INTER -OFFICE MEMORANDUM -
CITY OF BEAUMONT, TEXAS
Date June 3, 1970
Thad Heartfield, City Attorney
Kenneth E. Wall, Jr., Assistant City Attorney
Claim Against Mattie C. Matte
COMMENT:
On May 15, 1970, a City of Beaumont police car was
involved in a collision with a car driven by Mrs. Matte. The
police car was responding to an emergency call and had its
emergency equipment on. However, it did run a red light and
did collide with Mrs. Matte.
The lowest estimate of damage to the police car is
$672.84. Mrs. Matte's insurer, State Farm, has offered to
settle our damages for $500.00.
I recommend that we accept the $500.00. There is a
strong question of contributory negligence in this case and
our possibility of recovering upon trial of the suit is doubtful.
$500.00 would be paid to us immediately and I feel that this is
better than waiting around for $672.84.
If you agree, please initial this memorandum and return
it to me, and I will prepare the resolution for Council action
next Tuesday.
