WHEREAS, the.City Council of The City of Beaumont deems
it necessary to locate, construct, maintain, straighten, widen
and extend Delaware Street in The City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, said City Council has found that public necessity
requires the location, construction, maintenance, straightening,
widening and extension of said street on the hereinafter de-
scribed property; and,
WHEREAS, said City Council deems it necessary to acquire
the hereinafter described interest in and to the hereinafter
described property for said location, construction, maintenance,
straightening, widening and extension of said street, and the
said City Council has found and determined that the said in-
terest in and to the hereinafter described land is suited for
such purposes and that it is necessary to acquire same for said
purposes; and,
WHEREAS, The City of Beaumont, through -.its duly authorized
representatives, has negotiated with the owners of the herein-
after described land and has been unable to agree with the owners
of such property as to the fair cash value thereof and damages,
if any, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:
That Kenneth Wall, City Attorney, be,!and he is hereby, authorized
and directed to file or cause to be filed against all owners of
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title,
for said purpose, in and to the following described parcel of
land situated in Beaumont, Jefferson County, Texas, to -wit:
TRACT I
BEING a 1329 square foot triangular shaped tract of
land out of the Mary A. Cannon; et al., tract out of
the H. Williams League, Abstract 56, Beaumont,
Jefferson County, Texas, and being 223.33 feet along
the south right of way line of Delaware Street, an
existing 60 foot wide right of way described as fol-
lows:
BEGINNING at an iron rod which marks the northwest
corner of the Westwood Bible Church tract as des-
cribed in Volume 1709, Page 490, Deed Records,
Jefferson County, Texas, said beginning corner being
in the south right of way line..of Delaware Street as
described in Volume 457, Page 189, Deed Records,
Jefferson County, Texas, said beginning corner being
in the east line of Lot 4, Block 31, Calder Highlands
Addition, plat of which is recorded in Volume 4, Page
155, Map Records, Jefferson County, Texas, and said
beginning corner being the northeast corner of the
Mrs. Vera Marmion tract as described in Volume 864,
Page 608, Deed Records, Jefferson County, Texas, said
beginning corner being located 58.8 feet north of and
measured along the east line of and from the south-
east corner of said Lot 4, Block 31, Calder Highlands
Addition;
THENCE South 89 deg. 59' East along the south right
of way line of the existing Delaware Street a distance
of 223.33 feet to a mark on the concrete liner in the
23rd Street ditch for corner, said corner being the
northeast corner of the said Westwood Bible Church
tract and the northwest corner of Block 3, Briarcliff
Addition, plat of which is recorded in Volume 7, Page
12, Map Records, Jefferson County, Texas;
THENCE South 86 deg. 58' West a distance of 223.65
feet to an iron rod for corner in the west line of
the said Westwood Bible Church tract and the east
line of.Lot 4, Block 31, Calder. Highlands Addition
and the east line of the said Mrs. Vera Marmion tract;
THENCE North 00 deg. 01' East alongthe common line of
the said Marmion and Westwood Bible Church tracts a
distance of 11.9 feet to the place of beginning.
TRACT 11
BEING an 807 square foot tract of land and being 60.0
feet along the south right of way line of the existing
Delaware Street out of the northeast portion of Lot 4,
Block 31,:Calder Highlands Addition, plat of which is
recorded in Volume 4, Page 155, Map Records, Jefferson
County, Texas, described as follows:
BEGINNING at an iron rod which marks the intersection
of the east line of said Lot 4 and the South right of
way line of Delaware Street, a 60 foot wide right of
way as described in Volume 457, Page 199, Deed Records,
Jefferson County, Texas, said beginning corner being
located 58.8 feet north of and measured along the east
THENCE South 00 deg. 01' West along the east line
of Lot 4 and the common line of the Mrs. -Vera Marmion
tract and the said Westwood Bible:Church tract a dis-
tance of 11.9 feet to an iron rod for corner;
THENCE South 89 deg. 04' West across the Marmion tract
a distance of 60.08 feet to an iron rod for corner in
the east line of the Westwood Bible Church tract as
described in Volume 1369, Page 424, Deed Records,
Jefferson County, Texas, said corner being located 43.8
feet north of the south line of said Lot 4;
THENCE North 00 deg. 01' East along the common line of
the Marmion and Westwood Bible Church tracts a distance
of 15.0 feet to an iron rod for corner in the south
right of way line of said Delaware Street;
THENCE South 89 deg. 59' East along the south right of
way line of Delaware Street a distance of 60.0 feet to
the place of beginning.
TRACT III
BEING a 2450 square foot tract of land and being 15
feet along West Lucas Drive and 163.33 feet along
Delaware Street and being out of Lot 4, Block 31, Calder
Highlands Addition, plat of which is recorded in Volume
4, Page 155, Map Records, Jefferson County, Texas, and
described as follows:
BEGINNING at an iron rod which marks the intersection
of the east right of way line of West Lucas Drive and
the south right of way line of the existing Delaware
Street, a 60 foot wide right of way,. said iron rod being
located 58.8 feet measured along the west line of and
from the southwest corner of said Lot 4, said beginning
corner being the southwest corner -of a tract of land
conveyed.to Jefferson County for road purposes as des-
cribed in Volume 457, Page 199, Deed Records, Jefferson
County, Texas, the said beginning corner being the north-
west corner of the Westwood Bible Church tract as des-
cribed -in Volume 1369, Page 424, Deed Records, Jefferson
County, Texas;
THENCE South 89 deg. 59' East along the south right of
way line of said Delaware Street and parallel to the south
line of said Lot 4 a distance.of 163.33 feet to an iron
rod for corner at the northeast corner of the said West-
wood Bible Church tract and the northwest corner of the
Mr,s. Vera Marmion tract as described in Volume 864, Page
608, Deed Records of said county;
THENCE South 00 deg. 01' West along the common line be-
tween the Westwood Bible Church tract and the said Marmion
tract a distance of 15.0 feet to an iron rod for corner,
said corner being located 43.8 feet north of the south
line of said Lot 4;
THENCE North 89 deg. 59' West parallel to the South line
of the said Lot 4 a distance of -163.33 feet'to an iron
rod for corner in the west line of said Lot 4 and the
east right of way line of West Lucas Drive;
Provided, however, there is excluded from said estate to
be condemned and reserved to the owners thereof all the oil,
gas and sulphur beneath said land; and.provided further that
the rights of access, ingress and egress to and from the said
Delaware Street of the remaining premises of defendants are
not to be condemned.
