WHEREAS, in cooperation with Jefferson County Drainage District No.
6 of Jefferson County, Texas, The City of Beaumont is acquiring land for right-
of-way for the purpose of constructing and maintaining drainage improvements
within said District consisting of a drainage ditch for the carrying off of
surface water which would otherwise overflow on the lands of some of the citi-
zens residing within said District creating the danger of. flooding and doing
great damage to homes and ccnmrcial establishments, as well as providing pro-
per right-of-way for maintenance of said ditch, to be constructed within the
city limits of The City of Beaumont; and,
WFTF'RFAS, the City Council finds that there exists a public necessity
for the acquisition of property for right-of-way for that portion of a drainage
ditch in the vicinity of, and crossing, Dowlen Road in The City of Beaumont, Jef-
ferson County, Texas, and that public necessity exists for the acquisition of a
right-of-way to the hereinafter -described property for such public purpose; and,
WHEREAS, The City of Beaumont, through its duly authorized representa-
tives, has negotiated with the owners of the hereinafter -described land and has
been unable to agree with such owners as to the fair cash value thereof and dam-
ages, if any; NOW, TBE=RE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAU-MONI' :
THAT Kenneth Wall, City Attorney, or his designee, be and he is hereby, authorized
and directed to file or cause to be filed against all owners of the hereinafter
described property, and claimants of interest therein, Proceedings in Eminent Do-
main to acquire a right-of-way for said purpose across, through and over the fol -
laving -described tract of land situated in Beaumont, Jefferson County, Texas, to
wit:
BEGINNING at a point in the West line of the
P. H. Cannon, 23.86 acre tract of land as re-
corded in Volume 116, Page 172, of the Deed
Records.of Jefferson County, Texas; said be-
ginning.point being in the East'line of Dowlen
Road and bearing N 011 171 W, 879.12 feet from
the Southwest corner of the said P. H. Cannon,

THENCE N Ol° 17' W along the wast line of the
P. H. Cannon, 23.86 acre tract of land and the
East line of Dowlen Road a distance of 103.25
feet to a point for corner;
THENCE S 76° 52' E along the centerline of a
Gulf States Utilities Company power line ease-
ment a distance of 307.42 feet to a point;
THENCE S 7O° 24' E along the centerline.of the
said Gulf States Utilities Company power line
easement a distance of 575.73 feet to a point
for corner in the East line of the said' P. H.
Cannon, 23.86 acre tract of land;
THENCE S 010 17' E along the East line of the
P. H. Cannon, 23.86 acre tract'of land a dis-
tance of 107.03 feet to a point for corner;
THENCE N 700 24' W a distance of 608.23.feet
to a point;
THENCE N 76° 52' W a distance of 276.07 feet
to the point of beginning.
It is the intent of this description to describe
a 100 foot wide tract of land with the north line
being the centerline of a Gulf States Utilities
Company power line easement and containing 2.028
acres .of land, more or less.
