HomeMy WebLinkAbout7-11-19 BAminutes * M I N U T E S * BOARD OF ADJUSTMENT July 11, 2019 City Hall, 801 Main Street A Meeting of the Board of Adjustment was held on July 11, 2019 and called to order at 3:01 p.m. with the following members present: Chairman Dana Timaeus Board Member Jeff Beaver Alternate Board Member Tom Rowe Alternate Board Member Lee Smith Board Members absent: Board Member Joey Hilliard Alternate Board Member Christy Amuny Also present: Adina Josey, Senior Planner; Fran Malvo, Recording Secretary, Tyrone Cooper, City Attorney APPROVAL OF MINUTES Alternate Board Member Smith made a motion to approve the minutes for May 2, 2019. Board Member Beaver seconded the motion. Motion to approve the minutes carried 4:0. SWEARING IN OF WITNESSES PUBLIC HEARING 1) File 741-BA: Consider a request for a Variance to the required minimum rear yard setback in an RM-H (Residential Multiple-Family Dwelling Highest Density) District zoning from 25’ to 15’ 11”. Applicant: Bevilacqua Construction Location: 3885 West Pointe Drive Mrs. Josey presented the staff report. Sam Bevilacqua of Bevilacqua Construction is requesting a Variance to the minimum rear yard setback for the property at 3885 West Pointe Drive. RM- H (Residential Multiple-Family Dwelling-Highest Density) zoning requires a 25’ rear yard setback. The applicant is requesting this Variance to reduce the rear yard setback requirement from 25’ to 15’11” in order to build a full-size attached garage with the house. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Slides of the subject property were shown. Fourteen notices were mailed to property owners within 200 feet of the subject property. None were received in favor or in opposition. BOARD OF ADJUSTMENT July 11, 2019 The applicant was present. Twenty-one notices were mailed to property owners within 200 feet of the subject property. One response was received in favor and none were received in opposition. Mr. Sam Bevilacqua, 3195 Dowlen Road, addressed the Commission. Mr. Bevilacqua stated he is the current owner of the property and that he intends to build a residential single family dwelling for a couple. He stated that the dwelling will be approximately 2000 square feet and the Variance is needed to accommodate a full size garage for the dwelling. A brief discussion followed regarding the driveway to the dwelling. No other questions, comments or discussion. Alternate Board Member Smith made a motion to approve the request for a Variance to the minimum rear yard setback in an RM-H (Residential Multiple- Family Dwelling-Highest Density) District as requested for File 741-BA. Board Member Beaver seconded the motion. Motion to approve carried 4:0. OTHER BUSINESS None. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:14 p.m. 2
