Kohler, Consulting Engineer,'be retained for the purpose of,providing professional services of an engineering and surveying nature in accordance with the terms and conditions of.that certain contract, a copy of which is attached to this resolution at the per diem rates stated therein, but, in any event, not to exceed a total of $3,600.00; and, BE IT FURTHER RESOLVED that the City Manager be, and he is hereby,auth.orized to execute the attached contract for and in behalf of the City of Beaumont and that the. City Clerk be authorized to affix the Seal of the City of Beaumont thereto. PASSED BY THE CITY COUNCIL of the City of Beaumont / �l this the' aQ+ h day of 1975, Mayor THE STATE OF TEXAS X COUNTY OF JEFFERSON Z This agreement made, entered.into and executed this day of 1975, by and between the City of Beaumont, acting herein by and through its City Manager, duly authorized, hereinafter called the "City", and C. A. Kohler, Consulting Engineer,!hereinafter called the "Engineer". WHEREAS, the City intends to acquire Block --54 of Beaumont Township for a bus station; WHEREAS, it is intended that,Engineer shall perform certain services hereinafter more particularly set out with reference to said project; NOW, THEREFORE, the City and the Engineer in consider- ation of the mutual covenants and agreements hereinafter contained do mutually agree as follows: i I. I - j, Engineer agrees to furnish City survey services, field note descriptions, and maps necessary for each tract in Block 54 showing all improvements, encroachments and areas. II. Engineer agrees to .;establish concrete monuments'on the Block corners of said Block 54. Engineer agrees to calculate and write the field note. descriptions of each of the.parce'ls, and to provide maps of each parcel showing all improvements. The word "parcel", as used herein, shall mean each tract of land under ownership not identical to its abutting tract or tracts of land. IV., Engineer agrees to locate and identify the following: 1. Individual property plats showing all improvements, dimensions' for appraisal uses. i I ✓- � G S ! �� I [ f 2. Rights of way and easements. 3. Property boundaries of parcels, as hereinabove_ defined, with permanent stakes.at all corners. 4. Adjacent streets with present curb lines and with present driveway approaches. I 5. All utilities including the following: A. Electrical (1) type and voltage available (2) location of lines and poles B. water (1) location and size of mains (2). approximate-location and size of taps, if any (3) location of fire hydrants C. Sanitary sewer (1) location of size of mains adjacent to Block 54. (2) Manholes, if any, and elevation of flow. lines and tap.rims D. Storm sewer (1) location and size of mains adjacent to Block.54 (2) location of manholes, if any, and elevation. of flow line and rim (3) location of c,a'tch basins and inlets with rim and invert elevation E. Gas (1) location and size of mains adjacent to Block 54 6. _ Topography A. Bench mark established and tied to USC GD Survey on Beaumont Datun 2 5 fl B.' Topographical gird at fifty (50) foot intervals each way C. Top of curb elevations at extensions of gird. The foregoing items listed hereinabove in this paragraph are specific items Engineer agrees to locate and identify, but Engineer understands that said foregoing list is not conclu- sively definitive, and agrees to furnish such other additional items as may, from time to time, be, deemed necessary by the City. However, the City shall not:have the authority to signi-f- icantly increase the scope of the project without the consent of Engineer. V. Engineer agrees to preparea topographic map on approxi. - mately a scale of one inch (1") equals twenty feet (1"=201). Such maps will show survey, information and will show location I and elevation of all utility.lines sewer, water, telephone, I electricity and drainage lines. Also, elevation of all curbs, gutters and or natural ground on'fifty (50) foot centers will be shown. VI.` Engineer agrees to furnish six -(6) copies of each of the individual maps, six (6) copies.of field note descriptions and six (6) copies of the location map, one reproducable print of each map will be provided. VII . City agrees to pay Engineer for all services described in this agreement on the following per diem basis: Principal Registered Engineer Engineer in Training Engineer assistant, draftsman, inspector Four man survey party Three man survey party - Two man survey party. $200.00/8 hr. day $120.00/8 hr. day $100.00/8 hr. day $ 80.00/8 hr. day $280.00/8 hr. day $240.00/8 hr. day $200.00/8 hr. day VIII. While the precise fee cannot be determined in advance of the performance of the services, it is estimated that the total cost.will be $3,000.00 and it agreed by, and between the parties hereto that the fee to be paid Engineer shall be not more than $3,600.00. IX. In the event that the Engineer's presence is required as expert witness in any litigation requiring the personal services of C. A. Kohler, Engineer agrees to furnish such representationat the rate of $20000 per day for the time i not only in giving actual testimony in the litigation, but also for standby waiting time. Itj,is understood by and between the parties that the services included in this para- ' i graph, only, are in addition to the per diem fee set forth in the preceding paragraphs. 10 This contract shall not be,assignable in whole or in part without the consent .of the City. XI This contract may be terminated by either party upon thirty (30) days' written notice: If this contract is ter- minated, Engineer shall be paid for services rendered to the effective date of termination. XII. Drawings, plats and descriptions are and shall remain the property of the City: XIII. Engineer shall permit the authorized representatives T T T.., ." A4 - Transportation Administration, the Comptroller General of the United States, the City, or any of their duly authorized representatives, to inspect and audit all data and record relating to the performance of the work under this contract. XIV. In connection with the execution of this contract, Engineer shall not. discriminate against any employee or appli- cant for employment because of race, religion, color, sex or national origin. IN WITNESS WHEREOF, the City of Beaumont, a municipal corporation, and C. A. Kohler, Consulting Engineer, have executed this contract on the day of , 1975.
