R- E S 0 L U T I O N
OF
THE CITY COUNCIL OF THE CITY OF BEAUMONT
WHEREAS, the City of Beaumont is required to
establish and maintain a sanitary land fill for the disposi-
tion of solid wastes accumulated within said City and to
establish public parks and public recreational facilities for
the use and benefit of the public within said City; and
WHEREAS, it is necessary and convenient, that the
tract, lot or parcel of land hereinbelow described be acquired
by the City of Beaumont for the purpose of devoting the same
to the public use of establishing and maintaining a sanitary
fill area, and, ultimately, of a part of a public park and
public recreational facility area; and
WHEREAS, the said purposes for which said tract of
land is required to be acquired and to which it is to be de-
voted necessitates that the title to the same, in fee simple,
except the oil, gas and other mineral estate without any right
of the owner of said oil, gas .or other mineral estate to enter
upon the surface of said tract for the purpose of exploring
for or producing from said land any oil, gas or other minerals,
be acquired by the City of Beaumont; and
WHEREAS, the City of Beaumont is unable to ascer-
tain and .determine the persons who are vested with the fee
simple title to the tract of land, so needed and required
for said public purposes, to -wit:
BEINGa 384.879 acre tract of landout of the
James Drake Survey in Beaumont, Jefferson
County, Texas, and being a portion of that cer-
tain 1077 acres tract of land heretofore con-
veyed by Cotton Sanders, et al, to Jordan Reece
and being more.particularly described by metes
and bounds as follows:
FOR LOCATIVE CORNER BEGIN at an old iron bar
found on the common line between the A —Williams
League and the James .Drake Survey, at the east
edge of the high land and at the west edge of
the marsh land at a fence corner, said iron bar
locating the southeast corner of the Delano 90
acres tract of land and the southwest corner of
the Jirou Heirs 73.909 acres tract of land;
THENCE north 89 degrees 36 minutes 36 seconds
east with the south line of the Jirou Tract and
at 1431.4 feet past an iron pipe locating the
southeast corner of said Jirou Tract and continu-
ing on same course and at 1831.03 feet past a 3/4
inch galvanized pipe in the west edge of the City
of Beaumont's fresh water canal and continuing on
a total distance of 2036.26 feet to a 2 inch gal-
vanized iron pipe in the east edge of said fresh
water canal and in the south line of the A.
Williams League and in the north line of the
James Drake Survey locating the northwest and the
beginning corner of the tract of land herein
described;
THENCE south 12 degrees 34 minutes west with the
east edge of said fresh water canal 3292.49 feet
to a stake for corner in the north line of the
City of Beaumont's garbage dump tract, being also
in a south line of'said'1077 acres tract of land;
THENCE north 89 degrees 57 minutes east with.said
south line 2175.19 feet to a 5/8 inch steel rod
found and a 1 1/2 inch galvanized iron pipe placed
over said steel rod on'the•west edge of'the Neches
River for a corner, from said iron pipe a-36 inch
sweetgum marked X bears north 68 degrees 30 minutes
west 41.3 feet and a double 10 inch sweetgum marked
X bears north 16 degrees 40 minutes east 43 feet;
THENCE going upstream with the west -bank of the
Neches.River.the following courses and distances:
THENCE north 44 degrees 37.6 minutes east
253.86 feet;
THENCE south 77 degrees 42 minutes east
260.05 feet;
THENCE south 39 degrees 46 minutes east
215.10 feet;
THENCE south 59 degrees 58 minutes east

the west bank of the. Neches River and in the
north. line. of the James Drake Survey and in the
south.,line of the A. Williams League said iron
pipe locating the present northeast corner of the
James Drake Survey and the northeast corner of
the tract of land herein described;
THENCE south 89 degrees 36 minutes 36 seconds west
with the common line of the James Drake Survey and
the A. Williams League 5609.50 feet to the place
of beginning containing 384.879 acres of land.
and
Beaumont to negotiate -with all persons who may have or claim
title to said property and premises or some interest therein
for the purchase of the same; NOW, THEREFORE,
BE IT RESOLVED by the City Council of the City of
Beaumont that it is necessary, convenient and expedient that
the fee simple title, except, the oil, gas and other mineral
estate without any right of the owner or owners of said oil,
gas or other mineral estate .to enter upon the surface of said
land to explore for or produce therefrom the,oil, gas or
other minerals therein or thereunder, to the tract, lot or
parcel of land be acquired for the public purposes and uses
.hereinabove mentioned; and
BE IT FURTHER RESOLVED that the City Attorney of
the City of Beaumont be, and he is hereby ordered and directed
forthwith to;,commence such proceedings under the.laws of
eminent domain of the State of Texas, and.to prosecute the.
same diligently, to"cause such title to said land to be vested
in the City of Beaumont.
