R E S O L U T I O N
WHEREAS, 'the City Council of The City of Beaumont
deems it necessary to locate, construct, maintain, straighten,
widen and extend Major Drive in The City of Beaumont, Jeffer-
son County, Texas; and,
WHEREAS, said City Council has found that public
necessity requires the location, construction, maintenance,
straightening, widening and extension of Major Drive on the
hereinafter described property; and,
WHEREAS, said.City Council deems it necessary to acquire
the hereinafter described interest in and to the hereinafter
described property for said location, construction, maintenance,
straightening, widening and extension of Major Drive, and the
said City Council has found and determined that the said interest
in and to the hereinafter described land is suitable for such
purposes and that it is necessary to acquire same for said
purposes; and,
WHEREAS, The City of Beaumont, through its duly authorized
representatives, has negotiated with the owners of the herein-
after described land and has'been unable to agree with the owners
of such property as to the fair cash value thereof and damages,
if any; NOW, THEREFORE,
BE IT RESOLVED BY THE'CITY COUNCIL OF THE CITY
OF BEAUMONT, TEXAS:
That Thad Heartfield, City Attorney, be, and he is hereby,
authorized and directed to file or cause to be filed against
all owners of the hereinafter described property, and claimants
of interest therein, Proceedings in Eminent Domain to acquire
an easement for street right=of-way, for said purpose, in and

ALL THAT CERTAIN tract or parcel of land being
a part of Lot 3, of the Subdivision of..the west
one half of the H. Williams Survey, Abstract 56,
Beaumont, Jefferson County, Texas, as recorded
in. Volume "D", Page 439 of the District Court
Minutes of Beaumont, Jefferson County, Texas,
and a part of that certain 20 acre tract described
and reserved in deed from W. Harry Longe to the
First Methodist Church dated March 24, 1964, and
recorded in Volume 1380, Page 46 of the Deed Records
of Jefferson County, Texas; said herein described
tract being more fully bounded and described as
follows:
BEGINNING at a 2" iron pipe at the southwest
corner of Lot 4 of�the subdivision of the
west one half of the said'Williams Survey,
same being the northwest corner of the said
Lot 3 of the subdivision of the west one
half of the said H. Williams Survey, and also
being the northwest corner of the said 20 acre
tract reserved in deed from W. Harry Longe
to the First Methodist Church of Beaumont,
Texas and further being located in an old
north, south, fence and the existing east
right-of-way line of FM 364 (Major Drive);
THENCE South eighty-nine degrees twenty-
seven minutes zero'seconds East (S 89027'00"
E) along and with the common boundary of the
said Lot 3 and Lot 4, same being -the north
boundary line of.the said 20 acre tract at
eighty-two and twenty-five hundredths feet
(82.25') pass a 2" pipe in the east line of
the proposed right`of-way requirements of
said FM 364 as staked on the ground by the
Texas State Highway Department and continuing
along said course for a total distance of one
hundred two and twenty-six hundredths feet
(102.26') to a point for the northeast corner
of the herein described tract;
THENCE parallel to and twenty feet (20.00')
distant from the east line of the proposed
Right of Way requirement of FM 364 as staked
on the ground by the Texas State Highway
Department South zero degrees fifty-four
minutes twenty-seven seconds East (S 000
54'27" E) for a distance of four hundred
eighty-five and eighty-two hundredths
(485.82'.) feet to a point -for corner;
THENCE Continuing parallel to and twenty feet
(20.00') distant from the east line of
the proposed Right of Way requirement of FM
364 as staked on .the ground by the Texas
State Highway Department. South one degree
thirty-three minutes thirty-three seconds
West (S 01033'33" W) for a distance cf one
thousand six hundred forty-four and three
hundredths feet (16.44.03') more or less to
a point for the southeast corner of the herein
described tract, said corner being in the
north right of way line of Gladys Avenue a
street of sixty feet (60') width and the south
line of that certain 20 acre tract reserved
in deed from W. Harry Longe to First Methodist
Church dated March 24, 1964 and recorded in
Volume 1380, Page 46 of the Deed Records of
Jefferson County, Texas;
THENCE west with the north line of said sixty
foot (60') right-of-way and the south line of
the said reserved 20 acre tract at twenty feet
(20') pass a three-fourths (3/4") inch iron
pin marking the intersection of the east line
of the proposed right-of-way requirement of
FM 364 as staked on the ground by the Texas
State Highway Department and the north line of
Gladys Avenue, and continuing along said course
for a total distance of fifty-nine and zero
hundredths feet (59.00') to an old cross tie
for fence corner in the existing east right-of-way
line of the said FM 364 (Major Drive);
THENCE North zero degrees one minute fifty-six
seconds East (N 00001'56" E) along and with the
.said existing east right-of-way line of said
FM 364 (Major Drive), and also along and near
an old fence three!hundred ninety and thirty-
five hundredths feet (390.35') to a point for
corner in said east right-of-way line and said
old fence;
THENCE North zero degrees twelve minutes forty-
seven seconds West (N 00012'471' W) continuing
along and with the.said.existing right-of-way
of FM 364 (Major Drive) and the said old fence,
eight hundred forty-six and ninety-four hundredths
feet (846.94') to a point for corner in the
said right-of-way line and said old fence;
THENCE North zero degrees twelve minutes twenty-
two seconds West (N 00012'.22" W) continuing a1rn g
the said existing right-of-way line of said
FM 364 (Major Drive) and the said old fence
five hundred and thirty-nine hundredths feet
(500.39') to a point for corner in the said
fence and existing right-of-way line;
THENCE North zero degrees zero minutes twenty
seconds East (N 00°00'20" E) continuing along
and with the said existing east right-of-way
line of FM 364.(Major Drive) and the said old
fence three hundred two and nineteen hundredths
feet (302.19') to a point for corner in said
old fence and existing east right-of-way line;
THENCE North zero degrees fifty-six minutes
forty-one seconds West (N 00056'41" W) continuing
along and with the said existing east right-of-way

CONTAINING 4.299 acres of land, more or less.
Provided, however, that the rights of access and ingress
and egress to and from the said Major Drive of the remaining
premises of the owners of such property shall not be condemned.
