WHEREAS, the City Council of The City of Beaumont deems it

extend East Lavaca Street in The City of Beaumont, Jefferson
County, Texas; and,
WHEREAS, said City Council has found -that public necessity.
requires the location, construction,.main.tenance, straightening,
widening and extension of said street on the hereinafter described
property; and,
WHEREAS, said City Council deems it necessary to acquire 'the
hereinafter described interest in and'to`the hereinafter described'
...property for said location, construction, maintenance, straighten-
ing, widening and extension of said -street, and the said City
-Council has found rand determined.that;the said interest in and to
the hereinafter .descri,b,ed.", land 'is, suited .for, such purposes and -that
itis nece's'sary to acquire,.same for said purposes; and,
WHEREAS, The City of„Beaumont, through its duly authorized
representatives,.has,negotiated with the owners of the hereinafter
described land and has been unable to agree with the owners of such
propertyas to the fair cash value thereof and damages,'if any, NOW,
THEREFORE,
BE -IT RESOLVED BY'THE CITY COUNCIL
OF THE CITY OF BEAUMONT, TEXAS:
that, Kenneth Wall, City Attorney, be, and he is hereby, authorized
and directed to file or cause to be filed against 'all owners of
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
BEING a 8,574.8 square foot tract of land out of Lots
9 and 10, Block "A" of Granberry's Subdivision of
Blocks 12 and 3 of the W. W. Chaison Addition to the
City of Beaumont, Jefferson County, Texas, as per
map or plat thereof filed of record in Volume 91,
Page 395 of the Deed Records of said County and State,
said tract being more particularly described by metes
,and bounds as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of the
South line of Lavaca Street and the East line of
Lakner Street, said point being the Northwest corner
of Lot 9, Block "A" of the aforementioned subdivision;
THENCE South 89°15'15" East, 78.70 feet along the
North line of said Lot 9 to an angle point;
THENCE South 53048'15" East, 31.00 feet to a point of
curvature;
THENCE deflecting to the left along the arc of a
curve with a radius of 527.0 feet for a distance of
48.28 feet to a.point of tangency in the East line
of the aforementioned Lot 9 (chord of said curve
bears South 56°25'43" East, 48.26 feet);
THENCE South 00044'45" West, 62.87 feet along the
East line of'Lot 9 and 10 of said subdivision to a
point for corner in the Southeast corner of the afore-
mentioned Lot 10;
THENCE North 89015'15" West, 10.44 feet along the
South line of said Lot 10 to a point for corner;
THENCE deflecting to the right along the arc,of a
curve with a radius of 587.0 feet a distance of 76.43
feet to a point'of a reserve curve (chord of said -
curve bears North 57°32'04" West, 76.38 feet);
THENCE deflecting to the left along the arc of a
curve with a radius of 360.64 feet a distance of
64.08 feet to an angle point (chord of said curve
bears North 58°53'41" West, 64.0 feet);

THENCE North 00044'45" East, 39.5 feet along the
West line of Lot 9 to the PLACE OF BEGINNING of the
herein described tract of land;
CONTAINING 8,574.8 square feet more or less.
Provided, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all the oil, gas and
sulfur beneath said land.
