The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on September 10, 2019, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the

Mayor Ames called the council meeting to order at 1:30 p.m.
Father Anthony Clark with St. Mark's Episcopal Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Pate, Councilmembers Nield, Getz,
Feldschau, Samuel and Mouton. Also present were Kyle Hayes; City Manager; Tyrone Cooper, City

Commented on the City Council approving the Consent agenda along with the Council
meeting minutes, stated that he has noticed recently in the minutes it stated facts by City
staff regarding a certain business man, wanted to remind Council that facts don't always
equate to truth

GENERAL BUSINESS
1. Consider amending Section 20.03.004 of the Code of Ordinances related to Speed
Regulations and School Zones.
Recently staff received a request from All Saints Episcopal School to add a school zone for
their middle school. A zone is already established on Delaware that is in use for their
elementary students. The middle school students are picked up and dropped off on French
Road which is not included within that zone. After review, staff recommends an additional
zone be set up on French Road that will address the middle school with the same times as
the school zone on Delaware..

Also, after reviewing the Sallie Curtis Elementary school zone, staff noticed that the
description for the part of the school zone beginning on Westgate was incorrect. The
changed description reflects the true location of the beginning of the school zone on
Westgate for Sallie Curtis Elementary.
Approval of the ordinance changes.
Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING
CHAPTER 20, SECTION 20.03.004 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS BY
CHANGING AND AMENDING SCHOOL ZONE TIMES FOR ALL SAINTS EPISCOPAL AND BY CHANGING AND
AMENDING SCHOOL ZONE BOUNDARIES FOR SALLIE CURTIS ELEMENTARY SCHOOL BEGINNING ON
WESTGATE DRIVE; PROVIDING FOR SEVERABILITY; PROVIDING FORREPEAL; AND PROVIDING FOR
PENALTY. Councilmember Neild seconded the motion.

Ordinance 19-053
2. Consider allowing ninety (90) day extensions for the parking, use and occupancy of
Manufactured Housing Units (MHUs) and Recreational Vehicles (RVs) as temporary living
quarters on six residential properties damaged by Hurricane Harvey in accordance with
Ordinance 19-011.
In September, 2017, as a response to more than 2,000 households affected by Hurricane
Harvey, Council approved an ordinance to allow for the use of Recreational Vehicles (RVs)
and, Manufactured Housing Units (MHUs) on residential property a period of one (1) year,
with an additional six (6) month extension approved in September, 2018. In March, 2019
Ordinance 19-011 was approved granting an additional six (6) month extension, with the
option for residents to apply for a ninety (90) day extension if the home is still under
construction, the resident is in litigation with their insurance company or if they have applied
for and are awaiting CDBG disaster recovery assistance.
As we now approach the September 19 deadline, the vast majority of RVs and MHUs have
been removed by the General Land Office. Applicants at the following addresses have
applied for a ninety (90) day extension as allowed for under Ordinance 19-011.

Based on the applications submitted, the Administration is recommending extensions for

Approval of the Ordinance
Councilmember Mouton moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING
ORDINANCE NO. 19-011 BY ALLOWING FOR A NINETY (90) DAY EXTENSION FOR THE PARKING USE
AND OCCUPANCY OF RECREATIONAL VEHICLES, MANUFACTURED AND INDUSTRIALIZED HOUSING AS
TEMPORARY LIVING QUARTERS ON RESIDENTIAL PROPERTY DURING THE PERIOD OF REPAIR OR
RECONSTRUCTION OF DAMAGE TO PROPERTY CAUSED BY HURRICANE/TS HARVEY; ALLOWING FORAN
OPTION TO REQUEST AN ADDITIONAL NINETY (90) DAY EXTENSION; PROVIDING FOR SEVERABILITY;
PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Councilmember Feldschau seconded the
motion.

Ordinance 19-054
3. Consider approving a contract with K & F Demolition, Inc. of Houston for the asbestos
abatement and demolition of two structures located at 770 and 780 South 4th Street.
The Best Years Center located at 780 South 4th Street has been replaced with the Lakeside
Center. This older structure is approximately sixty-nine (69) years old and has been
experiencing several foundation failures, roof leaks, and is in need of major renovations
including asbestos abatement. It is no longer feasible to invest money into this aging facility.
The Police Activity League Building located at 770 South 4th Street has not been occupied
for approximately six years and is experiencing roof structure failure. Due to the structural
issues with the two facilities, the demolition of both buildings is recommended by City staff.
The land that the two structures occupy will be added into the Central Park green space.
The parking lot located on the North side of the Best Years Center will remain in order to
service the existing tennis courts.
Bids were requested for the asbestos abatement and demolition of the two structures.
Twelve vendors were notified; -and five bids were submitted. K & F Demolition, Inc. provided
the low qualified bid in the total amount of $173,466.00.
Funds will come from the Capital Reserve Fund.
Approval of the resolution.
Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY K&F
DEMOLITION, INC., OF HOUSTON, TEXAS, FOR THE ASBESTOS ABATEMENT AND DEMOLITION OF TWO
STRUCTURES LOCATED AT 770 AND 780 SOUTH 4T" STREET, IN THE AMOUNT OF $173,466.00, BE
ACCEPTED BY THE CITY OF BEAUMONT AND THAT THE CITY MANAGER BE AND HE IS HEREBY
AUTHORIZED TO EXECUTE A CONTRACT WITH K&F DEMOLITION, INC., OF HOUSTON, TEXAS.

WORK SESSIONS
Review information related to the Water Utilities Fund and receive and give an update
on sewer work in progress that's planned citywide
Kyle Hayes, City Manager reviewed information related to the Water Utilities Fund. Mr.
Hayes discussed the revenues, expenditures and fund balances for FY's 2013, 2015, 2017,
2019 and 2020. It was stated that the last increase to the Water/Sewer rates was in October
of 2016. The City issued $21 million in Water Revenue Bonds in May of 2017 and there has
been approximately $6.9 million remaining out of the $21 million at this time. There is a plan
to issue,$20 million in Water Revenue Bonds in early 2020.
Back in March of this year, the Administration discussed a plan with the City Council to utilize
$3 million out of the Fund Balance and the Water Fund for the following projects:
Manhole Rehabilitation City wide - $600,000
Cleaning and Televising City wide - $400,000
Pipe Bursting City wide - $2,000,000
There was also discussion of the Tyrrell Park Golf Course which was constructed in the late
1930's. The course was contracted out at one time and has been managed by the City of
Beaumont since 2004. The Golf Course has four full-time employees, (Director of Golf, Golf
Course Superintendent; Pro Shop Manager and a Crew Leader). There are.up to fifteen (15)
part-time employees, this is depending on the time of year and includes labor positions and
pro shop assistants. There was also discussion of yearly transfers to the Golf Course fund,
listed below are the following years and transfer amounts.
Year 2010 — Transfer amount $ 70,000
Year 2012 — Transfer amount'$200,000
Year 2014 — Transfer amount $100,000
Year 2016 — Transfer amount $150,000
Year 2018 — Transfer amount $300,000
Year 2019 — Transfer amount $400,000 (Stabilizing the fund for FY 2020)

Review and discuss the operations of the Tyrrell Park Golf Course
City Manager, Kyle Hayes discussed the Water Fund/Solid Waste Fund. There was
discussion regarding the roughly 35 parks that the City manages, the Sterling Pruitt
Activity Center at Magnolia Park, Lakeside Center, two Hike and Bike Trails, Tennis
Center at the Athletic Complex, two swimming pools and the Henry Homberg Golf
Course.

Spoke to Council regarding the same issue that he spoke on several weeks ago and that is -
the two homes that are being built on both sides of his home, he has gotten some help from
one of the Councilmembers-At-Large, hasn't gotten much of a response from the Planning
Department or the Engineering Department, has been told by the Planning Department that
they have issued a stop work order, evidently that hasn't happened, at this point not sure
what's the status, stated he just needs a better understanding so he will know how to
proceed, his property is being damaged when it rains and would like the City to adhere to the
code and have the contractor do the same
Marco Hernandez 2556 Angelina Beaumont TX
Thanked Council for all that they do, stated that he's speaking on behalf of the family of
Jessie Rodriguez, Jessie was a special young man, a great friend, a wonderful son and
brother who was loved and was a respected member of the soccer community, Jessie was
killed after leaving Cici's Pizza on August 17, 2019, stated that they would like to
commemorate his life in spirit by naming the 4t" St. Soccer Court in his name, in addition
there are other upgrades they would like to make to the court and would like to assist the
City by providing the funds through a tournament held at the court in Jessie's honor, they
would like to continue to do all they can to uplift the City and bring people together for a
positive purpose and positive outcome, thanked Council for their sincere consideration and
hopes to move forward with this plan
Landry Rountree 1565 S. Major Beaumont TX
Stated to Mr. Cooper, City Attorney that he wasn't at the last meeting but was quoted as
saying that he heard that Mr. Cooper had directed the 390 tickets that he received in 2015, in
the amount of over $145,000, if that's incorrect hopes that Mr. Cooper will correct that on
today, wanted to talk about how someone can be silenced but not at the podium, stated that
he received 390 tickets, was arrested by former Sgt. Troy Dyson, that lead to him filing a civil
rights lawsuit against the City of Beaumont in 2016, discussed the court that it went to as
well as a calendar that the court instructed to be done for court dates, discussed an issue
that occurred between him and Sharae Reed, 1St Assistant City Attorney, he stated that what
Ms. Reed did was gross incompetence and at best a lack of integrity

Stated that his purpose for his visit on today is to try and build a bridge between Beaumont
Independent School District and.the City of Beaumont, he's now the President of the BISD
Board of Trustees, doesn't know what transpired over the last couple of years but thinks that
he's the first President of the BISD Board to ever come before Council to extend a bridge,
the City has approximately 17,800 little citizens that are a part of BISD, the school district
has a model that says preparing the next generation/preparing them for the future and
beyond, asked that if Council can think of anything that they can do or he can do better to
please let him know
Maissa Salibi 2495 Whisper Wind Dr. Beaumont TX
Stated that she is currently a student at Lamar University, expressed one of her many
concerns regarding safety here in Beaumont, 12Newsnow put out a report two years ago
and in the report there was a study done by a Houston Law Firm listing the most dangerous
City's in Texas, Beaumont came in third with a population of 117,000, Houston came in
fourth with a population of 2 million, Dallas came in tenth with a population of a million,
these Cities are much larger than Beaumont but Beaumont still managed to beat those City's
out on a scale of how dangerous the Cities are, asked the Council what they could do to
improve the safety of the residents and constituents in this City

Stated that he's pleased to see that the City is trying to get the Loeb Water Plant up and
running in Hardin County, commented on the Capital Works Projects, some of the projects
are necessary, some are missing and some are dreams, discussed the missing projects,
commented on the Laurel St. project thinks that Council should look at this one, the part that
hasn't been replaced needs to be done, also stated that the most important projects are 4th
St., Pointe Parkway North as well as extending Dowlen Rd. to Walden Rd., ask that Council
focus on what can bring more revenue, disappointed that the sidewalks weren't finished on
Dowlen Rd., particularly in front of the apartments near Phelan, the sidewalks need to go up
to Marshall Middle School, sees citizens and kids walking in the grass and in the street

Stated that he was present when Jessie Rodriguez lost his life, it radically changed the way
that he sees people and things in this city, he saw a loving family witness the loss of their
loved one, thinks Beaumont is the 25th most dangerous city in the nation, that's no small
accomplishment, there's real reason for it and thinks it can be changed, begged Council to
take it upon their shoulders to do something about it, also stated that what happened to Mr.
Rountree was shameful and for someone in the city Attorney's office to defend it last week
like they did was more shameful, Mr. Roundtree has fourteen children, was put out of
business for two years, even saw him go on food stamps, he stands up here in Council
honorably and he lives his life that way, prays that nothing like that ever happens to another
citizen, also made comments regarding his construction board of appeals hearing

Mayor Ames read the announcement regarding Executive Session being held at the
conclusion of the General Business portion of the meeting.
COUNCILMEMBER COMMENTS
COUNCILMEMBER NEILD - THANKED MR. SIGEE FOR ATTENDING THE MEETING AND
REACHING OUT TO COUNCIL TO TRY AND HELP BUILD A BRIDGE
BETWEEN THE CITY OF BEAUMONT AND BISD THAT HAS BEEN
MISSING FOR SOME YEARS IN HIS PERSONAL OPINION, STATED
THAT RIGHT AFTER HE GOT ELECTED ONE OF THE THINGS THAT
HE BROUGHT TO COUNCIL WAS SEEING WHAT THEY CAN DO TO
REVAMP THE CITY CHARTER, UNDERSTANDS THAT THE LAST
SEVERAL MONTHS EVERYONE HAS BEEN WORKING HARD ON
THE BUDGET AND THAT HAS TAKEN MOST OF COUNCIL'S TIME,
NEXT WEEK COUNCIL WILL BE DONE WITH THE BUDGET SO HE
WOULD LIKE•TO SEE COUNCIL CONSIDER MOVING REVAMPING
THE CHARTER UP ON THE ACTION ITEMS AND START WORKING
HAVING WORKSHOPS ON REVAMPING, ONE OF THE THINGS IN
THE CHARTER THIS WEEK THAT HE WOULD SPECIFICALLY LIKE
TO BRING UP IS REGARDING THE CAPITAL PLAN, THE WAY THE
CHARTER READS IS THAT THE CAPITAL PLAN IS FOR A FIVE
YEAR PERIOD OF PROJECTS, AND IN THAT CAPITAL PLAN IT'S
SUPPOSED TO GIVE COUNCIL WAYS AND MEANS TO FINANCE
AND WHAT THE EXACT REASON IS FOR THAT, STATED THAT ON
LAST WEEK COUNCIL BEAT A DEAD HORSE ABOUT WHAT
NEEDS TO BE IN THE CAPITAL PLAN AND WHAT SHOULDN'T BE
IN IT, HE'S NOT INTERESTED IN HAVING THAT ARGUMENT WITH
ANYBODY BECAUSE HE TRULY BELIEVES THAT EVERYBODY HAS
THE RIGHT TO HAVE SOMETHING IN THE CAPITAL PLAN THAT
THEY ARE PASSIONATE ABOUT, HE WOULD JUST LIKE TO SEE
MORE DETAILS IN THE PLAN MOVING FORWARD AS TO WHAT
THE MEANS AND METHODS ARE FOR FINANCING SOMETHING
ALONG WITH THE HOW AND WHY
COUNCILMEMBER GETZ - THANKED MR. MARSHBURN FOR COMING FORWARD AND
SPEAKING ON THE NEED TO MOVE FORWARD WITH THE
DOWLEN RD. EXTENSION, STATED THAT THIS IS A PROJECT
THAT HAS BEEN IN THE CAPITAL PLAN WELL BEFORE HE GOT
ON COUNCIL, THE CITY MANAGER IS ON RECORD SAYING THAT
IF THE CITY WAS A BUSINESS THIS WOULD HAVE BEEN DONE
BECAUSE IT'S A GREAT PROJECT, BELIEVES THAT THE TIME
HAS COME TO AT LEAST START ON THAT PROJECT AND THE
START CAN BE THE CONSTRUCTION OF SEVEN TENTHS OF A
MILE OF ROADWAY EXTENDING FROM COLLEGE ST. OUT TO
WASHINGTON BLVD., THIS WOULD OPEN UP A LOT OF
UNDEVELOPED LAND, THINKS THIS IS SOMETHING THAT THE
CITY AS WELL AS COUNCIL REALLY NEEDS TO LOOK AT,
THINKS IT'S AFFORDABLE, THIS WILL BRING A LOT OF LAND IN

CITY ATTORNEY COOPER - STATED THAT HE WASN'T PRESENT AT THE LAST MEETING
WHEN MS. REED MADE WHATEVER COMMENTS THAT WERE
MADE REGARDING MR. ROUNTREE, THE COMMENT THAT WAS

LICENSE, THIS WAS APPEALED TO THE CITY COUNCIL AND THE
COUNCIL UPHELD THE DECISION OF THE POLICE CHIEF THAT
HIS OPERATION BE SUSPENDED FROM THE NON -CONSENT TOW
LIST, WHILE MR. ROUNTREE WAS SUSPENDED FROM THAT TOW
LIST OPERATION HE ARRIVED UPON THE SCENE OF AN
ACCIDENT ON THE INTERSTATE, HE WAS ASKED ON SEVERAL
OCCASIONS TO LEAVE THE SCENE WHICH HE DID NOT, THE
OFFICER THAT INSTIGATED HIS ARREST FOR NOT LEAVING
WHEN HE WAS ASKED TO LEAVE GOT SUED BY MR. ROUNTREE
TOGETHER WITH THE CITY, IT WAS IN THAT LAW SUIT THAT
JUDGE MAGISTRATE GIBBLIN DISMISSED THE LAW SUITAS NOT
HAVING ENOUGH BASIS AND LAW TO GO FORWARD, MR.
ROUNTREE APPEALED THAT DECISION TO THE FIFTH CIRCUIT
COURT OF APPEALS WHO AGREED WITH MAGISTRATE GIBBLIN,
THE SUPREME COURT ALSO AGREED WITH MAGISTRATE
GIBBLIN, SO HIS LAW SUIT HAS CONCLUDED AND IS DISPOSED
OF, IT'S THE END OF IT, WE ALL SHOULD JUST MOVE ON, MR.
COOPER STATED THAT MR. ROUNTREE COMES TO THE
MEETINGS HE ATTACKS THE INTEGRITY AND PROFESSIONALISM
OF HIMSELF AS WELL AS MS. REED, AGAIN EVERYONE SHOULD

STATED THAT SHE WILL ATTEND AND HOPES THAT THE
COUNCIL WILL JOIN HER, HIS FRIEND JESSIE WAS ONE OF THE
YOUNG MEN THAT WAS INVOLVED IN GETTING THE SOCCER
COURT, SHE WOULD BE IN SUPPORT OF PUTTING A PLAQUE AT
THE PARK IN HIS REMEMBRANCE IF THE REST OF THE COUNCIL
AGREES, WITH THAT OR AT LEAST FOUR OF THE COUNCIL
