A R E S O L U T I O N
WHEREAS, The Texas Highway Commission on October 30,
1970, passed Minute Order No. 64320 providing for the improve-
ment of Eleventh Street extending from Interstate Highway 10,
south to U. S. Highways 69, 96, and 287, a distance of approxi-
mately 3.7 miles and providing that the State Highway Department
will provide for the construction of pavement and its support,
channelization, traffic signals, signing and delineation within
these limits, at an estimated cost of $413,200, subject to the
condition that the City of Beaumont will provide for the adjust-
ment of utilities as may be required and provide for the construc-
tion of curb and gutter, storm sewers if required, driveways and
sidewalks and agree to make such installations in -accordance with
governing policies and regulations of the Highway Department; and
maintain all of the work constructed as a part of the project and
agree to regulate traffic and prevent encroachment on the right
of way;
WHEREAS, said Minute Order further directed the State
Highway Engineer to enter into an agreement with the City of
Beaumont covering the details of the proposed improvements and
to proceed with the engineering development of the project and
after the City has fulfilled its responsibilities, to procced
with construction as authorized in said Minute Order;
WHEREAS, said Minute Order further--provided--that it was
subject to acceptance by the City of Beaumont and if not accepted
within 90 days of this date, the action therein contained would
be automatically cancelled; and,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT
That Minute Order No. 64320 passed on October 30, 1970, by the
Texas Highway Commission be, and the same is hereby, accepted
by the City of Beaumont.
