Glen Johnson would be appointed to the Police Department Community Advisory Committee. The
term would commence December 17, 2019 and expire September 30, 2021. (Councilmember

A) Approve a contract with Marsh Waterproofing, Inc., of Vidor for maintenance and repair
services — Resolution 19-291
B) Authorize the City Manager to execute,an annual agreement with Capital Edge Advocacy,
Inc. to provide services as the City of Beaumont's Washington Assistant — Resolution 19-

C) Authorize the City Manager to execute an agreement with Fiberlight LLC forthe placement of
fiber.optic cable in public rights-of-way — Resolution 19-293
D) Authorize the settlement of the lawsuit styled Chasity Guidry, et al vs. Daniel Guillory and
City of Beaumont; Cause No. D-203,613 — Resolution 19-294
E) Authorize a one-year contract with the Greater Beaumont Chamber of Commerce for the
period of January 1, 2020 through December 31, 2020 — Resolution 19-295

GENERAL BUSINESS
Consider a resolution authorizing the City Manager to execute an agreement with CDM
Smith, Inc., of Houston, to continue management of the Municipal Separate Storm Sewer
System (MS4) Permit for Fiscal Year 2020.
On October 16, 2012, by Resolution No. 12-249, City Council awarded CDM Smith, Inc., of
Houston, an agreement for Professional Engineering Services to manage the MS4 Permit.
The manager of the permit conducts dry and, wet weather screenings of our five (5) major
outfalls in the City. Under the permit, the City is required to submit an annual report
summarizing activities and results of the screenings and other inspections conducted
throughout the yearwhich CDM Smith, Inc., has successfully completed on the City's behalf
since 2012.

If approved, the total services and expenses shall not exceed $250,000.00 without the City's
prior written authorization.
Funds will come from the General Fund and Public Works Department.

Councilme nber Neild moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS
HEREBY AUTHORIZED TO EXECUTE AN ENGINEERING SERVICES AGREEMENT WITH CDM SMITH, INC., OF
HOUSTON, TEXAS, IN AN AMOUNT NOT TO EXCEED $250,000.00 TO MANAGE THE MUNICIPAL
SEPARATE STORM SEWER SYSTEM (MS4) PERMIT. Mayor Pro Tem Pate seconded the motion.

WORK SESSION
Review and discuss Flood Plain Management Services provided by the Army Corp
of Engineers
Lisa McCracken Mairs, Project Manager with the .US Army Corps of Engineers,
Galveston District discussed the Army Corps of Engineers Partnership Opportunities,
Ms. Mairs discussed the Flood Plain Mitigation Services, Flood Plan Management
Services and Planning Assistance to States and Continuing Authorities Program.
There was also discussion regarding eligibility requirements, a two-phase process,
reporting to Congress on future Water Resource Developments and Section 1001 of
WRRDA 2014, the criteria for consideration, preparing and submitting a proposal as
well as an anticipated timeline. Ms. Mairs discussed how to get started, all programs
require non-federal funds, participation in any program requires a letter of intent from
the non-federal sponsor. The non-federal sponsors can be State, Regional or Local
Governments; as well as non-federal public agencies and Indian Tribes along with
7001 requests requiring proposals.
Mayor Ames read the announcement regarding Executive Session being held at the
conclusion of the General Business portion of the meeting.

Stated to Council that communication is the key, even when you don't get along with your
neighbor you have to come up with a common reason to get something solved, if all the facts
aren't stated then it's fictional period, agreed that flooding needs to, be looked at, mentioned
how bad the feral hogs are getting, something needs to be done

Commended the Council for having a robust conversation, thanked the Army Corps of
Engineers for their presentation, it creates a better idea of what needs to happen, stated the
facts remain the facts, commended DD6 for the great job they are doing with pushing the
water up hill, that only happens when there is blockage

Stated that he's trying to understand how the organizations are fitting in together, the
Southeast Texas Regional Planning Commission is putting together a big organization,
sounds like what is being discussed should be done with multiple Counties, asked if Council
could look into what the Regional Planning Commission is putting together and if it would be
a solution, thinks that everyone should work together, glad the city is hearing from the Army
Corps of Engineers because the water has become a problem

Stated that she has sat, heard and listened to the presentation, has heard the robust
conversation, pointed out as she knows and that Council knows federal is fine and has a
nice sound bite but federal is slow, it's laborious, it's a stalemate, and suspects that some of
the projects that were mentioned in the presentation that fell off the list died there, she's sure
the city doesn't want to be like that, the city issues are now and the "what" to be done is now

GEARY SENIGAUR, STATED THAT HE PARTICIPATED ALONG
WITH COUNCILMEMBER NEILD, IT WAS GOOD TO HAVE CITIZENS
OUT EXPRESSING THEIR CONCERNS AND INTEREST, IT'S HIS
HOPE THAT THEY CAN DO IT AGAIN, STATED THAT THERE ARE
SEVERAL THINGS THAT NEED TO BE DISCUSSED IN EXECUTIVE
SESSION REGARDING LEGAL MATTERS FOR THE CITY OF
BEAUMONT, COUNCIL HASN'T BEEN BRIEFED ON THE CASES
FOR A VERY LONG TIME, THE CASES PERTAIN TO BRANDI
