MD (General Commercial- Multiple Family Dwelling) District located at 2590 CalderAvenue. Ms. Traci Tucker would like to open a beer and wine tasting room at 2590 Calder Avenue. This bar will offer a. low-key, comfortable environment. Hours of operation will be Wednesday and Thursday from 2 p.m. until 10' p.m., Fridays from 2 p.m. until midnight and Saturdays from noon until midnight and Sundays from noon until 6 p.m. The bar will be closed on Mondays and Tuesdays. All food served will be catered and served with disposable plates and cutlery. All necessary parking and utilities are currently available. Consider a request for a Specific Use Permit to allow an event center in a GC -MD -2 (General Commercial- Multiple Family Dwelling -2) District located at 3255 North Major Drive. Mr. Richard Faust of Faust Engineering and Surveying, Inc. is requesting a Specific Use Permit to allow an event center at 3255 North Major Drive. This property is under construction and received an S.U.P. in June of 2018 to allow a shopping center with uses restricted to restaurant, retail and professional office space. The owner is now requesting permission to develop 8,000 square feet of the building as an event center. The event center would be for rental only and intended events may include, but not limited to, business meetings, weddings and receptions. All food would be catered and alcohol will be permitted, but not sold on the premises. The property owner has no plans to provide security. Consider.a request to rename Cuniff Avenue to McKinley Avenue. McKinley Avenue Baptist Church has requested that CuniffAvenue be renamed to McKinley Avenue. Their current address is 775 Cuniff Avenue. The church is celebrating their 110th year anniversary and would like to include this name change as a way to memorialize the event. This historic church congregation began meeting in 1909 and in 1913, secured and began worshipping at the current location. Overthe years, the church has grown and prospered. As such; the church could be considered a part of the "religious heritage of the City." The Street Renaming Policy for the City of Beaumont states that a minimum of "seventy-five (75%) percent of the property owners with street addresses on that street must agree to the proposed change." The policy also states that "If City Council'determines by a % vote of approval that special circumstances surround a street name change request, then City Council may change the name of a street without approval of seventy-five (759'o') percent of the abutting property owners." There are nine (9) properties using CuniffAvenue addresses. Currently, the church obtained signatures from five (5), including the church, that are in agreement with the name change. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NIELD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 19-064 Minutes —September 30, 2019 4. Consider a resolution approving the write-off of uncollectible delinquent accounts. This request is in accordance with the write-off policy approved by City Council on December 21, 1999. The policy gives Council the final authority to write-off an individual account receivable identified as uncollectible when the balance due exceeds $1,000.00. Accounts included are for transactions prior to September 2018 which have been sent to the collection agency and collection efforts have been unsuccessful for more than one year. A summary by receivable type is shown below. Weed Abatement Charges - $97,750.41 Original charge dates range from 2014 to 2017 EMS Ambulance Charges - $1,253,287.40 These charges from ambulance transports include uninsured claims or co -pay and deductibles that the customer is responsible for. The original charge dates range from 2005 to 201.8 and accounts have been uncollectible for at least one year. Total to be written off - $1,351,037.81 If at any time an account becomes collectible after having been written off, the receivable shall be adjusted accordingly. The balance of the account shall be reinstated and payments shall be applied to that balance. Approval of the resolution. Mayor Pro Tem Pate moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES, AS AN INTERNAL ACCOUNTING PROCEDURE, THE WRITE-OFF OF THE FOLLOWING DELINQUENT ACCOUNTS TOTALING $1,351,037.81 FOR WHICH EACH INDIVIDUAL ACCOUNT EXCEEDS $1,000.00 AND THAT THESE DEBTS ARE NOT BEING EXTINGUISHED OR FORGIVEN AND IF, AT ANY TIME, AN ACCOUNT BECOMES COLLECTIBLE AFTER HAVING BEEN WRITTEN OFF, THE RECEIVABLE SHALL BE ADJUSTED ACCORDINGLY AND THE BALANCE OF THE ACCOUNT SHALL BE REINSTATED AND PAYMENTS SHALL BE APPLIED TO THAT BALANCE. Consider an ordinance allowing the parking and occupancy of Recreational Vehicles (RVs), manufactured and industrialized housing as temporary living quarters within residential districts, while the damage to their property caused by Tropical Storm Imelda is being repaired. Use of recreational Vehicles (RVs) and manufactured housing are prohibited by the Zoning Ordinance except in designated travel trailer and mobile home parks and subdivisions. However, an estimated 2,000 households in Beaumont have been affected by Tropical Minutes — September 30, 2019 Storm Imelda and many more in our region. While a disaster declaration has not yet been made, temporary housing will be necessary for those affected by the flooding while residents attempt to repair damaged homes. Therefore, it would be in the best interest of the residents to allow temporary housing for one year to residents who submit an application to the Planning & Community Development Department along with permit requests for repair to their home. Approval of the Ordinance. Councilmember Feldschau moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE ALLOWING A PERIOD OF ONE (1) YEAR FOR THE PARKING USE AND OCCUPANCY OF RECREATIONAL VEHICLES MANUFACTURED AND INDUSTRIALIZED HOUSING AS TEMPORARY LIVING QUARTERS ON RESIDENTIAL PROPERTY DURING THE PERIOD TO REPAIR OR RECONSTRUCTION OF DAMAGE TO PROPERTY CAUSED BY TROPICAL STORM IMELDA; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. Councilmember Neild seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM PATE, COUNCILMEMBERS NEILD, GETZ, FELDSCHAU, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Ordinance 19-065 WORK SESSION Review and discuss a proposed Sewer Line Replacement Program for privately owned sewer lines utilizing Community Development Block Grant Funds Chris Boone, Director of Planning and Community Development reviewed and discussed a proposed sewer line replacement program for privately owned sewer lines utilizing Community Development Block Grant Funds. Mr. Boone stated that the City regularly receives calls from citizens having issues with their plumbing properly draining into to the City's sanitary sewer system. When the system's failure is within the owner's property, the City is not able to offer help. As repairs can be very expensive, it is not uncommon for problems to persist. In an effort to address this issue, City Council approved a line item in the 2019 CDBG Action Plan in the amount of $500,000 that can be used for such repairs for low -to - moderate income households. The proposed Sewer Line Replacement Program Guidelines are enclosed outlining the Program. It should be noted that the Guidelines are for low -to -moderate income households, with a senior and/or disability priority. With regard to how the Program will work, the City's Water & Sewer Maintenance Division will provide a work write-up and refer the homeowner to the Planning & Community Development Department to review' income and other factors to determine eligibility in the Program. The City will then procure bids for the work and the contractor will begin work once contracts between all parties (including the homeowner) have been executed. Permits and inspections will be required. It should be noted that this will not be a quick process, rather an alternative to the repairs not being done. Beaumont TX Stated that he wasn't present at the last meeting but did view it on the city access channel, the information provided by the gentleman that gave the report regarding the storm and what the city was supposed to have done to help prevent some of the disasters that took place in this city wasn't totally true, it was stated that there were boots on the ground prior to rescue operations within the city, that wasn't true, stated that he drove in the high waters on 11th St., Calder etc., and saw stranded vehicles everywhere, what he saw were citizens helping rescue citizens that were stranded for two and three hours, 911 was shut down, no one could get through, people were stranded for three to four hours under the bridges with no help, asked that honesty be given to the citizens in regards to what was being done, also there was a statement that was made in the report that all over- passes have pumps and that the pumps weren't all operational and that was the main reason why the flooding occurred, asked that Council get down to business and get the pumps fixed underneath the over passes so the same thing that occurred before will not happen again and for ,Council to do their jobs and if they can't he will circulate a petition that some of them be removed from office Harold Haynes 5405 Seale Rd. Beaumont TX Stated that he would like to be known as a person for what he's for rather than what he's against, by saying that he's for anything that moves the city forward, he was told that you learn from your mistakes so you don't repeat them, his questions would be, do you go forward by going backward, stated that forty-seven years ago the City of Beaumont removed one of the most horrendous traffic menagerie there ever was, it is now being called a roundabout, back then it was a traffic circle, there were wrecks galore with that traffic circle, it just didn't work Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER NEILD - ASKED THAT COUNCIL LOOK AT ROUTINE MEETINGS THAT COULD OCCUR IN THE EVENINGS ON A ROUTINE BASIS, HAS HEARD FROM SEVERAL PEOPLE IN THE COMMUNITY THAT WOULD LIKE TO SEE THIS HAPPEN, DISCUSSED CHARTER AMENDMENT, WOULD LIKE TO SEE IF THERE COULD BE A WORKSESSON WITHIN THE NEXT FEW WEEKS, COMMENTED ON THE FLOODING THAT TOOK PLACE IN THE CITY A FEW WEEKS AGO, ASKED IF IT WAS POSSIBLE FOR THE COUNCIL TO HAVE A WORKSESSION WITH DRAINAGE DISTRICT 6 AND JEFFERSON COUNTY, DOESN'T THINK THAT ONE PERSON IS TOTALLY. RESPONSIBLE FOR ALL THE FLOODING BUT COLLECTIVELY ALL PLAYERS INVOLVED CAN MAKE A DIFFERENCE TO ALLEVIATE Minutes — September 30, 2019 FUTURE FLOODING, THINKS THAT IT'S TIME FOR THEM ALL TO SIT DOWN `TOGETHER AND WORK IT OUT AND SEE IF THERE'S SOMETHING THAT THEY CAN DO TO BETTER SERVE THE CITIZENS IN THIS AREA COUNCILMEMBER GETZ - STATED THAT HE WOULD ALSO SUPPORT EVENING MEETINGS, HAS REQUESTED THIS FOR A LONG TIME, DOESN'T MATTER IF THEY ARE DONE AT CITY HALL OR IN EACH WARD, AT THE MINIMUM THEY SHOULD HAVE ONE EVENING MEETING PER QUARTER, APPRECIATED COUNCILMEMBER NEILD'S COMMENTS TO HAVE A JOINT. MEETING WITH DRAINAGE DISTRICT 6, THINKS THAT THERE NEEDS TO BE AN ASSESSMENT MADE OF THE STORM WATER DRAINAGE PROGRAM, THERE'S A LOT OF CONFUSION IN THE COMMUNITY AS TO WHAT DRAINAGE DISTRICT 6 RESPONSIBILITIES ARE AND WHAT THE CITY'S RESPONSIBILITIES ARE WHO MAINTAINS WHAT DITCH HOW THAT'S SUPPOSED TO BE MAINTAINED, THINKS IT WILL BE HELPFUL IF A WORKSESSION IS DONE TO CLARIFY THE DIFFERENT RESPONSIBILITIES AS WELL AS AN OVERALL ASSESSMENT OF WHAT THE COUNTIES DRAINAGE CAPACITIES ARE, UNDERSTANDS THAT THIS WAS A TERRIBLE RAIN EVENT BUT MAYBE THIS IS THE NEW NORMAL WITH THIS BEING TWICE IN TWO YEARS COUNCILMEMBER FELDSCHAU - STATED THAT EARLIER TODAY HE WAS PRIVILEGED TO BE AT THE ELEGANTE' HOTEL WHERE THE ELEGANTE' AND THEIR PARENT COMPANY RELEASED $100,000.00 INTO THE COMMUNITY FOR FLOOD RELIEF, MAYOR AMES WAS INSTRUMENTAL IN MAKING THAT HAPPEN AND CONNECTING THAT HOTEL TO THE ORGANIZATIONS, THANKED THE HOTEL AND THE MAYOR, APPEALED TO THE CITIZENS THAT ARE IN ATTENDANCE AT THE MEETING AS WELL AS THOSE THAT WILL VIEW THIS ON THE CITY ACCESS CHANNEL THAT THERE IS A DESPERATE NEED FOR VOLUNTEERS, THERE IS A DESPERATE NEED FOR BUSINESS MEN AND WOMEN TO STEP. OVEAL WALKER WHO HAD GOTTEN WITH COUNTY COMMISSIONER BO ALFRED AND WAS PROPOSING TO HAVE A COMMUNITY MEETING TO BRING ABOUT A BETTER UNDERSTANDING AND THE WORKINGS OF STORM PREPARATIONS AS IT'S IMPACTED BY THE STATEWIDE DRAINAGE, IN ORDER TO UNDERSTAND WHAT HAPPENS ON THE STREETS OF BEAUMONT THERE HAS TO BE AN UNDERSTANDING OF WHAT HAPPENS WITH WATER UP STATE, HOW IT GETS TO THE GULF AND HOW THE WATER GETS FROM OUR STREETS INTO THE DRAINAGE DITCHES WHICH MEANS THERE HAS TO BE AN UNDERSTANDING OF INTERGOVERNMENTAL RELATIONS BETWEEN DRAINAGE DISTRICT 6, THE STATE OF TEXAS AS WELL AS THE CITY OF BEAUMONT, ALL OF THESE ENTITIES PUT TOGETHER AN INTRICATE SYSTEM THAT IS DESIGNED TO GET WATER OFF OF PROPERTY, STREETS AND INTO RIVERS AND LAKES, COINCIDENTALLY THAT'S WHAT HAS BEEN MENTIONED HERE ON TODAY, COMMENTED ON NIGHT MEETINGS, STATED THAT HE HAPPENED TO BE ONE THAT HAS BEEN AROUND WHEN THEY DID HAVE NIGHT MEETINGS, HAS ALWAYS BEEN A PROPONENT OF HAVING NIGHT MEETINGS AND STILL IS, HOWEVER THERE WAS AN EXPERIENCE OF LESS TURNOUT BUT EVEN WITH THAT IT'S AN OPPORTUNITY TO MOVE FORWARD, COUNCIL COULD Minutes — September 30, 2019 USE THESE EVENING MEETINGS PARTICULARLY FOR INSTRUCTIONAL PURPOSES TO LET CITIZENS KNOW HOW THE CITY PREPARES FOR STORMS, STORM PREPARATION, RESPONSES AND RESTORATION, ALL OF THOSE GO TOGETHER, AND ALSO HAVE THE DRAINAGE DISTRICT, JEFFERSON COUNTY, CORE OF ENGINEERS, ALL OF THOSE THAT ARE DEALING WITH MOVING WATER FROM THE STREETS AND THE AREAS OF THE COUNTY AND OF THE STATE, AS WELL AS SOMEONE FROM THE NATIONAL WEATHER SERVICE IF POSSIBLE TO ATTEND THE MEETING WITH INFORMATION FOR THE CITIZENS COUNCILMEMBER MOUTON - STATED THAT LAST YEAR SHE HAD TWO NIGHT MEETINGS IN HER WARD, HAD MORE STAFF THAN SHE DID CONSTITUENTS, HER CONSTITUENTS REQUESTED THE NIGHT MEETING AND A HANDFUL SHOWED UP, SHE IS A PROPONENT FOR AN EVENING MEETING AND IS IN AGREEMENT WITH COUNCILMEMBER SAMUEL THAT IT NEEDS TO BE MORE THAN A GENERAL BUSINESS MEETING BUT MORE OF AN INFORMATIONAL MEETING, COMMENTED ON THE FOUR HOMICIDES THAT OCCURRED IN HER WARD, GAVE CONDOLENCES TO ALL FOUR FAMILIES, ALSO COMMENTED ON THE LARGE LETTERS OF BEAUMONT SPELLED OUT AT THE BEN ROGERS CONVENTION CENTER, ANNOUNCED THAT ON SATURDAY, OCTOBER 5, 2019, HARVEST FOR LOST SOULS WILL HAVE A COMMUNITY WIDE CLEANUP CALLED "HOPE AFTER IMELDA" STARTING AT 9:00 A.M. TO 12:00 P.M., VOLUNTEERS ARE NEEDED, THEY WILL BE GOING OUT TO CLEAN UP HOUSES, THEY WILL BE GIVING OUT RECOVERY BUCKETS, MATTHEW 25 ALIVE MINISTRIES, DAUGHTERS OF HOPE, EXXONMOBIL, LAMAR UNIVERSITY AND SOUTH EAST TEXAS FOOD BANK WILL BE DISTRIBUTING FOOD, ALSO ANNOUNCED ON SATURDAY, OCTOBER 5, 2019, THE GIFT OF LIFE JULIE RICHARDSON PROCTOR 5K RIBBON RUN/COLOR RUSH, AS WELL AS THE FIRE PREVENTION AND FAMILY SAFETY FESTIVAL, THANKED ALL OF CITY STAFF AND VOLUNTEERS FOR WHAT THEY DID DURING THE STORM CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - IN REGARDS TO UPDATING THE CITY CHARTER, HE AND THE CITY ATTORNEY HAS HAD A DISCUSSION, SUGGESTED THE BEST WAY TO UPDATE THE CHARTER WOULD BE TO DO INHOUSE, HE AND THE CITY ATTORNEY KNOW THE CHARTER WELL THEY WORK WITH IT EVERY DAY, STATED THAT ALONG WITH STAFF THEY WOULD TAKE CHAPTER BY CHAPTER, DRAW A LINE THROUGH WHAT SHOULD COME OUT AND HIGHLIGHT WHAT SHOULD BE INCLUDED WITH THE CORRECT LANGUAGE, THEY WOULD PROVIDE THE UPDATES TO COUNCIL IN.
