a 50% match. As such, the proposed budget for the grant request will be $2,055,000, with a local share of $1,027,500. It should be noted that TXDOT has given no clear indication of how much funding the system might be awarded and as such, the grant amount and related local match could be significantly less. TXDOT will announce grant awards and amounts in May, 2020. All vehicles that will be replaced as a result of this grant award will have met their FTA minimum age and mileage requirements. In prior discussions regarding the types of buses that should be purchased, the question of "low ridership" or few riders on big buses is often raised. To that end, there is currently consideration for a pilot project to use smaller buses on fixed routes with low ridership. However, a variety of factors should be considered. First, while larger buses are more than three times more expensive than small buses, their expected life is much more than three times the useable life (years and mileage) of the small buses. In addition, the operating costs (drivers, fuel and maintenance) of small buses is similar to the large buses. Second, larger buses can carry three times as many people. While this may not be an issue on low -ridership routes, especially at peak times, there may be occasions where more than ten (10) riders wish to use the bus, which would result in a denial of service to the rider. In addition, during an evacuation, larger buses will allow for faster evacuation of more citizens. Finally, having fewer large buses, will affect the ability to exchange buses on busier routes where a bus may be out of service due to an accident and/or a mechanical issue. FUNDING SOURCE The grant will pay up to 50% of the costs of the new buses; with a required 50% match to be funded by the Beaumont Municipal Transit Fund. RECOMMENDATION Approval of the resolution. Section 2. In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont, Chapter 24, Article 24.04 of the Code bf Ordinances of Beaumont, Texas, it is hereby ordered that the owner or owners of the above described buildings demolish and remove said structures within ten (10) days of the effective date of this ordinance. If the property owner(s) fail(s) to comply within ten (10) days, Council orders that the property be demolished without further notification to the property owners or City Council action. Section3. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable. Section 4. That any person who violates any provision of this ordinance shall, upon conviction, be punished as provided in Section 1.01.009 of the Code of Ordinances of Beaumont, Texas. The meeting at which this ordinance was approved was in all things conducted in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551.
