RESOLUTION
WHEREAS, the City Council of The City of Beaumont deems it
necessary to locate,,construct, maintain, straighten, widen and'..
extend East Lavaca Street in The City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, said City Council has found that public necessity
requires the location, construction, maintenance, straightening,..
widening and extension of said street on the hereinafter described
property; and,
WHEREAS, said City Council deems it necessary to acquire..the
hereinafter described interest in and'to the hereinafter described.
property for said location, construction, maintenance, straighten-
ing widening and extension of said street and the said City",-
Council has found and determined that the said interest in and to
the hereinafter.desc'ribed land is suited for 's'uch, purposes and that
it isnecessary to acquire,.same for said purposes;,and,
WHEREAS, The City of Beaumont, through-its.duly:authorized
representatives, has`'negotiated with the owners of the hereinafter
described land and has been unable to agree with the owners. of such
property as to the fair cash value thereof and damages, if any, NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
..OF THE,CITY OF BEAUMONT, TEXAS:
that Kenneth Wall, City Attorney, be, and he is hereby; authorized
and directed to file or cause to be filed against all owners of
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for.
said purpose, in and to the following described parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
BEING a 936°0 square foot tract out of Lot. 12,
Block 2 of University Place Addition to The City
of Beaumont, Jefferson County,' Texas, as per map
or plat thereof recorded in Volume 7, Page 45 of
the Map,Records of said County and State, said
tract being more particularly described as follows,
to -wit:
FOR THE PLACE OF BEGINNING, the intersection of the
West line of University Drive and the North line of
East Lavaca, said point being the Southeast corner
of Lot 12, Block 2 -of University Place Addition;
THENCE North 00034145" East, 10.20 feet along the
West line of University Drive to a point for corner;
THENCE South 88018124" West, 120.08 along the North
line of the herein described tract of land to a point
for corner;
THENCE South 00034'45" West, 5.40 feet along the West
line of the aforementioned Lot 12 to a point for
corner;
THENCE South 89018'15" East, 120.00 feet along the
North line of East Lavaca to a point for corner and
PLACE OF BEGINNING of the herein described tract of
land;
CONTAINING 936.0 square feet more or less.
PROVIDED, however, there -is excluded from said estate to be
condemned and reserved to the owners thereof all of the oil, gas
and sulphur beneath said land; and provided further that the rights
of access, ingress and egress to and from the said East Lavaca
Street of the remaining premises of defendants are,not to be con-
demned.
