Phelan) is desirous of making a gift of the herein described property in memory of his late father, John Henry Phelan, commonly known as J. Harry Phelan, an earlier pioneer of the City, who in his time contributed greatly to its growth and prosperity; and, 0 WHEREAS, Anthony M. Phelan, Sr. (also known as A. M. Phelan) did execute and deliver to The City of Beaumont, Jefferson County, Texas, a deed of conveyance dated January 165 1970, to such property being more particularly described as follows, to wit: Being the northerly 100 feet of that portion of Lots 1 through 4 of the A. K. Daniels Sub- division north of Hillebrandt Bayou and south of Broadway Place Addition in,the Hezekiah Williams League, Beaumont, Jefferson County, Texas,'conveyed by J. Weingarten, Incorporated to Anthony M. Phelan, Sr. (also known as A.. M. Phelan) by deed dated March 24, 1965 and recorded in Volume 1420, Page 138 of the Deed.Records- of Jefferson County, Texas, and being more parti- cularly described.as follows: Beginning at a concrete monument in the north line of the now abandoned Missouri Pacific Railroad Company right of way, said point being the northeast corner of that certain property conveyed by said J. Weingarten, Incorporated to said Anthony M. Phelan, Sr. on said March 24, 1965, also being in the west line of the Noah Tevis Survey, the east line of the Hezekiah Williams League and marking the southeast corner of Broadway Place Addition to the City of Beaumont; Thence in a westerly direction along the north line of the now abandoned Missouri Pacific Rail- road Company right of way or the north line of the property conveyed by the said J. Weingarten, Incorporated to the said Anthony M. Phelan, Sr., same also being the south line of said Broadway Place Addition to the northwest corner of the above mentioned property conveyed by J. Wein- garten, Incorporated to Anthony M. Phelan, Sr., said point also being in the east line of Maplewood Addition to the City of Beaumont ex- tended northward; Thence in a southerly direction along the west 1-0._v-111 LO (100) feet perpendicularly distant from the said northwest corner of said property, said point also being the northeast corner of said Maplewood Addition and also being in the south line of the now abandoned Missouri Pa- cific Railroad Company right of way; Thence in an easterly direction along the south line of the now abandoned Missouri Pacific Railroad Company right of way, same being parallel with and one hundred (100) feet perpendicularly distant from the north line of said railroad right of way or the north line of said property conveyed by J. Weingarten, Incorporated to said Anthony M. Phelan, Sr. to the east line of said property, said point being in the west line of said Noah Tevis Survey of the east line of the Hezekiah Williams League; Thence in a northerly direction to the place of beginning, containing approximately two (2).acres of land, more or less. WHEREAS, the City Council and the citizens of Beaumont recognize this gift to be a great value to the City of Beaumont and to its future progress, and reflects this civic -minded spirit of the Phelan family; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BEA.UMONT: That the deed for the said property is hereby accepted by The City of Beaumont in memory of the late J. Harry Phelan; Be it further resolved that The City of Beaumont, acting herein by and through its Mayor and City Council, does hereby express its appreciation and recognition of the gen- erosity of the donor, Anthony M. Phelan, Sr. (also known as A. M. Phelan) by naming a street contemplated for the future of the City to be built generally along the abandoned ease- ment of the old Missouri Pacific right of way west of 23rd Street as the J. Harry Phelan Avenue; and, Be it further resolved that a copy of this Resolution be entered into the minutes of the City Council of The City of Beaumont, Texas, this 20th day of January, A.D. 1970 and that a copy be delivered to the press and to the donor, and
