WHEREAS, the ,City Council desires to establish and adopt a
step-by-step procedure for assessment paving by petition of certain
streets in the City of Beaumont, Texas; and,
WHEREAS, an ordinance providing a program and policy of resi-
dental street paving by assessment in the City of Beaumont has been
adopted by this City Council;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the procedure for assessment paving by'a petition of streets in
the city of Beaumont is attached hereto as Exhibit "A", and made a
part hereof for all purposes, be, and the same is hereby adopted by
the City Council of the City of Beaumont as the assessment paving pro-
cedure to be used by the City of Beaumont in paving those streets eli-
gible for assessment paving as provided in the ordinance heretofore
passed by the City Council providing a program and policy of residen-
tial street paving assessment by the City of Beaumont.

PROCEDURE FOR ASSESSEENI' PAVING BY PETITION

.EXHIBIT- "A"
STEP 1. Request for paving petition from property owner received by Public works
STEP 2. On site feasibility study made of affected streets by Public Works
STEP 3. A written report shall be made to the City Manager and City Council. of those
projects which the Public Works Department finds not feasible. The City
Council will review all requests for a petition to widen an existing slab
street and the feasibility report and staff recommendation shall be
forwarded to the City Council.
STEP 4. Public Vbrks shall conduct a neighborhood meeting if a petition is to be
issued on the project.
STEP 5. Paving petition with supporting materials sent out by Public V7orks
STEP 6. Paving petition signed'by property owners received, checked,,approved-
by Public Works
STEP 7. Availability of funds checked with Finance Officer and City Manager by
Public Works
STEP 8. Recomendation to City Council for. action on request by City Manager
S'_EP 9. Resolution passed by City Council approving recomend.ation and giving
authority to Public Vbrks to prepare plans, specifications, cost
estimtes, etc. •.
SPEP 10. Plans, specifications, cost.estimates, etc., prepared by Public hbrks and
submitted for approval
STEP 11. By Ordinance, the City Council:
a. Declares improvements to be a public necessity

b. Lists the correct names of streets and units involved
c. Approves the plans, specifications, cost estimates, etc. prepared
and submitted by Public Works
d. Authorizes the advertisement for bids
e. States that a portion of paving costs are to be assessed
f. Sets date for receipt of bids
g. Establishes methods of payment of assessment
h. Directs City Clerk to file "Notice of Intent to Assess"
SUP 12, "Notice of Intent to Assess" filed in County Clerk's office
STEP 13. Notice to Bidders published
STS 14. Bids received open meeting and referred to blic Ubrks for re-
ccamendation and preparation of assessment roll, etc.
STS 15. Assessment roll ccmpleted by Public Vbrks:
a. Tistinq apparent abutting property owners
b. Stating the total cost of project
c. Stating the legal description of abutting property
d. Stating the number of front feet of abutting property
e. Computing the amount of assessment for each parcel of property
ST_F? 16. By Resolution, the City Council:
a. Awards bid and.authorizes City Manager to execute contract
b. Approves the paving assessment roll
c. Sets the time and place of the Benefit Hearing (Council Viers)
d. Authorizes the City Clerk to give Notice of Benefit Hearing
e. States that following the hearing assessments will be made
STEP 17. Data Process given copy of assessment roll
STEP 18. Notice of Benefit Hearing published three times (the first tine at -
least -21 days prior to benefit hearing) and written notice mailed to
property c7aners by Certified Mail at least 14 days prior to -benefit
hearing..
STE.P 19. Benefit Hearing held in Council Chambers.
a. Public'Works describes proposed improvements and method of
apportioning costs -
b. City Attorney states notice was properly given
c. Appraiser states qualifications and that he has examined the
property within the past 30 days and that benefits of improve-
ment to each tract exceeds cost of assessment to that tract
d. Interested parties are heard
e. Hearing is closed.
STEP 20. By Ordinance, the City Council
a. outlines procedure completed to date
b. States the facts of public hearing
c. Closes the public hearing

d. Rules upon all protests made at public hearing
e. Finds that enhancement exceeds cost of assessment
f. States the manner and time of payment and method of collection_
of assessments
g. Fixes the -lien for amount of assessments
STEP 21. Public kbrks prepares report showing final cost for the improve
ments and recommends acceptance of same
STEP 22. By Resolution, the City Council approves the report, accepts the
work and authorizes final payment to Contractor.
STEP 23. Assessments are collected by Tax Department
STFP 24. Delinquent accounts are referred to City Attorney for collection
