SUBJECT: Consider a request for a Rezoning of the rear portion of a commercial property
from RS (Residential Single -Family Dwelling) to GC -MD -2 (General
Commercial - Multiple Family Dwelling - 2) District.

Richard Faust of Faust Engineering and Surveying is requesting a Rezoning for the rear of the
property located at 7380 Bythewood Road. Quail Land Company has purchased this tract of land
as well as the tract to the north, which is zoned GC -MD (General Commercial - Multiple Family
Dwelling). Plans are to develop the property as a unit and therefore needs to be zoned
consistently.
The Development Strategies diagram of the Comprehensive Plan designates this property to be
within a neighborhood growth unit area. Effective planning strategies typically encourage
commercial uses at major intersections and high density housing along major arterial streets.
Our City's Major Street and Highway Plan displays that Tram Road is a Secondary Arterial and
Bythewood Road is a local street. Within the past fifteen (15) years, three (3) new houses have
been constructed along Bythewood Road. Rezoning this property for commercial use could
encroach into a viable residential neighborhood.
Staff recommends denial of the request.
Please note that final occupancy approval is subject to review and acceptance of submitted plans
and field inspections to verify compliance with applicable codes.
