A R E S 0 L U T I 0 N
WHEREAS, the City Council of the City of Beaumont,
deems it to be advisable and necessary to locate, construct,
operate and maintain a parking area at and in the immediate
vicinity of a library, to be used in connection with such
library and city hall for off-street parking and storage of
motor vehicles and other conveyances, and hereby finds and
declares the location, construction, operation and maintenance
of such parking area to be a municipal purpose; and,
WHEREAS, said City Council has found,that public
necessity requires the location, construction, operating and
maintenance of said parking area on the hereinafter described
property; and,
WHEREAS, said City Council deems it necessary to
acquire the fee title in and to the hereinafter described
property for said location, construction,.operation and
maintenance of said parking area, and the said City Council
has found and determined that the said interest in and to the
hereinafter described property is suitable for such purposes
and that it is necessary to acquire same for such purpose;
and,
WHEREAS, the City of Beaumont, through its duly au-
thorized representatives, has negotiated with the owners of
the hereinafter described property and, although it has
negotiated a purchase and consummated said purchase of the
interest of Edson Realty.Company, the record title owners of
the hereinafter described property, it has been unable to

agree with Mr. & Mrs. Kenneth Johnson, doing business as
Reliable Muffler Supply, claimants by virtue.of being a
lessee of the'hereinafter described property, as to the fair
cash value and damages, if any, of their leasehold interest;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT:
That Thad Heartfield, City Attorney, and Lavon L. Jones,
Assistant City Attorney,, be,.and they are hereby, authorized
and directed to file or cause to be filed against all owners
of the hereinafter described property, and claimants of in -
teres t
n-terest therein, proceedings in eminent domain to acquire fee
title for said property and the right of possession in and to
the following described parcel of land situated in Beaumont,
Jefferson County, Texas, to -wit:
Lots 560 and 561 of Block 5 of the Original
Townsite of Beaumont, Jefferson County,
Texas, as per map or plat filed in the office
of the County Clerk of Jefferson County, Texas.
PASSE by the City Council. this the day of
