R E -S O L U T I 0 N
WHEREAS, theiCity Council of the City of Beaumont deems
it necessary to provide visibility clearance for traffic at
I
the northeast corner of Goodhue Drive and Phelan Boulevard
I
in the City of Beaumont, Jefferson County, Texas; and,
WHEREAS, said City Council has found that public necess-
ity requires the acquisitionlof the;,hereinafter described pro-
perty for said visibility clearance;land,
WHEREAS, said City Council- deems it necessary to acquire
the hereinafter described interest in and to the hereinafter
described property for said visibility clearance for traffic
on said streets, and the City Council has found and determined
that the said interest in and to the hereinafter described land
is suited for such purposes and that it is necessary to acquire
same for said purposes; and,
WHEREAS, the City of Beaumont, through its duly autho-
rized representatives, has negotiated with the owners of the
hereinafter described land and has been unable to agree with
the owners of such property.as to fair cash value thereof
and damages, if any,
NOW, THEREFORE, BE IT!,RESOLVED BY THE

CITY COUNCIL OF. THE CITY OF BEAUMONT:
that Kenneth Wall, City Attorney; be, and heis hereby, autho-
rized and directed to file or cause to be filed against all
owners of the hereinafter described property, and claimants of
interest therein, proceedings in'eminent domain to acquire fee
title for said purpose, in and to the following described par-
cel of land situated in Beaumont; Jefferson County, Texas,
to wit:

BEING a tract of land!
out of Lot 1, Block 2
of'the Goodhue Estates Addition to the City
of Beaumont, Jefferson County, Texas, and
being more particularly described by metes

BEGINNING at a steel rod in the north line of
Phelan Boulevard being the southwest corner of
Lot 1, Block 2 of the Goodhue Estates Addition
and the east line of Goodhue Road, said rod
being the place of beginning of the herein de-
scribed tract of land;
THENCE in a northerly direction along a curve
being the west line of said Lot 1, Block 2
and having a central angle of 24015' for a dis-
tance of 3.0 feet to a point for corner;
THENCE North 68016134" East, for a distance of
68.04 feet to a point for corner in the north'
line of Phelan Boulevard also being the south
line of said Lot 1;
THENCE South 65045' West 68.0 feet along the
north line of Phelan Boulevard and the south
line of said Lot 1 and being the south line of
the herein described tract to a steel rod and
place of beginning, containing 102.00 square
feet of land, more or less.

Provided, however, there is excluded from said estate
to be condemned and reserved to the owners thereof all the
oil, gas and sulphur beneath said land; and provided further,
that the rights of access, ingress and egress to and from
said Phelan Boulevard and the said Goodhue Road of the re-
maining premises of Defendants are not to be condemned.
PASSED BY THE CITY COUNCIL. of the City of Beaumont this
