HomeMy WebLinkAboutRES 74 351te- /5/® -1 C R E S O L U T I O N WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, construct, maintain, straighten and widen College and Fourth Streets in The City of Beaumont, Jef- ferson County, Texas; and, WHEREAS, said City Council has found that public necessity J requires the location, construction, maintenance, straightening and widening of said Street on the hereinafter described property; ,and, WHEREAS, said City Council deems it necessary to acquire the hereinafter described interest in and to the hereinafter de- scribed property for said location, construction, maintenance, straightening, and widening of said street, and the said City Council has found and determined that the said interest in and to the hereinafter described land is suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, The City of Beaumont, through its duly authorized representatives, has negotiated with the owners of the herein- after described land and has been unable to agree with the owners of such property as to the fair cash value thereof and damages, if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS: that Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed to file or cause to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcel of land situated in Beaumont, Jefferson County, Texas, to -wit: 0 BEING a 1,660.0 square foot tract of land out of Lot 6, Block 37 of Cartwright Terrace Addition situated in the David Brown Survey Abstract 5, City of Beaumont, Jefferson County, Texas, as per map or plat of said subdivision recorded in Volume 3, Page 147 of the Map Records of said County and State, said tract being more particu- larly described by metes and bounds as follows, to wit: For the PLACE OF BEGINNING of the herein described tract of land, the intersection of the -existing West line of Fourth Street and the Existing North line of College Street, point being the existing Southeast corner of Lot 6, Block 37 of .said sub- division; THENCE West, 140.00 feet along the existing North line of College Street to a point for corner;. THENCE North 10.00 feet along the West line of said Lot 6 to a point for corner; THENCE North 89°48'47" East-, 107.50 feet along the porposed North line of College Street to a point for a curve; THENCE deflecting to the left along the arc of a curve with a radius of 32.50 feet for a distance of 50.94 feet to a point for corner in the West line of Fourth Street, (chord of said curve bears North 44°54'43" East, 46.03 feet); THENCE South 42.95 feet along the West line of Fourth Street to the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 1,660.0 square feet of land more or less. PROVIDED, however, there is excluded from said estate to be condemned and reserved to the owners thereof all of theoil, gas and sulphur beneath said land; and provided further that the rights of access, ingress and egress to or from the.said College and Fourth -Streets of the remaining premises of defendants are not to be condemned.
