A RESOLUTION
WHEREAS, on the 10th day of September, 1952, the City of
Beaumont, acting through its duly constituted City Council and
City Manager, did execute a certain -permit to the Department of
the Navy granting the right to construct, maintain, and operate
a wharf upon a strip of land one hundred (100') feet along and
ninety (90') feet wide, lying between Riverside Drive and the
waters edge of the Old Channel of the Neches River as an access
way to the Naval Reserve Wharf facilities constructed in the river;
and.,
WHEREAS, the Department of the Navy, by acting in pursuance
of said permit, thereafter created a bilateral contract; and,
WHEREAS, the Port of Beaumont now desires the area upon
which the wharf was constructed for further development of the
Port; and,
WHEREAS, it appears to be in the best interest of the City
of Beaumont and the citizenry thereof to formally rescind the said
permit;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BEAUMONT:
That the City Manager be, and he is hereby, authorized to
execute an instrument rescinding the said permit to the Department
of the Navy.
