FILE: 904 -OB STAFF REPORT Robert Holbert, P.E., is requesting a waiver to the requirements for a sidewalk at 6030 N. Major Drive. Reasons for the request include an emergency storm water overflow that connects to the existing TXDOT roadside ditch. Construction of a sidewalk would require a culvert at the overflow. Mr. Holbert states that the additional construction would add approximately $4,500 to the project costs. With regard to the waiver, the ordinance states: (3) The planning and zoning commission may grant a waiver to the sidewalk requirement if the applicant can prove that there is an engineering reason for not installing a sidewalk. (Chapter 26, Section 26.03.004 (3)) Although a letter has been submitted from an engineer, City Engineering has reviewed the request and states, "I consulted with TxDOT regarding the sidewalk variance request. We have agreed that the proposed sidewalk will not negatively impact the area, and the cost associated with it's installation is insignificant when compared to the cost of the entire project. The sidewalk variance request is denied. " Planning staff recommends denial of the request. Exhibits are attached. Major Drive Dear Planning and Zoning Commission: The City is requiring a 5 -ft public sidewalk along ail project frontage (SH -105 and Major Drive). lam respectfully requesting a wavier for a portion of the public sidewalk south of our proposed driveway on North Major Drive (approximately 250 feet). I am requesting the waiver for the following engineering reasons: There is an emergency stormwater overflow in the southwest corner of the property (as shown) and connects to the existing TxDOT roadside ditch. In order to construct sidewalk in this area, we would need to design a culvert. This crossing has the potential to hinder the flow of extreme storm events and cause flooding of garages and/or neighboring properties. Long term culvert maintenance is expected to be minimal given the location and this will further exacerbate the issue; and The sidewalk will not connect to any other sidewalks, thereby stranding any potential pedestrians. Additionally, Major Drive isn't constructed to its full width. Any improvements (e.g. culvert) installed now will potentially be demolished during the future reconstruction of the road.
