necessary to'locate, construct, maintain, straighten, widen and:
extend East Lavaca Street in.The City,of Beaumont, Jefferson
County, Texas; -and
WHEREAS, said City Council has.found that public necessity
requires the location, construction, maintenance, straightening;
widening and extension of said street on. the hereinafterdescribed
property; and,
WHEREAS, said C.ity,Council deems it, necessary to acquire, the
hereinafter described interest in and to the hereinafter described.
property for said location, construction, maintenance, straighten-
ing, widening.and extension of said street, and .the said City,
Council has found and determined 'that the said interest in and to
the hereinafter described land is stiite.d' for such purposes ,and, that
it is necessary to acquire same for said purposes; and,
WHEREAS, The City of Beaumont, through-its�duly authorized,
representatives, has negotiated with the owners of the hereinafter
described, land and has been unable to agree with the owners of such .
,property as..to,. the fair cash value 'thereof and ' damages;if an.y, NOW;
THEREFORE,
BE IT RESOLVED BY THE CITY -COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:'
that Kenneth Wall, City -Attorney, be, ,,and he is' hereby, authorized
and 'directed to file or cause to be fil"ed-against all owners of
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described.parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
TRACT NO. 1
BEING a 906.4 square foot tract of land situated
in the J. W. Bullock League and being out of Lot 1
and the North one-half of Lot.2, Block 3-A of the
W. W. Chaison Addition to the City of Beaumont,
Jefferson County, Texas, as per map or plat of
said Addition being recorded in Volume 91, Page
395 of the Map Records of said County and State,
said tract being more particularly described by
metes and bounds as follows, to -wit:
FOR A LOCATIVE POINT, the intersection of the
South line of Lavaca Street and the West line of
Highland Avenue, said point being the Northeast.
corner of Lot 1, Block 3-A of the aforementioned
subdivision;
THENCE South 00°44'45" West, 75.0 feet along the
West line of Highland Avenue to a point;
THENCE North 89015'15" West, 85.34 feet to the
PLACE OF BEGINNING of the herein described tract
of land;
THENCE CONTINUING North 89015'15" West, 62:16 feet
to a point for corner in the West line of Lot 2 of
said subdivision;
THENCE North 00044'45" East, 30.87 feet with the
West line of'said Lot 2 and Lot 1;
THENCE deflecting to the left along the arc of a
curve with a radius of 527.0 feet a distance of
.69.45 feet to the PLACE OF BEGINNING of the.herein
described tract of land (chord of said curve bears
South 62050'26" East, 69.40 feet);
CONTAINING 906.4 square feet more or less.
TRACT NO. 2
BEING a 339.7 square foot,tract of land out of
Lot 1, Block "B" of the Resubdivision of the

State, said tract being more particularly described
by metes and bounds as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of the
South line of Lavaca Street and the West line of
Lakner Street, said point being the Northeast
corner of Lot 1, Block "B" of the Resubdivision of
the W. W. Chaison Addition to the City of Beaumont;
THENCE South 00°.44'45" West., 11.40 feet along the
East line of said Lot 1 to a point for corner;
THENCE deflecting to the left along the arc' of a
curve with the radius of 360.64 feet for a dis-
tance of 90.92 feet to a point of tangency in the
North line of the aforementioned Lot 1 (chord of
said curve bears North 82°01'55" West, 90.68,.
feet) ;'
THENCE South 89015'15" East, 89.96 feet along the
North line of said Lot 1 to a point and the PLACE
OF BEGINNING of the herein described tract of
land;
CONTAINING 339.7 square feet more or less.
PROVIDED, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all the oil, gas and
sulfur beneath said land; and provided further that the rights of
access, ingress and egress to and from the said East Lavaca Street
of the remaining premises of defendants are not to be condemned as
to Tract No. 2 only.
