Confirmation of board and commission member appointments — Resolution 19-255
Andy Bogan would be appointed to the Convention and Tourism Advisory Board. The term
would commence November 5, 2019 and expire September 30, 2021. (Councilmember Randy
Feldschau)
A) Approve the purchase of network router and switch equipment from CDW-G for use in the
Police Department — Resolution 19-256
B) . Authorize the settlement of the lawsuit styled Joseph Thomas Rye v. The City of Beaumont;
Cause No. D-203,501 — Resolution 19-257
C) Approve the purchase of one 24" control valve from Municipal Valve of Wimberly, Texas for
use at the City Water Utilities Department — Resolution 19-258
D) Authorize the City Manager to sign a contract for an Intelligence Led Police Training Course
funded through the U.S. Department of Justice Project Safe Neighborhoods Block Grant
Program — Resolution 19-259

1. Consider a resolution to -adopt City Council Procedures and Decorum Policy in the
conducting of its business.'
The Beaumont City CharterArticle 111, Section 9 states thatthe City Council shall determine
its own rules and order of business.
There has been recent discussion and requests made for Council to consider the adoption of
rules of decorum to ensure that Council meetings are conducted in an orderly and efficient
manner. A draft of a suggested City Council Procedures and Decorum Policy will be
provided for your consideration.

2. Consider a resolution to approve or deny the scheduling of a work session item on a future

An action item to adopt Robert's Rules of Order was requested by Councilmember Getz.
The City Council will determine if they would like to have a work session to discuss this topic.

HEREBY AUTHORIZED TO SCHEDULE A WORK SESSION ITEM ON A FUTURE CITY COUNCIL AGENDA TO

3. Consider an ordinance to declare thirty (30) structures to be unsafe structures and order the
owners to raze the said structures within ten (10) days. If the property owner fails to comply
within ten (10) days, staff is requesting City Council authorization to demolish these
structures without further notification to the property owner or City Council, action.
Additionally, if the property owner of a structure requests and is authorized by City Council to
enroll in a work program, all delinquent taxes shall be paid in full or a payment -plan shall be
established prior to enrollment in the work program. Enrollment in the work program shall
occur within ten days after the effective date of this ordinance.

These structures have been inspected by the Building Codes Division and found to be
unsafe structures as defined by the City of Beaumont's Code of Ordinances, Chapter 24,
Article 24.04 Unsafe Substandard Structures, Division 1, Sec. 14.04.001 of the 2015
International Property Maintenance Code. Additionally, these structures have deteriorated to
a condition that they are no longer considered suitable for repair.
Sources may include General funds and Community Development Block Grant (CDBG)
funding.

Councilmember Neild moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE FINDING CERTAIN
STRUCTURES TO BE PUBLIC NUISANCES AND ORDERING THEIR DEMOLITION AND REMOVAL OR REPAIR;
AS WELL AS TO ALLOW PROPERTY OWNERS OF ITEMS #7, 11 AND 18, TO ENTER INTO A 150 DAY
WORK PROGRAM ON THE DANGEROUS STRUCTURES LIST, PROVIDING FOR SEVERABILITY AND
PROVIDING FOR A PENALTY. Councilmember Samuel seconded the motion.

Spoke to Councilregarding the Worksession that occurred on Monday, stated that Council
decided ' to move forward on the additional water pump station, thought this was a smart
move, it's probably the best thing that can be addressed given the condition of the pump
station, asked that the right height be used and notjust meetthe standard flood level, thinks
the city should go well above the standard level

Stated to Council that there is a veteran that wants to look into getting some,of the red tag
homes, would like to get veterans to work on those homes, this way they will learn a trade
and give back to the communit', asked that the city help push this forward especially for

some of the lower income citizens, spoke with a couple of Councilmembers in regards to the
$29 million, asked that Council try and do some type of flood mitigation especially on
Delaware to pump the water through conveyance water tunnels and maybe get with DD6'to
cut cost, DD6 may have a FEMA project in the works where they may be getting
reimbursement from FEMA at the same time

Addressed Council regarding the proposed Dowlen Road extension that Council has been
discussing recently, stated that most of the Council's discussion around this extension is that
the city has to grow, seems like Council is trying to grow this city for a city that's already here,
the South and East side of the city is almost forgotten, the City Manager was cavalier
enough to say that it would take a billion dollars to repair all the streets in the city, he stated
that he doesn't know how anyone can be that unconscionable and say something like that
about the rest of this city, there might be about three million dollars or more to repair streets,
the Dowlen Road extension would probably be good for a city that has forty two million
dollars to just throw away, the city has already extended the street past the mall and is
waiting on money back by people building on it and now you want to extend Dowlen Rd., to I -

10, there will be a wait of another ten to fifteen years to receive the money back on that
extension, in the mean time the citizens on his end of town are still having -to dodge pot
holes, the two most vocal supporters of this proposal has probably never had to dodge a pot
hole, he dodges them every day, stated to Council'that when they start thinking about how to
advance this city it can't be ' done by leaving the rest of the city behind, that's how city's
deteriorate, there's advancement out to the West, the South and East just keeps going down
the drain, asked that some money be spent on his street

Spoke to Council regarding herwater bill, stated that in September herwater bill was $80.22,
received her Octo ' ber bill it was $127.00, her November bill was $252.00, stated that she
contacted the city and spoke to Ms. Hoyt and others in. Water Customer Service on several
different occasions, it was stated to her that she may have a leak and needed to get it
checked, the house she lives in is a scattered sight home with the Beaumont Housing
Authority, the maintenance man walked the property and there was no leak found, when the
water was turned on the meter started to spin at a tremendous rate, asked for some help
dealing with this issue

Spoke about the proposed extension to Little Woodrow's Sports Bar on Phelan, has serious
concerns regarding the safety and the disaster planning in the parking lot, this has a direct
correlation with the maximum occupancy, the improvement to the parking and the
accessibility to the other businesses has improved quite a bit'since the maximum occupancy
has been reduced this past week to the correct level, approving the proposed expansion
would result in going back to a higher maximum level, this would affect the parking, the
parking lot is simply to small, stated that she relies on Basic Foods extensively as it s the
only one in Beaumont, if something were to happen and the store closed she would have to
drive to Houston and doesn't want to do that, it has been difficult to find somewhere to park,
has felt unsafe to go to the store at times, asked that Council please consider all that is
involved

Spoke regarding Basic Foods and how grateful she is that it's here in Beaumont as she has
a digestive health issue and relies on Basic Foods, with the opening of Little Woodrow's
Sports Bar the store has experienced a major decline in customer traffic, customers �have
had to walk long distances from their vehicles to the store, asked that Council would take this
into consideration as well as visiting the Colonnade to see the parking lot and the situation,
there's not enough parking capacity for the patrons that are visiting

Stated that she's against the expansion for Little Woodrow's Sports Bar, would like to see
the occupancy go down for the same reasons that was stated previously, the parking has
been an- issue, this has lowered Basic Foods revenue, there will be continued conflict
between the neighbors and Little Woodrow's regarding the parking, if Basic Foods could
have more designated parking spots that mi ay help, the owner of the Colonnade shopping
center has allotted Basic Foods nine parking spaces in front of the their store, it has helped

some but more is needed, commented on the conditions that Planning and Zoning put
forward �in regards to the expansion, doesn't think this will work

Spoke to Council regarding her water bill, in June herwaterwas cut off at her rental property,
stated that she is still getting.a water bill every month for the same amount which is about
three hundred dollars, stated that she wasn't aware that she needed to come to the Water
Department and have the water turned off as it was already cut off

Spoke regarding the proposed expansion to Little Woodrow's Sports Bar and the effect it
would have on Basic Foods, the ability to continue the business is in jeopardy with a twenty
percent loss in revenue, a small business simply can't sustain this type of loss, sixteen
businesses operate in a two hundred and sixty parking space lot, this does not allow for all
businesses to be served properly, asked how can the Council come up with a decision to
allow Basic Foods and other businesses that are in the Colonnade to operate successfully,
safely and in a clean parking lot

Spoke on behalf of the nail shop that's located in the Colonnade regarding Little Woodrow's
Sports Bart and their expansion, stated that Little Woodrow's takes over 75 to 80% of the
parking, which is more than ten businesses around the Colonnade, in the mornings it's really
nice, there's parking for their patrons, that all changes when they open at 2:-00 p.m., since
the bar has opened it has changed everything, feels that it's not safe, there's broken glass
everywhere in the parking lot, often wonders who's responsible for picking up all the broken
glass, when she leaves work she sees a lot of cars that aren't driving safe, very worried
about her customers and the rest of the people that visit the other businesses around her,
her weekends were very busy but due to Little Woodrow's her business has slowed down

Stated that she was very happy when Basic Foods moved to Beaumont, prior to that she
would drive to Houston to get,her food, recently it's been hard to shop in the late evening due
to parking, she turned in the parking lot a few weeks ago and had to leave because there
was no where to park, something needSrto be done, hopefully Council will address this
problem quickly because she doesn'twant to drive to Houston to,shop if something happens
to the store
