R E S O L U T I O N
WHEREAS, an 1,144.37 square foot tract of land described in
"Enclosure 1" to this resolution, and made a part hereof as fully as
though copied verbatim herein, acquired for street right of way pur-
poses is now considered to be surplus land as to the purpose for
which it was acquired; and,
WHEREAS, a certain 534.9.square foot tract of land; as de-
scribed in "Enclosure 2" to this resolution, which enclosure is made
a part hereof as though .copied verbatim herein, is needed for the pub-
lic purpose of street right of way for the Sarah -Lavaca Project, Pro-
ject No. 11 -ST -121, said -534-9 square foot tract of land being owned
by one Alvin Randolph who desires to acquire the tract of land de-
scribed in "Enclosure 1" to this resolution; and,
WHEREAS, both tracts of land described in "Enclosure 1" and
"Enclosure 2" to this resolution have been appraised by qualified ap-
praisers as having a market value of One Hundred and No/100 ($100.00)
Dollars each;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the City Manager be, and he is hereby, authorized to execute such
deeds and other legal instruments as may be necessary to effectuate an
exchange of the parcel of land described in "'Enclosure 1" to this reso-
lutionfor the parcel of land described,in "Enclosure 2" to this resolu-
tion, and that no additional consideration for either tract of land be
given or received inasmuch as the appriased fair market value of the
two tracts of land are identical.

"Being a 534,9 square foot tract of land situated in the J,.W.
Bullock League, Jefferson County, Texas, and being out of that
certain tract as conveyed to E. D, Sprott, Jr, and Alvin G. Randolph
by a deed.dated September 14, 1962 and recorded in Volume 1317, ,
Page 96 of said County and State,- said tract being more particularly
described by metes and bounds as follows, to wit:

"BEING a 1144.37square foot tract of land out of Lot 33 and Lot 34, Block 5
of the Pear Orchard Estates Addition to the City of Beaumont, Jefferson County,
Texas, as per map of plat thereof, as recorded in Volume 10, Page 157 of the
Map Records of said County and State, being more particularly described by
metes and bounds as follows,.to wit:
For a locative point, a concrete.monument'at the most westerly corner of
Lot 38, Block 5 of Pear Orchard Estates Addition., said point also being the
southeast corner of Lot 5, Block 1, of the Mildred Addition; to the City of
Beaumont;
THENCE, North 23022' East, 325.48 feet along the most westerly line of Pear.
Orchard Estates Addition to a point and Place of Beginning of -the herein
described tract of land;..
THENCE, continuing North 23022' East, with said -most westerly line. of -Pear
Orchard Estates Addition, 35.86 feet to a point for corner in the north line
of Lot 33 and Lot 34;
THENCE, North 62019' East, 79.00 feet 'with the north line of Lot 33 and
Lot 34 to a point for a corner in the north line of Lot 33;
THENCE, South 33019'28" East 6.01 feet to a point for a corner in the North
right-of-way line of Lavaca Street.
THENCE, deflecting to the left along the arc of a curve with a radius of
751.00, a distance of 54.73 feet to a point of tangency (chord of said curve
bears South 54035' 16" West, 54.72 feet);
