Vice-Chairman Mason seconded the motion. Motion to approve the minutes carried 8:0. REGULAR MEETING 1) Preliminary Plat of Fairfield, Phase VI: Request for approval of the Preliminary Plat of Fairfield, Phase VI, Beaumont, Jefferson County, Texas. Applicant: Arceneaux, Wilson & Cole Location: South of Claybourn Drive, east of Abby Lane Mr. Boone presented the staff report. Arceneaux, Wilson & Cole has requested Preliminary Plat approval of Fairfield, Phase VI. The development is located at the east end of Claybourn Drive from Major Drive. The 5.9545 acre development is a twenty-two (22) residential lot subdivision in an R-S (Residential Single-Family Dwelling) District. The proposed Lily Lane will have a 50 foot right-of-way and 27 foot pavement width. All lots will access Major Drive via the existing Claybourn Drive. Water and sewer will be provided by extension of City utilities. Slides were shown of the subject property. The item was sent to all interested parties. Staff recommended approval of the request. The applicant was present. Joe Pattie representing Arceneaux, Wilson & Cole, 2901 Turtle Creek Drive, Port Arthur, Texas addressed the Commission. No questions for Mr. Pattie. Alt. Commissioner Pate made a motion to approve the request for the Preliminary Plat of Fairfield, Phase VI. Commissioner Little seconded the motion. Motion to approve carried 8:0. 2) Preliminary Plat of West Chase Village, Section Ten, Phase V: Request for renewed approval of the Preliminary Plat of West Chase Village, Section Ten, Phase 5, Beaumont, Jefferson County, Texas. Applicant: Fittz & Shipman, Inc. Location: The extension of Village Court Mr. Boone presented the staff report. Fittz & Shipman, Inc. has requested preliminary Plat approval of West Chase Village, Section 10, Phase V. The property is located east of Major Drive, at the east end of Village Drive. The development is a 2.595 acre, seven (7) lot, single-family residential subdivision. All lots will access Village Court and right-of-way and pavement meets City Ordinance width requirements. Water and sanitary sewer will be provided by the City of Beaumont. Slides were shown of the subject property. The item was sent to all interested parties. The Planning staff recommended approval of the request. The applicant was present. Ben Tristan representing Fittz & Shipman, Inc., 1405 Cornerstone Court, addressed the Commission. 2 Planning and Zoning July 15, 2019 No questions or comments for Mr. Tristan. Commissioner Steinhagen made a motion to approve the request for the Preliminary Plat approval of West Chase Village, Section 10, Phase V. Commissioner Senigaur seconded the motion. Motion to approve carried 7:0:1 (Little abstained). 3) Replat-Tyrrell Park, Unit “D”, Lot 58: Request for approval of a Replat of Lot 58 into Lots 58A and 58B, Unit “D”, Tyrrell Park Addition, Beaumont, Jefferson County, Texas. Applicant: Access Surveyors Location: 6187 and 6191 F.M. Highway 124 Mr. Boone presented the staff report. Access Surveyors has requested approval of a Replat of Lot 58, Unit D, into Lots 58A & 58B, in the Tyrrell Park Addition, Beaumont, Jefferson County, Texas. The location of the subject property is 6187 FM Highway 124 and 6191 FM Highway 124 (Fannett Road). Slides were shown of the subject property. Three (3) property owner notices were mailed to property owners within 200 feet of the subject property. None were received in favor or in opposition. The Planning staff recommended approval of the request. The applicant was not present. No questions or comments for Mr. Boone. Vice-Chairman Mason made a motion to approve the request of a Replat of Lot 58, Unit D, Tyrrell Park Addition. Commissioner Colbert seconded the motion. Motion to approve carried 8:0. 4) Replat-Tyrrell Park, Unit “C”, Lots 16 & 17: Request for approval of a Replat of the south ½ of Lot 16 and all of Lot 17 into Lots 16A, 16B, 17A and 17B, Unit “C”, Tyrrell Park Addition, Beaumont, Jefferson County, Texas. Applicant: Mark W. Whiteley & Associates, Inc. Location: 5520 Seale Road and 5485, 5505 and 5515 Phelps Road Mr. Boone presented the staff report. Mark W. Whiteley & Associates, Inc. has requested approval of a Replat of the south ½ of Lot 16 and Lot 17, into Lots 16A, 16B, 17A & 17B, “Unit C,” in the Tyrrell Park Addition, Beaumont, Jefferson County, Texas. The intention for the division of this piece of land is to create more lots for single-family homes. The location of the subject property is 5485, 5505 and 5515 Phelps Road and 5520 Seale Road. Slides of the subject property were shown. Twenty-one (21) notices were mailed to property owners within 200 feet of the subject property. None were received in favor and none were received in opposition. The Planning staff recommended approval of the request. No questions or comments for Mr. Boone. The applicant was present. Tom Rowe representing Mark Whiteley & Associates, Inc., 3250 Eastex Freeway, addressed the Commission. Mr. Rowe stated that the property used to be Tyrrell Park Elementary. The school was demolished and BISD sold the vacant lot. No questions or comments for Mr. Rowe. The public hearing opened and closed. Commissioner Senigaur made a motion to approve the 3 Planning and Zoning July 15, 2019 request for a Replat of the south ½ of Lot 16 and all of Lots 17 into Lots 16A, 16B, 17A & 17B, Unit “C” Tyrrell Park Addition. Alt. Commissioner Pate seconded the motion. Motion to approve carried 8:0. 5) Replat-South End, Block 4, Lots 1-3: Request for approval of a Replat Lots 1-3 into Lots 1A & 2A, Block 4, South End Addition, Beaumont, Jefferson County, Texas. Applicant: Mark W. Whiteley & Associates, Inc. Location: 120 & 140 E. Chapin Street Mr. Boone presented the staff report. Mark W. Whiteley & Associates, Inc. has requested approval of a Replat of Lots 1, 2 and 3 into Lots 1A and 2A, Block 4, in the South End Addition, Beaumont, Jefferson County, Texas. The division of the land is intended to develop a duplex on each new lot. The property is currently zoned as R-S (Residential-Single Family Dwelling) District. The applicant has been informed that in order to develop duplexes on this property, a Specific Use Permit will be required. The location of the subject property is 120 and 140 E. Chapin Street. Slides were shown of the subject property. The item was mailed to eighteen (18) property owners within 200 feet of the subject property. There were no responses received in favor or in opposition. Planning staff recommended approval of the request. Tom Rowe, representing Mark Whiteley & Associates stated that he had no comments and Mr. Boone explained everything. The public hearing opened and closed. Vice-Chairman Mason made a motion to approve the Replat for South End Addition, Block 4, Lots 1-3. Commissioner Little seconded the motion. Motion to approve carried 8:0. 6) Replat-Calder Terrace, Lots 67-68: Request for approval of a Lot 68 and the north ½ Lot 67, Calder Terrace Addition, Beaumont, Jefferson County, Texas, to change the exterior side yard setback line. Applicant: Faust Engineering & Surveying, Inc. Location: 296 Ridgeland Avenue Mr. Boone presented the staff report. Richard Faust of Faust Engineering, has requested approval of a Replat of Lot 68 and the north ½ of Lot 67, Calder Terrace Addition, Beaumont, Jefferson County, Texas. The location of the subject property is 296 Ridgeland Avenue. The purpose of the replat is to change the exterior side yard setback requirement from twenty-five (25) feet to ten (10) feet. City of Beaumont Zoning Ordinance requires a minimum ten (10) foot exterior yard setback. Slides were shown of the subject property. The Planning staff recommended approval of the request. Eighteen (18) notices were mailed to property owners within 200 feet of the subject property. One response was received in favor and none were received in opposition. The applicant was present. Richard Faust, representing Faust Engineering & Surveying, 4 Planning and Zoning July 15, 2019 Inc., 5550 Eastex Freeway, Suite O, addressed the Commission. Mr. Faust stated that he had no comments but will answer any questions if needed to. Vice-Chairman Mason asked what is the purpose for moving the setback. Mr. Faust replied that the homeowner wanted to add a a carport. No other questions or comments for Mr. Faust. The public hearing opened and closed. Alt. Commissioner Pate made motion to approve the Replat of Calder Terrace Addition, Lots 67-68. Commissioner Little seconded the motion. Motion to approve carried 8:0. JOINT PUBLIC HEARINGS Mayor Ames called the Joint Public Hearings of July 15, 2019 to order and explained the purpose of the Joint Public Hearing process. Mayor Ames turned the meeting over to Chair- man Nejad to conduct the Joint Public Hearings. 1) File 2390-P: Request for a Specific Use Permit to allow a tequila bar in a GC-MD (General Commercial-Multiple Family Dwelling) District. Applicant: Ashley Hernandez Location: 4210 Calder, Suite A Mr. Boone presented the staff report. Ashley Hernandez has requested a Specific Use Permit To allow a new, “high-end Tequila Bar” at 4210 Calder Avenue. Mrs. Hernandez, along with her husband and grandfather, plan to teach the art of selection and enjoyment of premium and collector tequila in a small neighborhood establishment. Seating will accommodate up to thirty-six (36) customers. Hours of operation will be Tuesday through Thursday from 4 p.m. until midnight, Friday and Saturday, 4 p.m. until 2 a.m. and closed on Sunday and Monday. Mrs. Hernandez anticipates having nine (9) employees for the busiest shift. Slides were shown of the subject property. Staff recommended approval with the following condition: 1. Construction plans must meet all requirements by Water Utilities for water and sewer Services, including requirements of the City’s pre-treatment program. Fourteen (14) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor and one notice was received in opposition. Mr. Boone stated that Councilman Neild was unable to attend the meeting, but raised the question regarding concerns about adequate parking. Mr. Boone stated the concern was reviewed and it was concluded that parking is sufficient. Brandon Belaire representing the Engineering Department for the City was present. Commissioner Colbert asked if any homes were facing that particular portion of Lucas Street and was there any off-street parking. Mr. Boone replied there were a few homes in the cul-de-sac facing Lucas and that off-street parking is not necessary because the parking lot is sufficient. Mayor Ames questioned residential parking and commercial parking surrounding the business. The applicant was present. Ashley Hernandez, 710 W. Evangeline, addressed the Commission. A brief 5 Planning and Zoning July 15, 2019 discussion followed. Mrs. Hernandez stated that they plan on serving food that pairs well with tequila and other beverages will be served as well, including alcohol and soft drinks. The public hearing opened. Darlene Hanna, 4305 Calder, addressed the Commission. Ms. Hanna spoke against the request and stated she had concerns regarding parking. A brief discussion followed regarding parking. Mr. Belaire addressed the Commission. More discussion followed regarding parking. No other questions or comments. The public hearing closed. Commissioner Little made a motion to approve the request for a Specific Use Permit to allow a tequila bar in a GC-MD (General Commercial-Multiple Family Dwelling) District as requested for 2390-P. Commissioner Senigaur seconded the motion. Motion to approve carried 7:0:1(Nejad abstained) OTHER BUSINESS None. THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:41 P.M. 6
