R E S O L U T I O N
WHEREAS, the City Council of The City of Beaumont deems
it necessary to locate, construct, maintain, straighten, widen
and extend University Drive in The City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, said City Council has found that public necessity
requires the location, construction, maintenance, straightening,
widening and extension .of said street on the hereinafter de-
scribed property; and,
WHEREAS, said City Council deems it necessary to acquire
the hereinafter described interest in and to the hereinafter
described property for said location, construction, maintenance,
straightening, widening and extension of said street, and the
said City Council has found and determined that the said in-
terest in and to the hereinafter described land is suited for
such purposes and that it is necessary to acquire same for said
purposes; and,
WHEREAS, The City of Beaumont, through its duly authorized
representatives, has negotiated with the owners of the herein-
after described land and has been unable to agree with the owners
of such property as to the fair case value thereof and damages,
if any, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:
th,at_Kenneth Wall, City Attorney, be, and he is hereby, author-
ized and directed to file or cause to be filed against all
owners.of the hereinafter described property, and claimants of
interest therein, Proceedings in Eminent Domain to acquire fee
title, for said purpose, in and to the following described par-
cel of land situated in Beaumont, Jefferson County, Texas,
to -wit:'
BEING a 1,500.0 square foot tract of land out
of Lot 17, Block 3, of the:LaSalle Addition
to the City of Beaumont, Jefferson County,
Texas, as per map or plat thereof recorded in
Volume 5, Page 67, of the Map Records of said
County and.State, said tract being more partic-
ularly described by metes and bounds as follows,,
to wit:
For a locative point,.the intersection of the
_.South line of East Virginia and the West line
of University Drive, being the Northeast corner
of Lot 24, Block 3 of the LaSalle Addition;
THENCE South 00°01'01" East, 367.5 feet along
the West line of University Drive.to the PLACE
OF BEGINNING of the herein described tract of
land;
THENCE continuing along said West line South
00°01'01" East, 50.0 feet to a point for corner
in the South line of Lot 17;
THENCE South 89°58'59" West, 30.0 feet along
said South line to a point for corner;
THENCE North 00°01101" West, 50.0 feet to a
point for corner inthe North line of Lot 17;
THENCE North 89°58'59" East, 30.0 feet along
said North line to a point.for corner being
the PLACE OF BEGINNING of the herein described
tract of land;
CONTAINING 1,500.0 square feet of land more or
less.
Provided, however, there is excluded from said estate to
be condemned and reserved to -the owners thereof all the oil, gas
and sulphur beneath said land; and provided further that the
rights of access, ingress and egress'to and from the said Uni-
versity Drive of the remaining premises of defendants are not
to be condemned.
PASSED BY THE CITY COUNCIL this the f� day of
