R'ESOL.U,TION
WHEREAS., the City Council of The City of Beaumont deems it
necessarytolocate, construct, maintain straighten, widen and d
extend East Lavaca Street in The City of Beaumont, 13'efferson
County, Texas; and,
WHEREAS, said City Council has found that public
necessity
requires the location
construction, maintenance, straightening,
widening and extension of said street.on the hereinafter described
property; and,
WHEREAS, said City Council deems it necessary to acquire the
hereinafter described interest in
and Co the hereinafter described
propertyfor said location, construction, maintenance, straighten-
ingj- widening:'and extension- of -said street,
and the said City

purposes and that

WHEREAS,, The City 'o f Beaumont,. through its -duly authoriz'ed
representatives, has negotiated with the owners of the hereinafter
described land and has been unable to agree with the owners of such
property as to�the- fair cash value thereof and damages, if any,,NOW,
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMO.NT,-'TEXAS:
that Kenneth Wall, City Attorney, be, and he is:hereby,.authorized
and directed to file or cause to be filed against all owners of'
the hereinafter described property, and claimants of interest
therein, Proceedings in Eminent Domain to acquire fee title, for
said purpose, in and to the following described parcel of land
situated in Beaumont, Jefferson County, Texas, to -wit:
TRACT NO. 1
BEING a 417.6 square foot tract of land out of
Lot 1, Block l of Grandberry Addition to The City
of Beaumont, Jefferson County, Texas, as per map_
or plat of said addition recorded in Volume 4,
Page 10 of the Map Records of said County and
State, said tract being more particularly described
by metes and bounds as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of the
South line of East Lavaca -and the East line of
Sullivan Street, being the Northwest corner of
Lot 1, Block 1 of Grandberry Addition to The City
of Beaumont;
THENCE South 00046'45" West, 18.09 feet along the
East line of Sullivan.Street to a point for corner;
THENCE North 47015'54" East, 24.51 feet to an angle
point.;
THENCE South 88032'57" East, 121.24 feet to a point
in the East line of said Lot 1 for corner;
THENCE North 00046145" East, 2.83 feet to a point
for corner in the South line of East Lavaca;
THENCE North 89018'15" West, 139.0 feet along the
South line of East Lavaca to a point being the PLACE
OF BEGINNING.of the herein described tract of land;
CONTAINING 417.6 square feet more or less.
TRACT N0. 2
BEING a 503.3 square foot tract of land out of Lot 1,
Block 1 of Keith Park Addition to The City of Beau-
mont, Jefferson County, Texas, as per map or plat of
said addition recorded in Volume 6, Page 138 of the
Map Records of said County and State, said tract'be-
ing more particularly described by metes and bounds
as follows, to -wit:
FOR A PLACE OF BEGINNING, the intersection of the South
line of East Lavaca and the West line of Maddox Street,
being the Northeast corner of Lot 1, Block 1 of Keith
Park Addition to The City of Beaumont;
THENCE North 89018'15" West, 102.3 feet along the
South line of East Lavaca to a point for corner;
THENCE South 00046'45" West, 3.92 feet to a point for

THENCE South 88010'35" East, 102.3 feet to a point
for corner in the East line of the aforementioned
Lot 1;
THENCE North 00046'45" East, 5.93 feet along the
West line of Maddox Street to the PLACE OF BEGINNING
of the herein described tract of land;
CONTAINING 503.3 square feet more or less.
PROVIDED, however, there is excluded from said estate to be
condemned and reserved to the owners thereof all of the oil, gas
and sulphur beneath said land; and provided further that the
rights of access, ingress and egress to or from the said East
Lavaca Street of the remaining premises,of defendants are not to
be condemned.
PASSED BY THE CITY COUNCIL this the day of December,
1973.
