WHEREAS, the City Council of The City of Beaumont deems it
necessary to locate, construct, maintain, straighten, widen and,
extend East Lavaca Street in The City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, said City Council has found that public necessity
requires the location, construction, maintenance, straightening,
widening and extension of said street on the hereinafter described
property; and,
WHEREAS, said City Council deems it necessary to acquire .the,
hereinafter described interest_,in and to the hereinafter described.
property for -said location, construction, maintenance, straighten-
inig, widening,and extension of said street, and the said City
Council has found and determined that the'said interest in and to
the hiereinafter'described land is suited for such.purpdses.and�that
it is.necessary, to acquire same' for said purposes; and,

WHEREAS, The City,of Beaumont, through its .duly authorized
representatives, has negotiated with the owners- of the hereinafter .
described land.and'has been unable to agree with the owners of such
property as;.. to .,the fair cash value thereof and damages, if any; NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT, , TEXAS:
that Kenneth:Wall, City Attorney, be, and he is hereby, authorized.
and directed to file or cause to' be filed against all owners of
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
BEING a 1,168.5 square foot tract of'land out of Lot
18, Block 1 of University Place Addition to The City
of Beaumont, Jefferson County, Texas, as per map or
plat of said addition recorded in Volume 7, Page 45
of the Map Records of said County and State, said
tract being more particularly described by metes and
bounds as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of the
East line of University Drive and the North line of
East Lavaca, being the Southwest corner of Lot 18,
Block 1 of University Place.Addition;.
THENCE South 89°18'15" East, 121.09 feet along the
North line of East Lavaca to a point for corner;
THENCE North 00°32145" East, 9.93 feet along the East
line. -of said Lot 18 to a point for corner;
THENCE North 89034'15" West, 121.09 feet along the
North line of the.herein described tract to a point
for corner;
THENCE South 00034'45" West, 9.37 feet along the East
line of University Drive to a point and PLACE OF
BEGINNING of the herein described tract of land;
CONTAINING 1,168.5 square feet more or less.
Provided, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all the oil, gas and
sulfur beneath said land; and provided further that the rights of
access, ingress and egress to and from the said East Lavaca Street
of the remaining premises of defendants are not to be condemned.
