R E S O,L- U T 10, N
WHEREAS,. the City' Council' of The City of Beaumont deems it
necessary to lo'6a'te;,construc't".maintai,n, straighten, widen and
extend East Lavaca Street in The City of Beaumont,, Jefferson
County, Texas; and,
WHEREAS, said City Council has 'found that public necessity
requires the location, construction, maintenance., straightening,
widening and extension of -said street on the hereinafter described
property; and
WHEREAS, said City Council deems it necessary to acquire,the
hereinafter described interest in and to the hereinafter described
property for said location., construction, maintenance," straighten-
ing,. widening and extension of said street, and the.said City,
Council has found and determined that the said interest in and to
a
the hereinafter: -described land is suited-f6e such purposes and that -
:it is necessary Lo.a,cquire same for said purpose's; and,
WHEREAS The City of Beaumont 'through, its duly auLhori'zbd-
representatives,' has negotiated with' the,owners
of. the hereinafter
described land and has been unable to agree with.the owners of such -
property as to the fair cash value thereof and'damages, 'if any; 'NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE, CITY -OF BEAUMONT,, TEXAS:
that Kenneth Wall, City'A'ttorney, be, and he is hereby' authorized
and directed to file or cause to be filed against all owners of,
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described parcel of land
in Beaumont, Jefferson County, Texas, to -wit:
BEING a 360.0 square foot tract of land out of
Lot 13, Block 2 of the University Place Addition
to The City of Beaumont, Jefferson County, Texas,
as per map or plat of said addition recorded in
Volume 7, 'Page 45 of the Map Records of said County
and State, said tract being more particularly
described by metes and bounds as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of'the
East line of Hartel Street and the North line of
East Lavaca, said point being the Southwest corner
of Lot 13, Block 2 of University Place Addition;
THENCE South 89018'15" East, 120 feet to a point for
corner;
THENCE North 00034145" East, 5.40 feet along the
East line of Lot 13 to a point for corner;
THENCE South 88024'18" West, 120.08 feet along the
North line of the herein described tract of land
to a point for corner;
THENCE South 00034'45" West, 0.60 feet along the
East line of Hartel Street to a point being the PLACE
OF BEGINNING of the herein described tract of land;
CONTAINING 360.0 square feet more.or less.
PROVIDED, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all of the oil, gas
and sulphur beneath said land; and provided further that the rights
of access, ingress and 'egress to and from the said East Lavaca
Street of the remaining premises of defendants are not to be con-
demned.
