R E S O L U T I.O N
WHEREAS, the City Council of The City of Beaumont deems it
necessary to locate, construct, maintain, straighten, widen and extend
Washington Boulevard in The City of'Beaumont, Jefferson County, Texas;
and,
WHEREAS, said City Council has found that public necessity requires
the location, construction, maintenance, straightening, widening and extension
of said street on the hereinafter described property; and,
WHEREAS, said City Council deems it necessary to acquire the here-
inafter described interest in and to the hereinafter described property for said
location, construction, maintenance, straightening, widening and extension of
said street, and the said City Council has found and determined that the said
interest in and to the hereinafter described land is suited for such purposes
and that it is necessary to acquire same for said purposes; and,
WHEREAS, The City of Beaumont, through its duly authorized rep-
resentatives, has negotiated with the owners of the hereinafter described land
and has been unable to agree with the owners of such property as to the fair
cash value thereof and damages, if any, NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE. CITY OF BEAUMONT, TEXAS:
that Kenneth Wall, City Attorney, be, and he is hereby, authorized and directed
to file or cause to be filed. against all owners of the hereinafter described prop-
erty, and claimants of interest therein, Proceedings in Eminent Domain to
acquire fee title, for said purpose, in and to the following described parcel of
land situated in Beaumont, Jefferson County, Texas, to -wit:
TRACT I
BEING a 2, 203, 5 square foot tract of land out of Lot 16, Block`4
of Booker Heights Addition situated in the David Brown Survey,
Abstract 5, City of Beaumont, Jefferson County, Texas, as per
FOR the PLACE OF BEGINNING, the intersection of the North
line of Washington Boulevard and the existing East line of Fourth
Street, said point being the Southwest corner of Lot 16, Block 4,
of Booker Heights Addition;
THENCE North 89°52' East, 23. 00 feet along the North line of
Washington Boulevard to a point for corner;
THENCE North 21029144" West, 24. 70 feet along the proposed
East line of Fourth Street to an angle point;
THENCE North 00°08' West, 127. 00 feet along said proposed
East line to a point for corner in the North line of Lot 16., Block 4;
THENCE South 89°52' West, 14. 00 feet along the North line of
Lot 16, Block 4, to a point for corner in the existing East line of
Fourth Street;
THENCE South 00008' East, 150. 00 feet along the existing East line
of Fourth Street to the PLACE OF BEGINNING of the herein described
tract of land;
CONTAINING 2, 203. 5 square feet of land more or less.
TRACT II
BEING a 3, 219. 0 square foot tract of land out of Lots 16 and 17,
Block 6 of Booker Heights Addition situated in the James Bullock
Survey, Abstract 7, City of Beaumont, Jefferson County, Texas,
as per map or plat of said subdivision recorded in Volume 4, Page
113 of the Map Records of said County and State, said tract being
more particularly described by metes and bounds as follows, to -wit:
FOR the PLACE OF BEGINNING, the intersection of the South
line of Washington Boulevard and the existing East line of Fourth
Street, said point being the Northwest corner of Lot 16, Block 6;
THENCE North 89052' East, 14. 00 feet along the North line of said
Lot 16, Block 6 to a point for corner;
THENCE South 00°08' East, 224. 56 feet along the proposed East
line of Fourth Street to a point for corner in the North line of
Fannett Road;
THENCE South 52022' West, 17. 64 feet along the North line of
Fannett Road to a point for corner in the existing East line of
Fourth Street;
THENCE North 00008' West, 235. 30 feet along the existing East
line of Fourth Street to the PLACE OF BEGINNING of the herein
described tract of land;
CONTAINING 3, 219. 0 square feet of land more or less.
PROVIDED, however, there is excluded from said estate to be con-
demned and, reserved to the owners thereof all the oil, gas and sulfur beneath
said land; and provided further that the rights of access, ingress and egress
to and from the said Washington Boulevard of the remaining premises of de-
fendants are not to be condemned.
