HomeMy WebLinkAboutRES 76 245j 9 "j 10 - q "I' R E S O L.0 T I O.N WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten, widen and extend Sarah Street in The City of Beaumont, Jefferson.County, Texas; and, WHEREAS, said City Council has found that public necessity requires the location, construction, maintenance, straightening, widening and extension of said street on the hereinafter described property; and, WHEREAS,, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter de- scribed property for said location,.construction, maintenance, straightening, widening and extension of said street, and the said City Council has found and determined that the said interest in and to the hereinafter described land is sutied for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the hereinafter described land and has been unable to agree with the owners of such property as to the fair cash value.thereof and damages, if Any; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT: That Kenneth Wall, City Attorney be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said pur- poses in and to the following described parcels of land situated in Beaumont, Jefferson County, Texas, to,wit: Tract 1 BEING a 21305 square foot tract of land out of the Usan Hebert Estate and being J Hebert 27-1/2 acre tract, J. W. Bullock League, as per map or plat thereof recorded in Volume 2, Page 90 of the Map Records of Jefferson County, Texas, said tract being more particularly described by.metes and bounds as.. -follows, to wit: For a LOCATIVE POINT,.the intersection of the existing South line of Sarah Street and the [nest line of Houston Street; THENCE North 890 56' West, 60.0 feet along the aforementioned South line to the PLACE QF,BEGINNING of the herein described tract; THENCE continuing North 89° 56' West, 11.0 feet to a point for corner in a common line between the aforementioned Usan Hebert 27-1/2 acre tract and the subdivision of the Ozan Blanchette 27-1/2 acre tract as recorded in Volume .4, Page 120 of the Map Records of said county and state; THENCE South 00° 05' East, 19.43 .feet along said common line to a point for corner; THENCE North 890 51' East, 11.0 feet along the proposed South line of Sarah Street to a point for corner; THENCE North 000 05' West, 19.39 feet to a point for corner and PLACE OF BEGINNING of the herein described tract of land; Containing 213.5 square feet of land, more or less. Tract 2 BEING a 3125.6 square foot tract of land out of a 0.90 acre tract in the Usan Hebert Estate situated in Block 8 of the subdivision of the Usan Hebert 27-1/2 acre tract, J. W. Bullock League, Jefferson County, Texas, as per map or plat thereof recorded in Volume 2, Page 90 of the Pap Records of said county and state, said tract being more particularly described by metes and bounds as follows, to wit: For the PLACE OF BEGINNING, the Northwest cor- ner of Block 8 of the aforementioned 27-1/2 acre tract, being the intersection of the South line of Sarah Street and the East line of Hous- ton Street; THENCE North 890 58' East, 160.0 feet along the existing South line of Sarah Street to a point for corner; THENCE South 000 02' East, 19.38 feet to a point for corner in the proposed South line of Sarah Street; the East line of Houston Street; THENCE North GOO 02' West, 19.69 feet along the East line of Houston Street to a point for corner and PLACE OF BEGINNING of the herein described tract of land; Containing 3,125.6 square feet of land, more or less. Tract 3 BEING a 191.0 square foot tract of land situ- ated in Block 7 of the subdivision of the Usan Hebert 27-1/2 acre tract, J. W. Bullock League, Jefferson County,,Texas, as per map or plat thereof recorded in Volume 2, Page 90 of the Map Records of said county and state, said tract being more particularly described by metes and bounds as follows, to wit: For a LOCATIVE POINT, the Northwest corner of Block 7 of the aforementioned 27-1/2 acre tract being the intersection of the South line of Sarah Street and the East line of Usan Street; THENCE North 890 48' East, 145.0 feet along the existing South line of Sarah Street being the North line of said Block 7 to the PLACE OF BE- GINNING of the herein described tract; THENCE continuing North 890 48' East, 10.0 feet to a point for corner; THENCE South 000 12' East, 19.1 feet to a point for corner in the proposed South line of Sarah Street; THENCE South 890 51' West, 10.0 feet along the proposed South line of Sarah Street to a point for corner; THENCE North 000 12' West, 19.1 feet to a point for corner in the existing Southline of Sarah Street being the PLACE OF BEGINNING of the here- in described tract of land; Containing 191.0 square feet of land, more or less. Provided, however, there is excluded from said estate to be condemned and reserved to the owners thereof all the oil, gas and sulphur beneath said land; and provided further that the rights of access, ingress and egress to and from the said Sarah Street of the remaining premises of defendants are not to be condemned.
