HomeMy WebLinkAboutRES 54 HHH 8WHEREAS, the City Council of The City of Beaumont deems it necessary to locate, cons true t,- maintain, s t-raighten, , widen and extend East Lavaca Street in The City of Beaumont, Jefferson-' r County, Texas; and,. WHEREAS, said City Council has found that public necessity requires the location, construction,.maintenance., straightening, widening and extension of said street on -the hereinafter described property; and, WHEREAS, _:said City Council deems it necessary 'to acquire: thee. hereinafter described interest'in and' to the hereinafter described property for said location,.construction, maintenance, straight'e'n- ing; widening and extension of said street, and the said City:' Council has ----found -and,- determined that the said interest in and to - the hereinafter described land is 'Suited for such purposes and that it is necessary to acquire same for said purposes; and, WHEREAS, . The City-- of Beaumont, through its duly authorized representatives, has.`negotiated with'the owners of .the hereinafter described land and has been:unable to agree -with the owners'of such p-roperty as to the fair cash value thereof and damages; if any, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT- TEXAS: that Kenneth Wall, City Attorney;. be, and he is- hereby,' authorized . and directed to file or-cause.to be filed against all owners of the hereinafter described property, and claimants of interest therein, Proceedings in Eminent Domain to acquire fee title, for said purpose, in and to the following described parcels of land situated in Beaumont, Jefferson County, Texas, to -wit: TRACT NO. 1: BEING a 230.0 square foot tract of land out of Lot 7, Block 1 of University Place Second Addi- tion to The City of Beaumont, Jefferson County, Texas, as per map or plat thereof recorded in Volume 8, Page 32 of the Map Records of said County and State, said tract being more particu- larly described by metes and bounds as follows, to -wit: FOR A LOCATIVE POINT, the intersection of the South line of East Lavaca and the West line of University Drive being the Northeast corner of Lot 9, Block 1 of .University Place Second Addi- tion to The City of Beaumont; THENCE North 89°18'15" West, 121.25 feet along the South line of East Lavaca to the PLACE .OF BEGINNING of the herein described tract of land; THENCE continuing North 89018'15" West, 63.00 feet along the South line of East Lavaca to a point for corner; THENCE South 00030'45" West, 2.39 feet along the West line of said Lot 7 to a point for corner; THENCE South 87000'48" East, 63.04 feet to a point for corner in the East line of Lot 7; THENCE North 00°30'45" East, 4.91 feet along said East line to the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 230.0 square feet more or less. TRACT NO. 2: BEING a 366.6 square foot tract of land out of Lot 8, Block 1 of University Place Second Addition to The City.of Beaumont, Jefferson County, Texas, as per map or plat thereof recorded in Volume 8, Page 32 of the Map Records of said County and State, said tract being more particularly described by metes ,and bounds as follows,.to-wit: . FOR A LOCATIVE POINT, the intersection of the South line of East Lavaca and.the West line of University Drive being the Northeast corner of Lot 9, Block 1. of University Place Second Addition to The City of Beaumont; THENCE North 89018'15" West, 61.25 feet along the THENCE continuing North 89018'15" West, 60.00 feet along the South line of East Lavaca to a point for corner; THENCE South 00030'45" West, 4.91 feet along the West line of said Lot 8 to a point for corner; THENCE South 87000148" East, 60.04 feet to a point for corner in the East line of Lot 8; THENCE North 00030'45" East, 7.31 feet along said East line to the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 366.6 square feet more or less. THENCE South 00030'45" West, 7.31 feet along the West line of Lot 9 to a point for corner; THENCE South 89000'48"East, 11.26 feet to an angle point; THENCE South 51033'15" East, 39.43 feet to an angle point; THENCE South 00030'45" We ---t, 82.15 feet to a point in .the South line of Lot 9 for corner; THENCE South 89018'15" East, 20.00 feet along said South line to a point.for corner; THENCE North 00030145" East, 114.15 feet along the East line of Lot 9 to.the PLACE OF BEGINNING of the herein described tract of land; CONTAINING 22964.1 square feet more or less. PROVIDED, however, there„is excluded from -said estate to be condemned and reserved to the owners thereof all of the oil, gas and sulphur beneath said land; and provided further that the rights FH 1C/1I33, of access, ingress and egress to and from the said East Lavaca Street of the remaining premises of defendants are not to be con- demned.
