RES O LU TION
WHEREAS, the City Council of The City of Beaumont deems it necessary
to locate, construct, maintain, straighten, widen and extend College Street in
The City of Beaumont, Jefferson County, Texas; and,
WHEREAS, said City Council has found that public necessity requires
the location, construction, maintenance, straightening, widening and extension
of said street on the hereinafter described property; and,
WHEREAS, said City Council deems it necessary to acquire the here-
inafter described interest in and to the hereinafter described property for said
location, construction, maintenance, straightening, widening and extension of said
street, and the said City Council has found and determined that the said interest
in and to the hereinafter described land is suited for such purposes and that it
is necessary to acquire same for said purposes; and,
WHEREAS, The City of Beaumont, through its duly authorized repre-
sentatives, has negotiated with the owners of the hereinafter described land and
has been unable to agree with the owners of such property as to the fair cash
value thereof and damages, if any, ,NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:
that Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed
to file or cause to be filed against all owners of the hereinafter described property,
and claimants of interest therein, Proceedings in Eminent Domain to acquire fee
title, for said purpose, in and to the following described parcel of land situated
in Beaumont, Jefferson County, Texas, to -wit:
BEING a 1, 250. 7 square foot tract of land out of Lots 7 and 8, Block
37 of Cartwright Terrace Addition situated in the David Brown Survey
Abstract 5, City of Beaumont, Jefferson County, Texas, as per map
or plat of said subdivision recorded in Volume 3, Page 147 of the
Map Records of said Countv and State, said tract being more par-
FOR a locative point, the intersection of the existing West line
of Fourth Street and the existing North line of College Street,
point being the existing Southeast corner of Lot 6., Block 37 of
said subdivision;
THENCE West 160. 00 feet along the existing North line of College
Street to the PLACE OF BEGINNING of the herein described tract
of land, said point being the existing Southeast corner of Lot 7,
Block 37.of said addition;
THENCE continuing West 129. 63 feet along the existing North
line of College Street to a point for corner;
THENCE North 42024' East, 13. 54 feet along the Eastern line
of a Santa, Fe Railroad right-of-way to a point for corner;
THENCE East 120. 50 feet along the proposed North line of College
Street to a point for corner in the East line of Lot 7;
THENCE South 10. 00 feet to a point for corner and PLACE OF
BEGINNING of the herein described tract of land;
CONTAINING 1, 250. 7 square feet of land more or less.
PROVIDED, however, there is excluded from said estate to be condemned
and reserved to the owners -thereof all of the oil, gas and sulphur beneath said
land; and provided further that the rights of access, ingress and egress to or
from the said College Street of the remaining premises of defendants are not
to be condemned.
