GRANTING to the Texas and flew Orleans Railroad Company, its
successors and assigns, the right and privilege to construct and main—
tain the certain following described railroad trackage in, along, u-o—
on and across Hickory and Cypress Streets, being described as follows,
to—wit: First, one certain extension track commencing at the end of
the Texas and New Orleans Railroad Company's most northerly track in
Hickory Street approximately midway between Travis and Cypress Streets
and extending eastward from Hickory Street, crossing Cypress Street
and entering Block No. 23 of the Original Torun of Beaumont near the
southwest corner thereof. Second, one certain spur tract springing
from the Texas and New Orleans Railroad Company's most southerly track
in Hickory Street.at a point approximately midway between Travis and
Cypress Streets and extending eastward along Hickory Street, crossing
Cypress Street and. entering Block. No . 7 of the Original Town of Beau—
mont near the northwest corner thereof; with the right to maintain
and operate its trains and cars thereover for a. period to expire at
the same time with its franchise for trackage now operated and main—
tained upon, along and over Hickory Street, and prescribing the con—
ditions to be ful-f it led before said ordinance shall go into effect
and the time limit for -the removal of said -trackage and prescribing
the conditions thereof. .
BE IT ORDAINED BY THE CITY COIvWISSION OF THE CITY
OF BEAULiONT
SECTION I.
-That the Texas and l"ew Orleans Railroad Company, its suc-r
cessors.,and assigns, a.re hereby granted the right and privilege to
construcx -t and maintain, at its own expense, first, a single, standard
guage extension track commencing at the end of the Texas and. Nev Or—
leans Railroad Company's most northerly track in Hickory Street ap—
proximately midway between Travis and Cypress Streets and extending
eastward along Hickory Street, crossing Cypress Street and entering;
Block No. 23 of the Original Town of Beaumont near the southwest cor—
ner thereof.
Second, that the Texas and New Orleans Railroad Company,
its successors and assigns, are hereby granted the right and pri`rilege
to construct and maintain, at its own expense, a single, standard
guage spur track springing from the most southerly track in Hickory
Street at a point approximately midway between Travis and Cypress
streets and extending eastward along Hickory Street, crossing Cypress

understood and agreed that the above described railroad trackage
is laid as industrial trackage for the purpose of reaching commer—
cial and industrial enterprises located along the right of way over
which said trackage is authorized to be laid.
SECTION 2.
The Grantee, its successors and. assigns., shall have the
right to operate trains, engines and cars over said trackage when
.done so to .further the interest for which this grant is given as
stated in the latter portion of Section I hereof.
SECTION 3.
That the said Texas and New Orleans Railroad Company shall
be required, at its own expense, to construct and maintain suitable
ditches and culverts for the purpose of properly draining said Streets
along, upon and over which said railroad trackage is authorized to be
laid and at its own expense to gravel orshell said Street where not
paved, and to construct and maintain, at its own expense, good and :tuf—
ficient crossings at the intersections of" all cross streets crossed --- ---
by said railroad tracks with easy approaches thereto and on crossings
on paved streets to construct permanent crossings in accordance with
blue print attached hereto and marked Exhibit B and under the direction
of the City Engineer.
SECTION 4.
The trackage herein described shall be laid under the direction
and supervision of the City Engineer of the City of Beaumont and should
a dispute over said construction arise, the Grantee, its successors and
assigns, hereby agree to refrain from doing said work or any part there—
of until the matter of dispute has been settled -by the City Comnai ssion__.

SECTION 5.
This ordinance is passed subject to all the terms and pro—
visions of the Charter.of the City of Beaumont.

file with the City Clerk its written acceptance of this ordinance and
upon the further condition that the trackage -to be constructed here-
unddr. shall 'be completed within one hundred eighty (180) days from
the passage hereof and upon the failure of the Grantee, its successors
or assigns, to file its acceptance as provided herein, then this fran-
chise shall be null and void and become of no -6 further force nor effect.
SECTION 7.
This ordinance shall go into force and. effect from and after
its passage and approval by the Mayor and the filing of the written ac-
ceptance as provided in Section 6 hereof and the lawful publication as
provided by the City Charter and shall continue for a period to expire
at the same time with the franchise for trackage now operated and main-
tained upon, along -and over Hickory Street.

On February 20, 1906, there was an ordinance
passed giving the Texas ac New Orleans Railway Company
a franchise to construct and operate a switch or spur
track from a connection with its present spur track
on Hickory Street at the north corner of Block 14 at
the,intersection of Main and Bowie Streets, thence
across Main Street, thence extending along Hickory
Street and across Travis Street to the west line of
Cypress Street. This franchise was granted for a
period of twelve years from the date of final passage
and approval by the Mayor, which date wad February 20i
1906. This Ordinance is No. 45 A 2.

In regard to your inquiry as to whether
the Texas & New Orleans Railway Company has
a
franchise for two railroad tracks on Hickory
Street,
a-
I wish to state the following:
'
On February 8, 1899, there was an
ordinance
passed giving this Company a franchise to own,
operate
and maintain a track extending from point of
connection
with its main track reaching into and along
Main Street,
thence into the Mills of -the Texas Tram and
Lumber Com—
pany.
On February 20, 1906, there was an ordinance
passed giving the Texas ac New Orleans Railway Company
a franchise to construct and operate a switch or spur
track from a connection with its present spur track
on Hickory Street at the north corner of Block 14 at
the,intersection of Main and Bowie Streets, thence
across Main Street, thence extending along Hickory
Street and across Travis Street to the west line of
Cypress Street. This franchise was granted for a

I am attaching print of sketch showing pro-
posed location and method of installation of two tracks in
Hickory Street, in accordance with understanding reached with
yourself and Mr. Black, at Beaumont, on June 22nd®
We are requesting authority for expenditure
necessary to install the two tracks across Cypress Street,
which installation we expect to make just as soon as possible
with the understanding that our petition for the two.tracks
across Cypress Street is approved.
'Ile have ordered necessary gravel for resur-
facing the tracks and roadway in Hickory Street and will see ,
that they are kept in good condition until such time the Street
is 1oaved.
